SB1104,16,1715 292.31 (1) (d) 1m. The type and quantity of waste generated at the site or
16facility that was transported to, treated at, stored at, or disposed of at another site,
17facility, or location, and the dates and locations of these activities.
SB1104,25 18Section 25 . 292.31 (11) of the statutes is created to read:
SB1104,16,2219 292.31 (11) Soil cleanup standards for PFAS. The department shall require
20responsible parties to establish residual contaminant levels for the cleanup of
21contaminated soil and sediment, or select a soil performance standard, as a result
22of a discharge of any perfluoroalkyl or polyfluoroalkyl substance.
SB1104,26 23Section 26 . 292.66 of the statutes is created to read:
SB1104,16,24 24292.66 PFAS community grant program. (1) Definitions. In this section:
SB1104,16,2525 (a) “Class B fire fighting foam” has the meaning given in s. 299.48 (1) (a).
SB1104,17,5
1(b) “Municipality” means a city, village, town, county, tribal governing body,
2utility district, lake protection district, sewerage district, or municipal airport or a
3public, private, or tribal elementary or secondary school, a child care center that is
4licensed under s. 48.65, a child care program that is established or contracted for
5under s. 120.13 (14), or a child care provider that is certified under s. 48.651.
SB1104,17,66 (c) “PFAS” means a perfluoroalkyl or polyfluoroalkyl substance.
SB1104,17,10 7(2) Financial assistance. The department shall administer a program to
8provide grants from the appropriation under s. 20.370 (6) (af) to municipalities that
9meet the requirements under sub. (3) for the purpose of conducting any of the eligible
10activities under sub. (4).
SB1104,17,12 11(3) Eligibility prerequisites. A grant may be awarded under sub. (2) only if
12one of the following has occurred:
SB1104,17,1613 (a) The municipality tested or trained with a class B fire fighting foam that
14contained intentionally added PFAS in accordance with applicable state and federal
15law, or a 3rd party tested or trained with a class B fire fighting foam that contained
16intentionally added PFAS within 3 miles of a public or private water supply.
SB1104,17,1817 (b) The municipality applied biosolids to land under a permit issued by the
18department under s. 283.31.
SB1104,17,2119 (c) One or more PFAS are affecting the municipality's drinking water supply
20or surface water or groundwater within the municipality and the responsible party
21is unknown or is unwilling or unable to take the necessary response actions.
SB1104,17,23 22(4) Eligible activities. The department may award a grant under sub. (2) for
23any of the following activities:
SB1104,17,2524 (a) Investigating potential PFAS impacts to the air, land, or water at a site or
25facility for the purpose of reducing or eliminating environmental contamination.

1(b) Treating or disposing of PFAS-containing fire fighting foam or fire fighting
2foam containers from a municipal site or facility or purchasing PFAS-free fire
3fighting foam.
SB1104,18,54 (c) Sampling a private water supply within 3 miles of a site or facility known
5to contain PFAS or to have caused a PFAS discharge.
SB1104,18,76 (d) Providing a temporary emergency water supply, a water treatment system,
7or bulk water to replace water contaminated with PFAS.
SB1104,18,98 (e) Conducting emergency, interim, or remedial actions to mitigate, treat,
9dispose of, or remove PFAS contamination to the air, land, or waters of the state.
SB1104,18,1410 (f) Removing or treating PFAS in a public water system using the most
11cost-effective method to provide safe drinking water in areas where PFAS levels
12exceed the maximum contaminant level for PFAS under ch. 281 or an enforcement
13standard for PFAS under ch. 160 or where the state has issued a health advisory for
14PFAS.
SB1104,18,1515 (g) Paying a municipality's costs for a mediator under s. 281.79.
SB1104,18,1916 (h) Sampling and testing water for PFAS contamination in a public, private,
17or tribal elementary or secondary school, a child care center that is licensed under
18s. 48.65, a child care program that is established or contracted for under s. 120.13
19(14), or a child care provider that is certified under s. 48.651.
SB1104,18,23 20(5) Application. A municipality shall apply for a grant on a form prescribed
21by the department and shall include any information that the department finds
22necessary to determine the eligibility of the project, identify the funding requested,
23determine the priority of the project, and calculate the amount of a grant.
SB1104,18,25 24(6) Evaluation criteria. The department, in awarding grants under this
25section, shall consider all of the following criteria:

