SB7,7,1914 255.07 (2) (b) A health care provider with prescribing authority who is
15employed by or under contract with the department may issue a statewide standing
16order for the dispensing of epinephrine auto-injectors or prefilled syringes
17epinephrine delivery systems for use under sub. (4) by authorized individuals or by
18employees or agents of authorized entities who have completed the training required
19by sub. (5).
SB7,25 20Section 25 . 255.07 (3) of the statutes is amended to read:
SB7,8,721 255.07 (3) Authorized entities or individuals permitted to maintain supply.
22An authorized entity or an authorized individual may acquire and maintain a supply
23of epinephrine auto-injectors and prefilled syringes epinephrine delivery systems
24pursuant to a prescription issued in accordance with this section. The authorized
25entity or authorized individual shall store an epinephrine auto-injector or prefilled

epinephrine delivery system in a location readily accessible in an emergency
2and in accordance with the epinephrine auto-injector's or prefilled syringe's
3epinephrine delivery system's instructions for use. An authorized entity shall
4designate an employee or agent who has completed the training required in sub. (5)
5to be responsible for the storage, maintenance, control, and general oversight of
6epinephrine auto-injectors or prefilled syringes epinephrine delivery systems
7acquired by the authorized entity.
SB7,26 8Section 26 . 255.07 (4) of the statutes is amended to read:
SB7,8,129 255.07 (4) Use of epinephrine. An employee or agent of an authorized entity
10who has completed the training required by sub. (5) or an authorized individual may
11use an epinephrine auto-injector or prefilled syringe epinephrine delivery system
12prescribed under sub. (2) to do any of the following:
SB7,8,1913 (a) Provide one or more epinephrine auto-injectors or prefilled syringes
14epinephrine delivery systems to any individual who the employee, agent, or
15authorized individual believes in good faith is experiencing anaphylaxis, or to the
16parent, guardian, or caregiver of that individual for immediate administration,
17regardless of whether the individual has a prescription for an epinephrine
18auto-injector or prefilled syringe
epinephrine delivery system or has previously been
19diagnosed with an allergy.
SB7,8,2420 (b) Administer an epinephrine auto-injector or prefilled syringe epinephrine
21delivery system
to any individual who the employee, agent, or authorized individual
22believes in good faith is experiencing anaphylaxis, regardless of whether the
23individual has a prescription for an epinephrine auto-injector or prefilled syringe
24epinephrine delivery system or has previously been diagnosed with an allergy.

SB7,31 4Section 31 . 255.07 (6) (b) of the statutes is amended to read:

6epinephrine delivery system under this section does not constitute the practice of
7medicine or of any other health care profession that requires a credential to practice.
SB7,32 8Section 32 . 255.07 (6) (d) of the statutes is amended to read:
SB7,10,129 255.07 (6) (d) A person is not liable for any injuries or related damages that
10result from providing or administering an epinephrine auto-injector or prefilled
11syringe
epinephrine delivery system outside of this state if the person satisfies any
12of the following criteria:
SB7,10,1513 1. The person would not have been liable for injuries or damages if the
14epinephrine auto-injector or prefilled syringe epinephrine delivery system was
15provided or administered in this state.
SB7,10,1816 2. The person is not liable for injuries or damages under the law of the state
17in which the epinephrine auto-injector or prefilled syringe epinephrine delivery
18system
was provided or administered.
SB7,33 19Section 33 . 255.07 (6) (e) of the statutes is amended to read:
SB7,10,2320 255.07 (6) (e) Nothing in this section creates or imposes any duty, obligation,
21or basis for liability on any authorized entity, or employees, agents, or authorized
22individuals, to acquire or make available an epinephrine auto-injector or prefilled
23syringe

SB7,34 24Section 34 . 255.07 (6) (f) of the statutes is amended to read:

2or basis for liability on any employer or any other person to supervise or exercise
3control over an individual's provision or administration of an epinephrine
4auto-injector or prefilled syringe
epinephrine delivery system, if the employer or
5other person reasonably believes the individual is acting as an authorized individual
6under this section.
SB7,35 7Section 35 . 448.03 (2) (q) of the statutes is amended to read:
