ASSEMBLY SUBSTITUTE AMENDMENT 1, TO ASSEMBLY BILL 257

AB257-ASA1,1,3 An Act to renumber 254.18; to amend 254.18 (title); and to create 254.18 (2) of the statutes; relating to: exemption from lead inspection requirements for partial lead inspection during certain lead-safe renovations.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

AB257-ASA1,1 Section 1. 254.18 (title) of the statutes is amended to read:

AB257-ASA1,1,6 254.18 (title) Lead hazard reduction in dwellings and premises; renovations.

AB257-ASA1,2 Section 2. 254.18 of the statutes is renumbered 254.18 (1).

AB257-ASA1,3 Section 3. 254.18 (2) of the statutes is created to read:

AB257-ASA1,1,12 254.18 (2) (a) In this subsection, "partial lead inspection" means an on-site investigation of one or more painted, varnished, or otherwise coated building components to determine the presence of lead, but not a surface-by-surface investigation.

AB257-ASA1,2,5 (b) If the presence of lead-bearing paint or a lead hazard is assumed and a renovation of a dwelling, unit of a dwelling, or premises is performed in a lead-safe manner, any person who performs a partial lead inspection relating to that renovation is not required to comply with any requirements established by the department for a lead inspection.

AB257-ASA1,2,8 (c) The person who performs a partial lead inspection under this subsection shall disclose, in writing, to the owner or lessor of the dwelling or premises that the person performed a partial lead inspection.