1(a) The municipality's demonstrated commitment to performing and
2completing eligible activities, including the municipality's financial commitment
3and ability to successfully administer grants.
SB1104,19,54 (b) The degree to which the project will have a positive impact on public health
5and the environment.
SB1104,19,76 (c) Other criteria that the department finds necessary to prioritize the funds
7available for awarding grants.
SB1104,27 8Section 27 . 292.67 of the statutes is created to read:
SB1104,19,10 9292.67 County well testing grant program. (1) Definitions. In this
10section:
SB1104,19,1111 (a) “PFAS” means a perfluoroalkyl or polyfluoroalkyl substance.
SB1104,19,1212 (b) “Private water supply" has the meaning given in s. 281.77 (1) (a).
SB1104,19,16 13(2) Financial assistance. The department shall administer a program to
14provide grants from the appropriation under s. 20.370 (6) (et) to counties for the
15purpose of providing sampling and testing services to owners of private water
16supplies to sample and test for PFAS, nitrates, bacteria, and lead.
SB1104,28 17Section 28 . 292.74 of the statutes is created to read:
SB1104,20,11 18292.74 Financial responsibility for PFAS. The department may, if it
19determines doing so is necessary to protect human health or the environment,
20require a person who possesses or controls or who causes the discharge of a
21perfluoroalkyl or polyfluoroalkyl substance, and any person who manufactures any
22product that contains intentionally added PFAS, as defined under s. 299.485 (c), to
23provide proof of financial responsibility for conducting emergency response actions,
24remedial actions, environmental repair, and long-term care to address
25contamination by a potential discharge of a perfluoroalkyl or polyfluoroalkyl

1substance or environmental pollution that may be caused by a discharge of such
2substances. The department shall establish, by rule, the procedure for determining
3whether requiring a proof of financial responsibility is necessary to protect human
4health or the environment, and may establish requirements for types of financial
5responsibility, methods for calculating amounts of financial responsibility, access
6and default, bankruptcy notifications, and any other requirements the department
7determines is necessary under this section. The proof of financial responsibility
8required under this section shall be in addition to any other proof of financial
9responsibility or financial assurance required under this chapter. This section does
10not apply to a municipality, fire department, fire district, water utility, wastewater
11utility, agricultural producer, or the state.
SB1104,29 12Section 29 . 299.485 of the statutes is created to read:
SB1104,20,13 13299.485 Products containing PFAS. (1) Definitions. In this section:
SB1104,20,1514 (a) “Fabric treatment" means a substance applied to fabric to give the fabric one
15or more characteristics, such as stain or water resistance.
SB1104,20,2316 (b) “Food packaging" means a container applied to or providing a means to
17market, protect, handle, deliver, serve, contain, or store a food or beverage. “Food
18packaging” includes a unit package, an intermediate package, and a shipping
19container; unsealed receptacles, such as carrying cases, crates, cups, plates, bowls,
20pails, rigid foil and other trays, wrappers and wrapping films, bags, and tubs; and
21an individually assembled part of a food package, such as any interior or exterior
22blocking, bracing, cushioning, weatherproofing, exterior strapping, coating, closure,
23ink, and label.

