AB940,1,5 An Act to amend 165.93 (2) (b) (intro.), 165.93 (2) (b) 3., 165.93 (2) (c) (intro.), 165.93 (3) (intro.) and 165.96 (intro.), (2), (4), (8), (9), (10), (11), (12) and (13); and to create 165.93 (2c) and 165.96 (16) and (17) of the statutes; relating to: funding for victim services and domestic abuse services, training for grant recipients, grants to child advocacy centers, and making an appropriation.

Analysis by the Legislative Reference Bureau

Under current law, the Department of Justice awards grants to nonprofit or public organizations that provide services to victims of sexual assault. This bill increases the amount for such grants by $7,000,000 in fiscal year 2023-24 and $18,000,000 in fiscal year 2024-25. Under the bill, DOJ must also annually provide a grant to a nonstate entity to provide ongoing training and technical assistance to the recipients of the grants under current law in order to enhance the services to the victims.

Under current law, the Department of Children and Families awards grants to nonprofit or public organizations that provide domestic abuse services. This bill increases the amount for such grants by $7,000,000 in fiscal year 2023-24 and $18,000,000 in fiscal year 2024-25.

Under current law, DOJ must provide $17,000 in each fiscal year to specified child advocacy centers for education, training, medical advice, and quality assurance activities. This bill increases the amount to $150,000 in each fiscal year and changes the purpose so that the funds are to enhance the multidisciplinary response to suspected child maltreatment. The bill adds two centers as recipients, the Lakeshore Regional Child Advocacy Center in Ozaukee County and Child Advocacy Centers of Wisconsin, and updates the names of the centers that are designated recipients under current law.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

AB940,2,3 165.93 (2) (b) (intro.) An organization is eligible to apply for and receive a grant under this section subsection if the organization meets all of the following criteria:

AB940,2 Section 2 . 165.93 (2) (b) 3. of the statutes is amended to read:

AB940,2,6 165.93 (2) (b) 3. The organization does not receive more than 70 percent of its operating budget from grants under this section subsection.

AB940,3 Section 3 . 165.93 (2) (c) (intro.) of the statutes is amended to read:

AB940,2,9 165.93 (2) (c) (intro.) Whenever the department reviews applications for grants under this section subsection, the department shall consider all of the following:

AB940,4 Section 4 . 165.93 (2c) of the statutes is created to read:

AB940,2,15 165.93 (2c) Grants for training and technical assistance. (a) From the appropriation under s. 20.455 (5) (e), the department shall provide an annual grant to a nonstate entity to provide ongoing training and technical assistance on a statewide level to grant recipients under sub. (2) for the purpose of enhancing services for sexual assault victims.

AB940,2,17 (b) An entity that receives a grant under this subsection shall report all of the following information to the department for each fiscal year covered by the grant:

AB940,2,19 1. The total expenditures that the entity made to provide training and technical assistance to grant recipients under sub. (2).

AB940,3,2 2. The grant recipients to which the entity provided training and technical assistance.

AB940,3,24 (12) A child advocacy center Walworth County Child Advocacy Center in Walworth County.

AB940,7 Section 7. 165.96 (16) and (17) of the statutes are created to read:

AB940,8 Section 8. Fiscal changes.

AB940,4,9 (1) Sexual assault victim services grants. In the schedule under s. 20.005 (3) for the appropriation to the department of justice under s. 20.455 (5) (e), the dollar amount for fiscal year 2023-24 is increased by $7,000,000. In the schedule under s. 20.005 (3) for the appropriation to the department of justice under s. 20.455 (5) (e), the dollar amount for fiscal year 2024-25 is increased by $18,000,000.

AB940,4,15 (2) Domestic abuse grants. In the schedule under s. 20.005 (3) for the appropriation to the department of children and families under s. 20.437 (1) (cd), the dollar amount for fiscal year 2023-24 is increased by $7,000,000. In the schedule under s. 20.005 (3) for the appropriation to the department of children and families under s. 20.437 (1) (cd), the dollar amount for fiscal year 2024-25 is increased by $18,000,000.
