AB651,1,2 1An Act to create 349.238 of the statutes; relating to: authorizing cameras in
2highway work zones.

This bill authorizes a county, city, town, or village to install and maintain
cameras in highway work zones for the purpose of capturing video or photographic
evidence of traffic accidents and other violations of the law. Evidence captured by
a camera authorized under the bill may be accessed only by a law enforcement agency
and only if a police report is filed in connection with a traffic accident or other
violation. Evidence captured by a camera authorized under the bill may not
otherwise be used to determine compliance with any state law or local ordinance.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

AB651,1,7 4349.238 Authority to install cameras in work zones. (1) A political
5subdivision may install and maintain cameras where persons are engaged in work
6in a highway maintenance or construction area for the purpose of capturing video or
7photographic evidence of traffic accidents and other violations of the law.

1(2) Video and photographic evidence captured by a camera authorized under
2this section may be accessed only by a law enforcement agency, as defined in s. 165.83
3(1) (b), and only if a police report is filed in connection with a traffic accident or other
4violation of the law that occurred in the highway maintenance or construction area
5where the camera is installed.
AB651,2,8 6(3) Except as provided in sub. (2), no state or local authority may use video or
7photographic evidence captured by a camera authorized under this section to
8determine compliance with the laws of this state or local ordinances.
