ASSEMBLY SUBSTITUTE AMENDMENT 1, TO ASSEMBLY BILL 34

AB34-ASA1,1,4 An Act to amend 20.370 (1) (hs) (title), 20.370 (1) (mu) and 29.063 (1); and to create 20.370 (1) (he), 29.063 (7) and 29.063 (8) of the statutes; relating to: chronic wasting disease research, sampling, and education; deer carcass disposal sites; and making an appropriation.

Current law allows the Department of Natural Resources to manage and provide funding to conduct testing for chronic wasting disease (CWD) in cervids, which are any species of deer or elk that are present in the wild and are not farm-raised deer.

Under this bill, DNR may research CWD in cervids, and the bill appropriates $1,000,000 annually from the general fund in fiscal years 2023-24 and 2024-25 for research on and management of CWD. Current law appropriates no money for this purpose.

Currently, DNR administers a program under which it provides self-service chronic wasting disease sampling kiosks where hunters may drop off deer carcass parts for sampling. This bill codifies this program by requiring DNR to establish and administer it and provides $200,000 in the 2023-25 fiscal biennium for the program. The bill allows DNR to contract with private entities to conduct the sampling and to pay private entities per sample taken.

This bill requires DNR to provide large metal containers where hunters may dispose of deer carcasses, to be placed in locations throughout the state as determined by DNR. The bill provides in the 2023-25 fiscal biennium $2,000,000 for the carcass disposal sites. The bill also provides in the 2023-25 fiscal biennium $100,000 for DNR to provide education to hunters about chronic wasting disease and the importance of proper carcass disposal.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

AB34-ASA1,2 Section 2 . 20.370 (1) (he) of the statutes is created to read:

AB34-ASA1,2,6 20.370 (1) (he) Chronic wasting disease management. From the general fund, the amounts in the schedule for research on and the management of chronic wasting disease under s. 29.063 (1).

AB34-ASA1,3 Section 3 . 20.370 (1) (hs) (title) of the statutes is amended to read:

AB34-ASA1,2,8 20.370 (1) (hs) (title) Chronic wasting disease management — fees.

AB34-ASA1,4 Section 4 . 20.370 (1) (mu) of the statutes is amended to read:

AB34-ASA1,3,5 20.370 (1) (mu) General program operations — state funds. The amounts in the schedule for general program operations that are conducted under ss. 23.09 to 23.11, 27.01, 30.203, 30.277, and 90.21, and chs. 29 and 169, for activities conducted under the ecological inventory and monitoring program of the endangered resources program, for the aquatic and terrestrial resources inventory under s. 23.09 (2) (km), for providing the signage required under s. 23.118, for the chronic wasting disease sampling kiosk program under s. 29.063 (8), and for payments of $53,700 in each fiscal year, to be credited to the appropriation account under s. 20.285 (1) (k), to the University of Wisconsin System for outdoor skills training under s. 29.598.

AB34-ASA1,6 Section 6 . 29.063 (1) of the statutes is amended to read:

AB34-ASA1,3,19 29.063 (1) The department may research, manage, and provide funding to conduct testing for, chronic wasting disease in cervids.

AB34-ASA1,7 Section 7 . 29.063 (7) of the statutes is created to read:

AB34-ASA1,3,24 29.063 (7) The department shall provide large metal containers where hunters may dispose of deer carcasses in locations throughout the state as determined by the department. The department shall regularly dispose of any carcasses placed in the containers.

AB34-ASA1,8 Section 8 . 29.063 (8) of the statutes is created to read:

AB34-ASA1,4,5 29.063 (8) The department shall establish and administer a program under which it provides self-service chronic wasting disease sampling kiosks at locations determined by the department, where hunters may drop off deer carcass parts for sampling. The department may contract with private entities to conduct the sampling and may pay private entities per sample taken.

AB34-ASA1,9 Section 9 . Fiscal changes.

AB34-ASA1,4,14 (1) Chronic wasting disease self-service sampling kiosks. In the schedule under s. 20.005 (3) for the appropriation to the department of natural resources under s. 20.370 (1) (mu), the dollar amount for fiscal year 2023-24 is increased by $100,000 for the self-service chronic wasting disease sampling kiosk program under s. 29.063 (8). In the schedule under s. 20.005 (3) for the appropriation to the department of natural resources under s. 20.370 (1) (mu), the dollar amount for fiscal year 2024-25 is increased by $100,000 for the self-service chronic wasting disease sampling kiosk program under s. 29.063 (8).

AB34-ASA1,4,21 (2) Deer carcass disposal sites. In the schedule under s. 20.005 (3) for the appropriation to the department of natural resources under s. 20.370 (1) (mu), the dollar amount for fiscal year 2023-24 is increased by $1,000,000 to provide deer carcass disposal sites under s. 29.063 (7). In the schedule under s. 20.005 (3) for the appropriation to the department of natural resources under s. 20.370 (1) (mu), the dollar amount for fiscal year 2024-25 is increased by $1,000,000 to provide deer carcass disposal sites under s. 29.063 (7).

AB34-ASA1,5,4 (3) Chronic wasting disease education. In the schedule under s. 20.005 (3) for the appropriation to the department of natural resources under s. 20.370 (1) (mu), the dollar amount for fiscal year 2023-24 is increased by $50,000 to provide education to hunters about chronic wasting disease and the importance of proper carcass disposal. In the schedule under s. 20.005 (3) for the appropriation to the department of natural resources under s. 20.370 (1) (mu), the dollar amount for fiscal year 2024-25 is increased by $50,000 to provide education to hunters about chronic wasting disease and the importance of proper carcass disposal.
