SB1059,19,1917 3. The former home state shall convert the former home state license into a
18compact privilege once the new home state has activated the new home state license
19in accordance with applicable rules adopted by the compact commission.
SB1059,19,2220 4. Notwithstanding any other provision of this compact, if the licensee cannot
21meet the criteria in sub. (4), the new home state may apply its requirements for
22issuing a new single state license.
SB1059,19,2423 5. The licensee shall pay all applicable fees to the new home state in order to
24be issued a new home state license.

1(c) If a licensee changes their state of residence by moving from a member state
2to a nonmember state, or from a nonmember state to a member state, the state
3criteria shall apply for issuance of a single state license in the new state.
SB1059,20,64 (d) Nothing in this compact shall interfere with a licensee's ability to hold a
5single state license in multiple states; however, for the purposes of this compact, a
6licensee shall have only one home state license.
SB1059,20,87 (e) Nothing in this compact shall affect the requirements established by a
8member state for the issuance of a single state license.
SB1059,20,12 9(6) Active military members or their spouses. An active military member, or
10their spouse, shall designate a home state where the individual has a current license
11in good standing. The individual may retain the home state designation during the
12period the service member is on active duty.
SB1059,20,15 13(7) Adverse actions. (a) In addition to the other powers conferred by state law,
14a remote state shall have the authority, in accordance with existing state due process
15law, to:
SB1059,20,1716 1. Take adverse action against a licensee's compact privilege within that
17member state; and
SB1059,21,218 2. Issue subpoenas for both hearings and investigations that require the
19attendance and testimony of witnesses as well as the production of evidence.
20Subpoenas issued by a licensing authority in a member state for the attendance and
21testimony of witnesses or the production of evidence from another member state
22shall be enforced in the latter state by any court of competent jurisdiction, according
23to the practice and procedure applicable to subpoenas issued in proceedings pending
24before that court. The issuing authority shall pay any witness fees, travel expenses,

1mileage, and other fees required by the service statutes of the state in which the
2witnesses or evidence are located.
SB1059,21,43 (b) Only the home state shall have the power to take adverse action against a
4licensee's home state license.
SB1059,21,85 (c) For purposes of taking adverse action, the home state shall give the same
6priority and effect to reported conduct received from a member state as it would if
7the conduct had occurred within the home state. In so doing, the home state shall
8apply its own state laws to determine appropriate action.
SB1059,21,149 (d) The home state shall complete any pending investigations of a licensee who
10changes home states during the course of the investigations. The home state shall
11also have authority to take appropriate action and shall promptly report the
12conclusions of the investigations to the administrator of the data system. The
13administrator of the data system shall promptly notify the new home state of any
14adverse actions.
SB1059,21,1715 (e) A member state, if otherwise permitted by state law, may recover from the
16affected licensee the costs of investigations and dispositions of cases resulting from
17any adverse action taken against that licensee.
SB1059,21,2018 (f) A member state may take adverse action based on the factual findings of
19another remote state, provided that the member state follows its own procedures for
20taking the adverse action.
SB1059,21,2321 (g) Joint investigations. 1. In addition to the authority granted to a member
22state by its respective state law, any member state may participate with other
23member states in joint investigations of licensees.
SB1059,21,2524 2. Member states shall share any investigative, litigation, or compliance
25materials in furtherance of any joint investigation initiated under the compact.

1(h) If adverse action is taken by the home state against a licensee's home state
2license resulting in an encumbrance on the home state license, the licensee's compact
3privilege in all other member states shall be revoked until all encumbrances have
4been removed from the home state license. All home state disciplinary orders that
5impose adverse action against a licensee shall include a statement that the licensee's
6compact privileges are revoked in all member states during the pendency of the
7order.
SB1059,22,118 (i) Once an encumbered license in the home state is restored to an
9unencumbered license (as certified by the home state's licensing authority), the
10licensee must meet the requirements of sub. (4) (a) and follow the administrative
11requirements to reapply to obtain a compact privilege in any remote state.
SB1059,22,1412 (j) If a member state takes adverse action, it shall promptly notify the
13administrator of the data system. The administrator of the data system shall
14promptly notify the other member states of any adverse actions.
SB1059,22,1615 (k) Nothing in this compact shall override a member state's decision that
16participation in an alternative program may be used in lieu of adverse action.
SB1059,22,23 17(8) Establishment of the dietitian licensure compact commission. (a) The
18compact member states hereby create and establish a joint government agency
19whose membership consists of all member states that have enacted the compact
20known as the dietitian licensure compact commission. The compact commission is
21an instrumentality of the compact states acting jointly and not an instrumentality
22of any one state. The compact commission shall come into existence on or after the
23effective date of the compact as set forth in sub. (12).
SB1059,22,2524 (b) Membership, voting, and meetings. 1. Each member state shall have and
25be limited to one delegate selected by that member state's licensing authority.

