AB78,1,3 1An Act to amend 13.48 (10) (a); and to create 16.85 (17) of the statutes;
2relating to: a study requirement with respect to certain proposed new state
3facilities.

This bill provides that the Department of Administration (DOA), at the request
of the Building Commission, shall perform a consolidation study with respect to any
proposed new enclosed state facility which shall examine the existing state facilities
located within 30 miles of the site of the proposed new facility that could be used to
meet the need for the proposed new facility, the suitable enclosed space within those
facilities, the age of those facilities, and the land surrounding those facilities that
would be available for expansion of those facilities. The bill prohibits the Building
Commission from approving a project to construct a new enclosed state facility before
receiving such a study from DOA pertaining to the proposed construction.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB78, s. 1 4Section 1. 13.48 (10) (a) of the statutes is amended to read:

113.48 (10) (a) No state board, agency, officer, department, commission or body
2corporate may enter into a contract for the construction, reconstruction, remodeling
3of or addition to any building, structure, or facility, in connection with any building
4project which involves a cost in excess of $150,000 without completion of final plans
5and arrangement for supervision of construction and prior approval by the building
6commission. The building commission shall not approve a project to construct a new
7enclosed state facility before receiving a consolidation study from the department of
8administration pertaining to the proposed construction.
The building commission
9may not approve a contract for the construction, reconstruction, renovation or
10remodeling of or an addition to a state building as defined in s. 44.51 (2) unless it
11determines that s. 44.57 has been complied with or does not apply. This section
12applies to the department of transportation only in respect to buildings, structures
13and facilities to be used for administrative or operating functions, including
14buildings, land and equipment to be used for the motor vehicle emission inspection
15and maintenance program under s. 110.20.
