ASSEMBLY AMENDMENT 1, TO ASSEMBLY BILL 957

AB957-AA1,1,1 At the locations indicated, amend the bill as follows:

AB957-AA1,1,4 1. Page 3, line 17: delete “therefrom," and substitute “therefrom if not used to identify a specific individual or infer information about an identified or identifiable individual,".

AB957-AA1,1,5 2. Page 9, line 6: delete “twice" and substitute “once".

AB957-AA1,1,6 3. Page 9, line 16: after that line insert:

AB957-AA1,1,9 “6. A controller that has obtained personal data about a consumer from a source other than the consumer shall be deemed in compliance with a consumer's request to delete the personal data under par. (a) 3. by doing any of the following:

AB957-AA1,1,12 a. Deleting the personal data, retaining a record of the request and the minimum data necessary to ensure the consumer's personal data remains deleted from the controller's records, and not using the retained data for any other purpose.

AB957-AA1,2,2 b. Not processing the consumer's personal data except as otherwise authorized under this section.”.

AB957-AA1,2,4 4. Page 21, line 12: after “institutions" insert “or affiliates of financial institutions".

AB957-AA1,2,5 5. Page 23, line 25: after that line insert:

AB957-AA1,2,8 “16. Personal data collected, processed, and maintained in compliance with the federal Children's Online Privacy Protection Act of 1998, 15 USC 6501 et seq., as amended.”.