1(c) “Intentionally added PFAS" means PFAS that are deliberately added during
2the manufacture of a product where the continued presence of PFAS is desired in the
3final product or one of the product's components to perform a specific function.
SB1104,21,74 (d) “Juvenile product” means a product designed or marketed for use by infants
5and children under the age of 12, but does not include an electronic product such as
6a personal computer, audio and video equipment, calculator, wireless phone, game
7console, or any associated peripheral.
SB1104,21,88 (e) “PFAS” means a perfluoroalkyl or polyfluoroalkyl substance.
SB1104,21,119 (f) “Textile furnishings" means textile goods of a type customarily used in
10households and businesses, including draperies, floor coverings, furnishings,
11bedding, towels, and tablecloths.
SB1104,21,1412 (g) “Unavoidable use” means a use of PFAS that is protective or beneficial to
13public health or safety or to the environment and for which there are no feasible
14alternatives available with a lower risk to public health and the environment.
SB1104,21,17 15(2) Prohibitions. (a) Beginning on January 1, 2028, no person may distribute,
16sell, or offer for sale any of the following products if the product contains
17intentionally added PFAS:
SB1104,21,1818 1. Food packaging, or food products contained in food packaging.
SB1104,21,1919 2. Carpets or rugs.
SB1104,21,2020 3. Cleaning products.
SB1104,21,2121 4. Cookware.
SB1104,21,2222 5. Cosmetics.
SB1104,21,2323 6. Dental floss.
SB1104,21,2424 7. Fabric treatments.
SB1104,21,2525 8. Juvenile products.
SB1104,22,1
19. Menstruation products.
SB1104,22,22 10. Textile furnishings.
SB1104,22,33 11. Ski wax.
SB1104,22,44 12. Upholstered furniture.
SB1104,22,65 13. A product for which the manufacturer has failed to provide the information
6required under sub. (4).
SB1104,22,97 (b) The department may, by rule, identify products, in addition to those under
8par. (a) 1. to 13., by category or use that may not be distributed, sold, or offered for
9sale, and designate effective dates for such prohibitions.
SB1104,22,1210 (c) Beginning on January 1, 2034, no person may distribute, sell, or offer for sale
11any product that contains intentionally added PFAS, unless the department has
12determined, by rule, that the use of PFAS in the product is an unavoidable use.
SB1104,22,13 13(3) Exemptions. This section does not apply to any of the following:
SB1104,22,1514 (a) A product for which federal law governs the presence of PFAS in the product
15in a manner that preempts state law.
SB1104,22,1616 (b) Fire fighting foam regulated under s. 299.48.
SB1104,22,1717 (c) The sale or resale of a used product.
SB1104,22,2018 (d) A prosthetic or orthotic device, or any product that is a medical device or
19drug or that is otherwise used in a medical setting or in medical applications
20regulated by the U.S. food and drug administration.
SB1104,22,2221 (e) A product for which the department has determined, by rule, that the use
22of PFAS in the product is an unavoidable use.
SB1104,23,4 23(4) Information required. (a) On or before January 1, 2026, a manufacturer
24of a product distributed, sold, or offered for sale that contains intentionally added
25PFAS shall submit to the department a brief description of the product; the purpose

