1An Act to amend 79.15 and 230.12 (1) (b); and
to create 16.705 (1s) and 20.505
2(1) (ch) of the statutes;
relating to: payments to public employees affected by
32011 Wisconsin Act 10; increasing the amount of the first-dollar credit;
4transfers to the budget stabilization fund; and base wages paid to state
5employees and individuals providing services to the state pursuant to contract.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

1. 16.705 (1s) of the statutes is created to read:

(1s) (a) In this subsection:

1. "Contractor" means a person who provides services under a contract with the
9state under this subchapter, either directly or as a subcontractor.

2. "Employee" means an individual who is employed by a contractor to perform
11work under the contract.

1(b) A contractor shall pay an employee for work performed under the contract
2an hourly base wage that is no less than $11.

879.15 Improvements credit. The total amount paid each year to
9municipalities from the appropriation account under s. 20.835 (3) (b) for the
10payments under s. 79.10 (5m) is $75,000,000 in 2009, $145,000,000 in 2010,
and 11$150,000,000
in each year beginning in 2011
and ending in 2014, and $625,000,000
12in 2015 and in each year thereafter.

4. 230.12 (1) (b) of the statutes is amended to read:

Schedules. The several separate pay schedules may incorporate
15different wage and salary administration features. Each schedule shall provide for
16pay ranges or pay rates and applicable methods and frequency of within range pay
17adjustments based on such considerations as competitive practice, appropriate
18principles and techniques of wage and salary administration and determination,
19elimination of pay inequities based on gender or race, and the needs of the service.
20Not limited by enumeration, such considerations for establishment of pay rates and
21ranges and applicable within range pay adjustments may include provisions
22prevalent in schedules used in other public and private employment, professional or
23advanced training, recognized expertise, or any other criteria which assures state
24employee compensation is set on an equitable basis.
No pay schedule may include
25a base wage of less than $11 an hour.".

payment of moneys to public employees affected by 2011 Wisconsin Act 10. 3The department of administration shall calculate the increase in retirement and
4other benefit contributions for public employees resulting from the enactment of
52011 Wisconsin Act 10 before the effective date of this subsection. No later than 60
6days after the effective date of this subsection, the department shall pay to each
7public employee, from the appropriation account under section 20.505 (1) (ch) of the
8statues, as created by this act, the amount that the employee was required to pay in
9increased retirement and other benefit contributions for public employees resulting
10from the enactment of
2011 Wisconsin Act 10.

12(1) Payment of base wages to state employees. Any state employee who is paid
13a base wage of less than $11 an hour on the day before the effective date of this
14subsection shall immediately have his or her base wage increased to $11 an hour.

Transfer to budget stabilization fund. Notwithstanding the amounts that
17are required to be transferred from the general fund to the budget stabilization fund
18during the 2013-15 fiscal biennium under section 16.518 (3) of the statutes, an
19amount equal to $106,000,000 shall be transferred from the general fund to the
20budget stabilization fund during the 2013-14 fiscal year and an amount equal to $0
21shall be transferred from the general fund to the budget stabilization fund during the
222014-15 fiscal year.

1(1m) Living wage in state contracts. The treatment of section 16.705 (1s) of
2the statutes first applies to a contract entered into, renewed, modified, or extended
3on the effective date of this subsection.
