1An Act to amend 632.895 (17) (b) 2. of the statutes;
relating to: coverage of
2sterilization procedures and patient education and counseling under health
3insurance policies and plans.

Under current law, health insurance policies and self-insured governmental
health plans that provide coverage of outpatient health care services, preventive
treatments and services, or prescription drugs and devices are required to provide
coverage of certain contraceptives and related services, including outpatient
consultations, examinations, procedures, and medical services that are necessary to
prescribe, administer, maintain, or remove a contraceptive. This bill requires that
health insurance policies and self-insured governmental health plans that are
required to provide such contraceptive coverage under current law also provide
coverage for sterilization procedures and patient education and counseling. Health
insurance policies are referred to in the statutes as disability insurance policies.
This proposal may contain a health insurance mandate requiring a social and
financial impact report under s. 601.423, stats.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

Initial applicability.

(1) For policies and plans containing provisions inconsistent with this act, this
8act first applies to policy or plan years beginning on the effective date of this
9subsection, except as provided in sub. (2
).

(2) For policies and plans that are affected by a collective bargaining agreement
11containing provisions inconsistent with this act, this act first applies to policy or plan
12years beginning on the effective date of this subsection or on the day on which the
13collective bargaining agreement is newly established, extended, modified, or
14renewed, whichever is later.

(1) This act takes effect on the first day of the 4th month beginning after
17publication.
