AB21-ASA1,1125,9 121.59 (2) (intro.) Annually the department shall pay to each eligible school district the amount determined as follows:

AB21-ASA1,3410 Section 3410. 121.59 (2) (e) of the statutes is amended to read:

AB21-ASA1,1125,12 121.59 (2) (e) Divide the product under par. (d) for the school district by the product under par. (d) for all eligible school districts.

AB21-ASA1,3411 Section 3411. 121.77 (3) of the statutes is amended to read:

AB21-ASA1,1125,15 121.77 (3) Subsections (1) (b) and (2) do not apply to a pupil attending a public school in a nonresident school district under s. 118.50, 118.51, or 121.84 (4).

AB21-ASA1,3411e Section 3411e. 121.78 (1) (a) of the statutes is amended to read:

AB21-ASA1,1125,24 121.78 (1) (a) The school board of the district of residence and the school board of the district of attendance may make a written agreement to permit an elementary or high school pupil to attend a public school, including an out-of-state school, outside the school district of residence, and the . The school district of residence shall pay the tuition to the school board of the district of attendance in an amount specified in the written agreement. The school district of residence shall be paid state aid for the pupil, in an amount up to the amount specified in the written agreement, as though the pupil were enrolled in the school district of residence.

AB21-ASA1,3411m Section 3411m. 121.78 (1) (b) of the statutes is amended to read:

AB21-ASA1,1126,10 121.78 (1) (b) A school board, upon its own order, may provide for the enrollment of a pupil in a public school located outside this state , if the course of study in such school is equivalent to the course of study in this state and if the school is at least 1.5 miles nearer the pupil's home than any public school in this state. The school board shall pay the tuition for such pupil and the school district shall be paid state aid as though such pupil was enrolled in the school district of residence. The school board shall pay for the transportation of a pupil so enrolled who resides 2 or more miles from such out-of-state school. The school district shall be paid state aid under subch. IV for the transportation of such pupil as though the pupil had been transported to the school of the school district of residence.

AB21-ASA1,3411n Section 3411n. 121.78 (1) (c) of the statutes is repealed.

AB21-ASA1,3411r Section 3411r. 121.84 (4) (b) of the statutes is amended to read:

AB21-ASA1,1126,18 121.84 (4) (b) If a pupil attends school in a school district outside the pupil's school district of residence under par. (a), s. 118.51 (12), (14), (16), and (17) apply to the pupil as if the pupil were attending school in a nonresident school district under s. 118.51. If the pupil is rejected as a result of s. 118.51 (12) (a), prohibited from attending as a result of s. 118.51 (12) (b) 1. or transferred as a result of s. 118.51 (12) (b) 2., s. 118.51 (9) applies.

AB21-ASA1,3411s Section 3411s. 121.845 (1m) of the statutes is created to read:

AB21-ASA1,1126,20 121.845 (1m) "Membership" has the meaning given in s. 121.07 (2).

AB21-ASA1,3412 Section 3412. 121.85 (3) (a) of the statutes is renumbered 121.85 (3) (a) 1. and amended to read:

AB21-ASA1,1127,2 121.85 (3) (a) 1. The Subject to subd. 2., the school board of the district of residence and the school board of the district of attendance may enter into annual written agreements to permit a pupil to attend a public school outside the school district of residence.

AB21-ASA1,3413 Section 3413. 121.85 (3) (a) 2. of the statutes is created to read:

AB21-ASA1,1127,6 121.85 (3) (a) 2. a. Except as provided in subd. 2. b., c., and d., beginning on the effective date of this subdivision paragraph .... [LRB inserts date], no school board may enter into a written agreement with another school board under subd. 1.

AB21-ASA1,1127,9 b. A school board may continue to enter into an annual written agreement with another school board under subd. 1. on behalf of a pupil that attended a public school under a written agreement under subd. 1. in the 2015-16 school year.

AB21-ASA1,1127,13 c. A school board may enter into a written agreement with another school board under subd. 1., and may continue to enter into that written agreement, on behalf of a pupil that will attend a public school under that agreement in the 2015-16 school year.

AB21-ASA1,1127,18 d. The school board of a school district operating grades kindergarten through 8 and a school board operating a unified high school district may enter into an annual written agreement under subd. 1. on behalf of a pupil that attended a public school in the school district operating grades kindergarten through 8 in the 2015-16 school year.

AB21-ASA1,3414 Section 3414. 121.85 (3) (b) of the statutes is renumbered 121.85 (3) (b) 1. and amended to read:

AB21-ASA1,1127,23 121.85 (3) (b) 1. The Except as provided in subd. 2., the school board of the a district may not permit a pupil to attend a public school under this section that is within the district which but that is outside the pupil's attendance area.