12. The delegate shall be the primary administrator of the licensing authority
2or their designee.
SB1059,23,43 3. The compact commission shall by rule or bylaw establish a term of office for
4delegates and may by rule or bylaw establish term limits.
SB1059,23,65 4. The compact commission may recommend removal or suspension of any
6delegate from office.
SB1059,23,87 5. A member state's licensing authority shall fill any vacancy of its delegate
8occurring on the compact commission within 60 days of the vacancy.
SB1059,23,109 6. Each delegate shall be entitled to one vote on all matters before the compact
10commission requiring a vote by the delegates.
SB1059,23,1311 7. Delegates shall meet and vote by such means as set forth in the bylaws. The
12bylaws may provide for delegates to meet and vote in person or by
13telecommunication, video conference, or other means of communication.
SB1059,23,1714 8. The compact commission shall meet at least once during each calendar year.
15Additional meetings may be held as set forth in the bylaws. The compact commission
16may meet in person or by telecommunication, video conference, or other means of
17communication.
SB1059,23,1818 (c) The compact commission shall have the following powers:

5the authenticated business records of the compact commission, and designate an
6agent to do so on the compact commission's behalf;

SB1059,24,98 9. Borrow, accept, or contract for services of personnel, including, but not
9limited to, employees of a member state;

12grant such individuals appropriate authority to carry out the purposes of the
13compact, and establish the compact commission's personnel policies and programs
14relating to conflicts of interest, qualifications of personnel, and other related
15personnel matters;

SB1059,24,2017 13. Accept any and all appropriate donations, grants of money, other sources
18of revenue, equipment, supplies, materials, services, and gifts, and receive, utilize,
19and dispose of the same; provided that at all times the compact commission shall
20avoid any actual or appearance of impropriety or conflict of interest;

22personal, or mixed, or any undivided interest therein;

3members, state regulators, state legislators or their representatives, and consumer
4representatives, and such other interested persons as may be designated in this
5compact or the bylaws;
SB1059,25,76 19. Provide and receive information from, and cooperate with, law enforcement
7agencies;
SB1059,25,98 20. Establish and elect an executive committee, including a chair and a vice
9chair;
SB1059,25,1210 21. Determine whether a state's adopted language is materially different from
11the model compact language such that the state would not qualify for participation
12in the compact; and
SB1059,25,1413 22. Perform such other functions as may be necessary or appropriate to achieve
14the purposes of this compact.
SB1059,25,1715 (d) The executive committee. 1. The executive committee shall have the power
16to act on behalf of the compact commission according to the terms of this compact.
17The powers, duties, and responsibilities of the executive committee shall include:
SB1059,25,2018 a. Oversee the day-to-day activities of the administration of the compact
19including enforcement and compliance with the provisions of the compact, its rules
20and bylaws, and other such duties as deemed necessary;
SB1059,25,2321 b. Recommend to the compact commission changes to the rules or bylaws,
22changes to this compact legislation, fees charged to compact member states, fees
23charged to licensees, and other fees;
SB1059,25,2524 c. Ensure compact administration services are appropriately provided,
25including by contract;

1d. Prepare and recommend the budget;
SB1059,26,22 e. Maintain financial records on behalf of the compact commission;
SB1059,26,43 f. Monitor compact compliance of member states and provide compliance
4reports to the compact commission;
SB1059,26,55 g. Establish additional committees as necessary;
SB1059,26,96 h. Exercise the powers and duties of the compact commission during the
7interim between compact commission meetings, except for adopting or amending
8rules, adopting or amending bylaws, and exercising any other powers and duties
9expressly reserved to the compact commission by rule or bylaw; and
SB1059,26,1010 i. Other duties as provided in the rules or bylaws of the compact commission.
SB1059,26,1111 2. The executive committee shall be composed of nine members:
SB1059,26,1312 a. The chair and vice chair of the compact commission shall be voting members
13of the executive committee;
SB1059,26,1514 b. Five voting members from the current membership of the compact
15commission, elected by the compact commission;
SB1059,26,1716 c. One ex officio, nonvoting member from a recognized professional association
17representing dietitians; and
SB1059,26,1918 d. One ex officio, nonvoting member from a recognized national credentialing
19organization for dietitians.
SB1059,26,2120 3. The compact commission may remove any member of the executive
21committee as provided in the compact commission's bylaws.
SB1059,26,2222 4. The executive committee shall meet at least annually.
SB1059,26,2523 a. Executive committee meetings shall be open to the public, except that the
24executive committee may meet in a closed, nonpublic meeting as provided in par. (f)
252.

1b. The executive committee shall give 30 days' notice of its meetings, posted on
2the website of the compact commission and as determined to provide notice to
3persons with an interest in the business of the compact commission.
SB1059,27,54 c. The executive committee may hold a special meeting in accordance with par.
5(f) 1. b.
SB1059,27,76 (e) The compact commission shall adopt and provide to the member states an
7annual report.
SB1059,27,108 (f) Meetings of the compact commission. 1. All meetings shall be open to the
9public, except that the compact commission may meet in a closed, nonpublic meeting
10as provided in subd. 2.
SB1059,27,1411 a. Public notice for all meetings of the full compact commission shall be given
12in the same manner as required under the rule-making provisions in sub. (10),
13except that the compact commission may hold a special meeting as provided in subd.
141. b.
SB1059,27,1915 b. The compact commission may hold a special meeting when it must meet to
16conduct emergency business by giving 24 hours' notice to all member states, on the
17compact commission's website, and other means as provided in the compact
18commission's rules. The compact commission's legal counsel shall certify that the
19compact commission's need to meet qualifies as an emergency.

SB1059,28,76 e. Negotiation of contracts for the purchase, lease, or sale of goods, services, or
7real estate;
SB1059,28,88 f. Accusing any person of a crime or formally censuring any person;
SB1059,28,109 g. Trade secrets or commercial or financial information that is privileged or
10confidential;
SB1059,28,1211 h. Information of a personal nature where disclosure would constitute a clearly
12unwarranted invasion of personal privacy;
SB1059,28,1313 i. Investigative records compiled for law enforcement purposes;
SB1059,28,1614 j. Information related to any investigative reports prepared by or on behalf of
15or for use of the compact commission or other committee charged with responsibility
16of investigation or determination of compliance issues pursuant to the compact;
