SENATE AMENDMENT 1, TO ASSEMBLY BILL 27

October 8, 2013 - Offered by Senators Vinehout, Harris, T. Cullen, C. Larson, Lassa, Hansen, Carpenter, Risser and L. Taylor.

AB27-SA1,1,1 At the locations indicated, amend the bill as follows:

AB27-SA1,1,2 1. Page 1, line 3: delete "on a contingent fee basis".

AB27-SA1,1,5 2. Page 2, line 4: delete the material beginning with "If the" and ending with "shall be" on line 6 and substitute "The contract shall be subject to s. 20.9305, shall be".

AB27-SA1,1,6 3. Page 2, line 8: after that line insert:

AB27-SA1,1,7 " Section 1m. 16.705 (1) of the statutes is amended to read:

AB27-SA1,1,12 16.705 (1) The department or its agents may contract for services which can be performed more economically or efficiently by such contract. The department shall, by rule, prescribe uniform procedures for determining whether services are appropriate for contracting under this subsection. If the services are legal services, the contract is subject to s. 20.9305.

AB27-SA1,1t Section 1t. 20.930 of the statutes is amended to read:

AB27-SA1,2,4 20.930 Attorney fees. Except as provided in ss. 5.05 (2m) (c) 7., 46.27 (7g) (h), 49.496 (3) (f), and 49.682 (6), no state agency in the executive branch may employ any attorney until such employment has been approved by the governor and any contract for legal services is subject to s. 20.9305.".

AB27-SA1,2,5 4. Page 2, line 16: delete " on a contingent fee basis".

AB27-SA1,2,9 5. Page 2, line 17: delete the material beginning with "Except" and ending with "apply" on line 19, including the material inserted by assembly amendment 4, and substitute "An agency in the executive branch may contract for legal services only".

AB27-SA1,2,11 6. Page 2, line 20: delete the material beginning with "on a" and ending with "basis" on page 3, line 1.

AB27-SA1,2,12 7. Page 3, line 16: delete "contingency".

AB27-SA1,2,13 8. Page 4, line 1: delete "contingency".

AB27-SA1,2,14 9. Page 4, line 3: delete "contingency".

AB27-SA1,2,15 10. Page 4, line 23: delete "contingency fee".

AB27-SA1,2,16 11. Page 5, line 3: delete "contingency".

AB27-SA1,2,17 12. Page 5, line 21: delete "contingency fee".

AB27-SA1,2,18 13. Page 6, line 6: delete "contingency".

AB27-SA1,2,20 14. Page 6, line 17: delete lines 17 and 18 and substitute "account, and any contract for the legal services is subject to s. 20.9305.".