AB21-ASA1,3415 Section 3415. 121.85 (3) (b) 2. of the statutes is created to read:

AB21-ASA1,1128,5 121.85 (3) (b) 2. The school board of a school district may permit a pupil to attend a public school under this section that is within the pupil's district of residence but that is outside the pupil's attendance area if the pupil attended a public school under this section that is within the pupil's district of residence but that is outside the pupil's attendance area in the 2015-16 school year.

AB21-ASA1,3416 Section 3416. 121.85 (4) of the statutes is amended to read:

AB21-ASA1,1128,13 121.85 (4) Other plans to reduce racial imbalance. (a) Pupil transfers resulting from a plan implemented by the school board to reduce racial imbalance in a school district or attendance area shall be deemed to be transfer agreements under sub. (3) and shall be eligible for state aid under this section if the transfers comply with sub. (2), provided the transfers are of pupils who attended a public school in a school district or attendance area under the plan in the 2015-16 school year.

AB21-ASA1,1128,18 (b) Any school board that, prior to May 4, 1976, established a plan to reduce racial imbalance in the school district is eligible for state aid under sub. (6) (a) if the state superintendent approves the plan, provided the transfer pupil attended a public school in an attendance area other than the pupil's attendance area under the plan in the 2015-16 school year.

AB21-ASA1,3417 Section 3417. 121.85 (5) of the statutes is renumbered 121.85 (5) (a) and amended to read:

AB21-ASA1,1128,23 121.85 (5) (a) Part-time Except as provided in par. (b), part-time transfers for curriculum offerings also may be are not permitted under this section. The department shall establish procedures for aid computations in such cases.

AB21-ASA1,3418 Section 3418. 121.85 (5) (b) of the statutes is created to read:

AB21-ASA1,1129,9 121.85 (5) (b) A pupil who, in the 2015-16 school year, attended on a part-time basis under this section a public school that is in a school district other than the pupil's district of residence, or that is located in an attendance area other than the pupil's attendance area, for the purpose of receiving curriculum offerings at that school may continue to attend on a part-time basis under this section a public school that is in a school district other than the pupil's district of residence, or that is located in an attendance area other than the pupil's attendance area, for the purpose of receiving curriculum offerings at that school. The department shall establish procedures for aid computations in such cases.

AB21-ASA1,1130,3 2. In the 2016-17 school year, the school district of attendance of pupils transferring from one attendance area to another under subs. (3) (b) and (4) is entitled to the greater of the following:

AB21-ASA1,1130,4 a. The amount of aid to which the school district is entitled under par. (a).

AB21-ASA1,1130,6 b. The amount of aid to which the school district was entitled under par. (a) in the 2014-15 school year multiplied by 0.75.

AB21-ASA1,1130,9 3. In the 2017-18 school year, the school district of attendance of pupils transferring from one attendance area to another under subs. (3) (b) and (4) is entitled to the greater of the following:

AB21-ASA1,1130,10 a. The amount of aid to which the school district is entitled under par. (a).

AB21-ASA1,1130,12 b. The amount of aid to which the school district was entitled under par. (a) in the 2014-15 school year multiplied by 0.625.

AB21-ASA1,1130,15 4. In the 2018-19 school year, the school district of attendance of pupils transferring from one attendance area to another under subs. (3) (b) and (4) is entitled to the greater of the following:

AB21-ASA1,1130,16 a. The amount of aid to which the school district is entitled under par. (a).

AB21-ASA1,1130,18 b. The amount of aid to which the school district was entitled under par. (a) in the 2014-15 school year multiplied by 0.50.

AB21-ASA1,1130,21 5. In the 2019-20 school year, the school district of attendance of pupils transferring from one attendance area to another under subs. (3) (b) and (4) is entitled to the greater of the following:

AB21-ASA1,1130,22 a. The amount of aid to which the school district is entitled under par. (a).

AB21-ASA1,1130,24 b. The amount of aid to which the school district was entitled under par. (a) in the 2014-15 school year multiplied by 0.375.

AB21-ASA1,1131,3 6. In the 2020-21 school year, the school district of attendance of pupils transferring from one attendance area to another under subs. (3) (b) and (4) is entitled to the greater of the following:

AB21-ASA1,1131,4 a. The amount of aid to which the school district is entitled under par. (a).

AB21-ASA1,1131,6 b. The amount of aid to which the school district was entitled under par. (a) in the 2014-15 school year multiplied by 0.25.

