SENATE AMENDMENT 2, TO SENATE BILL 585

SB585-SA2,1,1 At the locations indicated, amend the bill as follows:

SB585-SA2,1,2 1. Page 2, line 1: delete "157.02 (1) (a)" and substitute "157.02 (1) (am)".

SB585-SA2,1,3 2. Page 2, line 3: delete "157.02 (1) (a)" and substitute "157.02 (1) (am)".

SB585-SA2,1,4 3. Page 2, line 16: after that line insert:

SB585-SA2,1,5 " Section 1m. 157.02 (1) (a) of the statutes is created to read:

SB585-SA2,1,6 157.02 (1) (a) In this section, "burial" has the meaning given in s. 157.061 (1).".

SB585-SA2,1,8 4. Page 2, line 19: delete "before the remains are buried" and substitute "before burial of the remains".

SB585-SA2,1,10 5. Page 3, line 6: delete " before the cremated remains have been buried" and substitute "before burial of the cremated remains".

SB585-SA2,1,11 6. Page 4, line 23: after that line insert:

SB585-SA2,1,12 " Section 6m. 302.14 of the statutes is amended to read:

SB585-SA2,2,10 302.14 Property of deceased inmates, parolees, probationers or persons on extended supervision, disposition. When an inmate of a prison, a parolee of an institution, a person on extended supervision or a person on probation to the department dies leaving an estate, after paying all costs and obligations under ss. 301.32 and 301.325, of $150 or less in the trust of the warden, superintendent or secretary, the warden, superintendent or secretary shall try to determine whether or not the estate is to be probated. If probate proceedings are not commenced within 90 days, the warden, superintendent or secretary shall turn over the money or securities to the nearest of kin as evidenced by the records of the institution and the department.".