1for which PFAS is used in the product; the amount of each type of PFAS in the
2product; the name, address, and phone number for the manufacturer; and any
3additional information requested by the department as needed to implement this
4section.
SB1104,23,85 (b) A manufacturer shall submit the information required under par. (a)
6whenever a new product that contains intentionally added PFAS is distributed, sold,
7or offered for sale, and shall revise information provided to the department whenever
8there is a significant change in the information.
SB1104,23,18 9(5) Testing; certificate of compliance. If the department has reason to believe
10that a product contains intentionally added PFAS and the product is being
11distributed, sold, or offered for sale, the department may direct the manufacturer of
12the product to, within 30 days, provide the department with testing results that
13demonstrate the amount of each of the PFAS in the product. If testing shows that
14the product does not contain intentionally added PFAS, the manufacturer shall
15provide the department with the testing results and a certificate attesting that the
16product does not contain intentionally added PFAS. If testing shows that the product
17contains intentionally added PFAS, the manufacturer shall provide the department
18with the testing results and the information required under sub. (4).
SB1104,23,21 19(6) Financial responsibility. The manufacturer of any new product that
20contains intentionally added PFAS that is distributed, sold, or offered for sale shall
21provide proof of financial responsibility as required under s. 292.74.
SB1104,23,23 22(7) Penalty. A person that violates sub. (2) (a) or (c) shall be subject to a
23forfeiture of $100 for each violating product, for each day that the violation continues.
SB1104,30 24Section 30. 299.487 of the statutes is created to read:
SB1104,23,25 25299.487 Transportation and disposal of PFAS. (1) In this section:
SB1104,24,7
1(a) “Environmental justice” means the fair treatment and meaningful
2involvement of all individuals, regardless of race, color, national origin, educational
3level, or income, with respect to the development, implementation, and enforcement
4of environmental laws, regulations, and policies to ensure that no population of color
5or community of color, indigenous community, or low-income community shall be
6exposed to a disproportionate burden of the negative human health and
7environmental impacts of pollution or other environmental hazards.
SB1104,24,88 (b) “PFAS” means a perfluoroalkyl or polyfluoroalkyl substance.
SB1104,24,15 9(2) A person disposing of PFAS, or transporting PFAS for the purpose of
10disposal, shall attempt to the greatest extent possible to avoid disposing of PFAS in,
11or transporting PFAS to, any location where such disposal or transportation will
12contribute to environmental justice concerns and shall consider all reasonable
13alternatives for transport and disposal of PFAS. The department shall assist any
14person, upon request, in evaluating the environmental justice impacts of the person's
15disposal or transportation of PFAS.
SB1104,31 16Section 31 . Nonstatutory provisions.
SB1104,25,217 (1) Emergency rules for PFAS community grant program. The department
18of natural resources may use the procedure under s. 227.24 to promulgate emergency
19rules relating to the PFAS community grant program under s. 292.66.
20Notwithstanding s. 227.24 (1) (a) and (3), when promulgating emergency rules under
21this subsection, the department is not required to provide evidence that
22promulgating a rule under this subsection as an emergency rule is necessary for the
23preservation of the public peace, health, safety, or welfare and is not required to
24provide a finding of emergency for a rule promulgated under this subsection.
25Notwithstanding s. 227.24 (1) (e) 1d. and 1g., for emergency rules promulgated under

1this subsection, the department is not required to prepare a statement of scope of the
2rules or to submit the proposed rules in final draft form to the governor for approval.
SB1104,25,83 (2) Emission standards for PFAS. If the department of health services has
4recommended a groundwater enforcement standard for a perfluoroalkyl or
5polyfluoroalkyl substance before the effective date of this subsection, the department
6of natural resources is not required to begin promulgating rules establishing an
7emission standard for that substance until 12 months beginning after the effective
8date of this subsection.
SB1104,25,109 (3) Emergency rules for PFAS in drinking water, groundwater, surface
10water, solid waste, beds of navigable waters, and contaminated soil and sediment.
SB1104,25,1611 (a) The department of natural resources shall promulgate emergency rules
12under s. 227.24 establishing acceptable levels and standards, performance
13standards, monitoring requirements, and required response actions for any
14perfluoroalkyl or polyfluoroalkyl substance or group or class of such substances that
15the department determines may be harmful to human health or the environment in
16the following:

SB1104,25,19 182. Groundwater under ss. 160.07 (5) and 160.15, except as provided under ss.
19160.07 (5) (b) and 160.15 (4).
SB1104,25,21 203. Surface water from point sources under ss. 283.11 (4) and 283.21 and from
21nonpoint sources under s. 281.16.
SB1104,25,22 224. Solid waste and solid waste facilities under chs. 289 and 291.
SB1104,25,23 235. Beds of navigable waters under s. 30.20.
SB1104,25,24 246. Soil and sediment under chs. 289 and 292.

9which the department determines that the listing is necessary to protect public