AB21-ASA1,1131,9 7. In the 2021-22 school year, the school district of attendance of pupils transferring from one attendance area to another under subs. (3) (b) and (4) is entitled to the greater of the following:

AB21-ASA1,1131,10 a. The amount of aid to which the school district is entitled under par. (a).

AB21-ASA1,1131,12 b. The amount of aid to which the school district was entitled under par. (a) in the 2014-15 school year multiplied by 0.125.

AB21-ASA1,3418r Section 3418r. 121.85 (6) (b) 2. of the statutes is amended to read:

AB21-ASA1,1131,23 121.85 (6) (b) 2. In Subject to par. (bm), in each school year, the school district of attendance of pupils transferring from one school district to another under sub. (3) (a) shall receive an amount equal to that produced by multiplying the number of pupils transferred into the school district under sub. (3) (a) in the previous school year by the amount produced by dividing the school district's net school cost by the sum of the membership, plus the number of pupils transferred into the school district of attendance in the previous school year under sub. (3) (a). This subdivision applies to aid paid in the 1995-96 school year only if the number of pupils transferring from one school district to another under sub. (3) (a) in the 1994-95 school year constitutes less than 5% of the total membership of the school district of attendance.

AB21-ASA1,1132,3 1. In the 2015-16 school year, the school district of attendance of pupils transferring from one school district to another under sub. (3) (a) is entitled to the greater of the following:

AB21-ASA1,1132,4 a. The amount of aid to which the school district is entitled under par. (b).

AB21-ASA1,1132,6 b. The amount of aid to which the school district was entitled under par. (b) in the 2014-15 school year multiplied by 0.875.

AB21-ASA1,1132,9 2. In the 2016-17 school year, the school district of attendance of pupils transferring from one school district to another under sub. (3) (a) is entitled to the greater of the following:

AB21-ASA1,1132,10 a. The amount of aid to which the school district is entitled under par. (b).

AB21-ASA1,1132,12 b. The amount of aid to which the school district was entitled under par. (b) in the 2014-15 school year multiplied by 0.75.

AB21-ASA1,1132,15 3. In the 2017-18 school year, the school district of attendance of pupils transferring from one school district to another under sub. (3) (a) is entitled to the greater of the following:

AB21-ASA1,1132,18 b. The amount of aid to which the school district was entitled under par. (b) in the 2014-15 school year multiplied by 0.625.

AB21-ASA1,1132,21 4. In the 2018-19 school year, the school district of attendance of pupils transferring from one school district to another under sub. (3) (a) is entitled to the greater of the following:

AB21-ASA1,1132,22 a. The amount of aid to which the school district is entitled under par. (b).

AB21-ASA1,1132,24 b. The amount of aid to which the school district was entitled under par. (b) in the 2014-15 school year multiplied by 0.50.

AB21-ASA1,1133,3 5. In the 2019-20 school year, the school district of attendance of pupils transferring from one school district to another under sub. (3) (a) is entitled to the greater of the following:

AB21-ASA1,1133,4 a. The amount of aid to which the school district is entitled under par. (b).

AB21-ASA1,1133,6 b. The amount of aid to which the school district was entitled under par. (b) in the 2014-15 school year multiplied by 0.375.

AB21-ASA1,1133,9 6. In the 2020-21 school year, the school district of attendance of pupils transferring from one school district to another under sub. (3) (a) is entitled to the greater of the following:

AB21-ASA1,1133,10 a. The amount of aid to which the school district is entitled under par. (b).

AB21-ASA1,1133,12 b. The amount of aid to which the school district was entitled under par. (b) in the 2014-15 school year multiplied by 0.25.

AB21-ASA1,1133,15 7. In the 2021-22 school year, the school district of attendance of pupils transferring from one school district to another under sub. (3) (a) is entitled to the greater of the following:

AB21-ASA1,1133,16 a. The amount of aid to which the school district is entitled under par. (b).

AB21-ASA1,1133,18 b. The amount of aid to which the school district was entitled under par. (b) in the 2014-15 school year multiplied by 0.125.

AB21-ASA1,3419 Section 3419. 121.85 (6) (h) of the statutes is created to read:

AB21-ASA1,1133,22 121.85 (6) (h) Sunset. Beginning on the effective date of this paragraph .... [LRB inserts date], a school district may not receive state aid under this section unless all of the following conditions are satisfied:

AB21-ASA1,1133,24 1. A pupil is attending a public school in the school district under one of the following:

AB21-ASA1,1133,25 a. A transfer agreement under sub. (3).

AB21-ASA1,1134,2 b. A plan that has been deemed a transfer agreement under sub. (4) (a) or approved under sub. (4) (b).
