AB48-AA2,1,11 At the locations indicated, amend the bill as follows:
AB48-AA2,1,3 21. Page 1, line 3: after “officers" insert “and collection and analysis of traffic
3stop information".
AB48-AA2,1,4 42. Page 1, line 4: before that line insert:
AB48-AA2,1,5 5 Section 1c. 165.847 of the statutes is created to read:
AB48-AA2,1,12 6165.847 Motor vehicle traffic stop information. (1) The department shall
7analyze the information submitted to it by law enforcement agencies under s.
8349.027 (2) to determine whether the number of motor vehicle stops and searches
9involving motor vehicles operated or occupied by members of a racial minority is
10disproportionate to the number of motor vehicle stops and searches involving motor
11vehicles operated or occupied solely by persons who are not members of a racial
12minority.
AB48-AA2,1,13 13(2) The department shall promulgate rules relating to all of the following:
AB48-AA2,2,5
1(a) The types of information that law enforcement agencies must collect
2relating to traffic stops and the circumstances under which this information must be
3collected. The rule under this paragraph shall require the collection of the zip code,
4gender, and ethnicity of the operator and each passenger of the stopped motor vehicle
5for each motor vehicle stop.
AB48-AA2,2,76 (b) The process and format that law enforcement agencies must use to submit
7to the office the collected information specified in par. (a).
AB48-AA2,2,98 (c) The types of analyses that the office will perform in fulfilling the
9requirement under sub. (1).
AB48-AA2,2,1110 (d) Requirements for making reports to the legislature under s. 13.172 (2), to
11the governor, and to the director of state courts.
AB48-AA2,1h 12Section 1h. 349.027 of the statutes is created to read:
AB48-AA2,2,18 13349.027 Collection of motor vehicle traffic stop information. (1) For
14each motor vehicle stop made on or after the effective date of this subsection .... [LRB
15inserts date], by a law enforcement officer, the person in charge of the law
16enforcement agency employing the law enforcement officer shall cause to be obtained
17all information relating to the traffic stop that is required to be collected under rules
18promulgated under s. 165.847 (2) (a).
AB48-AA2,2,21 19(2) The person in charge of a law enforcement agency shall submit the
20information collected under sub. (1) to the department of justice using the process,
21and in the format, prescribed by the rules promulgated under s. 165.847 (2) (b).”.
