2017 WISCONSIN ACT 285
An Act to amend 289.01 (33); and
to create 287.29 of the statutes;
relating to: iron or steel slag managed as an item of value and providing a penalty.
The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

Section 1m. 287.29 of the statutes is created to read:
287.29 Iron and steel slag recovery. (1) In this section, “slag” means slag generated by the production or processing of iron or steel that is managed as an item of value in a controlled manner and is not discarded.
(2) No person may use unencapsulated slag on private property within 100 feet of a residential dwelling or a building intended to be used in whole or in part as a school or daycare facility without prior approval of the department.

Section 1q. 289.01 (33) of the statutes is amended to read:
289.01 (33) “Solid waste" means any garbage, refuse, sludge from a waste treatment plant, water supply treatment plant, or air pollution control facility
, and other discarded or salvageable materials, including solid, liquid, semisolid, or contained gaseous materials resulting from industrial, commercial, mining, and agricultural operations, and from community activities, but. “
Solid waste” does not include solids or dissolved material in domestic sewage, or solid or dissolved materials in irrigation return flows or industrial discharges which are point sources subject to permits under ch. 283, or
slag generated by the production or processing of iron or steel and that is managed as an item of value in a controlled manner and is not discarded, source material, as defined in s. 254.31 (10), special nuclear material, as defined in s. 254.31 (11), or by-product material, as defined in s. 254.31 (1).
