2019 WISCONSIN ACT 157
An Act to amend 20.370 (6) (dq) of the statutes; relating to: a flood risk reduction pilot project and making an appropriation.
The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:
157,1 Section 1 . 20.370 (6) (dq) of the statutes is amended to read:
20.370 (6) (dq) Environmental aids — urban nonpoint source. Biennially, from the environmental fund, the amounts in the schedule to provide financial assistance for urban nonpoint source water pollution abatement and storm water management under s. 281.66 and for municipal flood control and riparian restoration under s. 281.665, for the flood risk reduction pilot project under 2019 Wisconsin Act .... (this act), section 2 (1), and to make the grants under 2009 Wisconsin Act 28, section 9137 (5q) and (6i) and 2017 Wisconsin Act 59, section 9133 (8t).
157,2 Section 2 . Nonstatutory provisions.
(1) Flood risk reduction pilot project. In the 2019-21 fiscal biennium, the department of natural resources shall allocate $150,000 from the appropriation under s. 20.370 (6) (dq) to Ashland County to design, implement, and evaluate not more than three demonstration projects that test natural flood risk reduction practices in that county. Project expenditures for the moneys allocated may be used include engineering and design, materials, construction, pre-construction and post-construction monitoring, and project management. The department shall require Ashland County to submit to the department a progress report summarizing the results to date of its demonstration projects no later than June 30, 2021. The department shall submit to the legislature, in the manner provided under s. 13.172 (2), and to the division of emergency management in the department of military affairs a report summarizing the results of the demonstration projects and recommendations for how existing state policies or funding streams could be adapted to create incentives to protect and restore natural infrastructure and reduce floods.
157,3 Section 3 . Fiscal changes.
(1) Flood risk reduction pilot project. In the schedule under s. 20.005 (3) for the appropriation to the department of natural resources under s. 20.370 (6) (dq), the dollar amount for fiscal year 2019-20 is increased by $150,000 for the flood risk reduction pilot project under Section 2 (1) of this act.
