1An Act to amend 29.336 (2) (b) and 29.336 (2) (c) of the statutes;
relating to:
2restrictions on baiting deer in counties based on chronic wasting disease or
3bovine tuberculosis.
Analysis by the Legislative Reference Bureau
This bill provides that rules promulgated by the Department of Natural
Resources that ban baiting deer in counties on the basis of confirmed positive tests
for chronic wasting disease (CWD) or bovine tuberculosis (bovine TB) must be based
on CWD or bovine TB confirmed in free-roaming animals.
Under current law, DNR must promulgate rules that prohibit baiting deer in
any county that has a confirmed positive test for CWD or bovine TB in any captive
or free-roaming animal. The rule may not prohibit feeding deer for longer than three
years after the positive test.
Under current law, DNR must promulgate rules that prohibit baiting deer in
any county that is within 10 miles of the location of a confirmed positive test for CWD
or bovine TB in any captive or free-roaming animal. The rule may not prohibit
feeding deer for longer than two years after the positive test.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

3wild animal after December 31, 1997. A rule promulgated under this paragraph may
4not prohibit feeding deer for longer than 36 months after any positive test for chronic
5wasting disease or bovine tuberculosis has been confirmed.

(2) (c) A county in which the county or a portion of the county is within
8a 10-mile radius of the known location of a
captive or free-roaming domestic or wild
9animal that has been tested and confirmed to be positive for chronic wasting disease
10or bovine tuberculosis after December 31, 1997. A rule promulgated under this
11paragraph may not prohibit feeding deer for longer than 24 months after any positive
12test for chronic wasting disease or bovine tuberculosis has been confirmed.
