SB70,1706 9Section 1706. 86.31 (3g) of the statutes is amended to read:
SB70,1020,1910 86.31 (3g) County trunk highway improvements — discretionary grants.
11From the appropriation under s. 20.395 (2) (ft), the department shall allocate
12$5,127,000 in fiscal years 2014-15 to 2016-17 and $5,393,400 in fiscal year
132017-2018 and each fiscal year thereafter,
years 2017-18 to 2022-23 to fund county
14trunk highway improvements with eligible costs totaling more than $250,000. In
15fiscal year 2023-24 and each fiscal year thereafter, the department shall allocate
1635.6 percent of the amounts appropriated under s. 20.395 (2) (ft) to fund county trunk
17highway improvements with eligible costs totaling more than $250,000.
The funding
18of improvements under this subsection is in addition to the allocation of funds for
19entitlements under sub. (3).
SB70,1707 20Section 1707. 86.31 (3m) of the statutes is amended to read:
SB70,1021,421 86.31 (3m) Town road improvements — discretionary grants. From the
22appropriation under s. 20.395 (2) (ft), the department shall allocate $5,732,500 in
23fiscal years 2011-12 to 2016-17 and $5,923,600 in fiscal year years 2017-18 and each
24fiscal year thereafter,
to 2022-23 to fund town road improvements with eligible costs
25totaling $100,000 or more. In fiscal year 2023-24 and each fiscal year thereafter, the

1department shall allocate 39.0 percent of the amounts appropriated under s. 20.395
2(2) (ft) to fund town road improvements with eligible costs totaling $100,000 or more.

3The funding of improvements under this subsection is in addition to the allocation
4of funds for entitlements under sub. (3).
SB70,1708 5Section 1708. 86.31 (3r) of the statutes is amended to read:
SB70,1021,156 86.31 (3r) Municipal street improvements — discretionary grants. From the
7appropriation under s. 20.395 (2) (ft), the department shall allocate $976,500 in fiscal
8years 2009-10 to 2016-17 and $3,850,400 in fiscal year years 2017-18 and each
9fiscal year thereafter,
to 2022-23 to fund municipal street improvement projects
10having total estimated costs of $250,000 or more. In fiscal year 2023-24 and each
11fiscal year thereafter, the department shall allocate 25.4 percent of the amounts
12appropriated under s. 20.395 (2) (ft) to fund municipal street improvement projects
13having total estimated costs of $250,000 or more.
The funding of improvements
14under this subsection is in addition to the allocation of funds for entitlements under
15sub. (3).
SB70,1709 16Section 1709 . 86.51 of the statutes is repealed.

22may award implementation grants to counties for implementing a county's certified
23farmland preservation plan.
SB70,1022,224 (b) The department shall enter into a contract with a county to which it awards
25a planning grant under par. (a) before the department distributes any grant funds

1to the county. In the contract, the department shall identify the costs that are eligible
2for reimbursement through the grant.
SB70,1022,53 (c) The department may distribute grant funds under this subsection only after
4the county shows that it has incurred costs that are eligible for reimbursement under
5par. (b).
SB70,1712 6Section 1712. 92.14 (3) (intro.) of the statutes is amended to read:
SB70,1022,157 92.14 (3) Basic allocations to counties. (intro.) To help counties fund their
8land and water conservation activities, the department shall award an annual grant
9from the appropriation under s. 20.115 (7) (c), (qe), or (qf) or s. 20.866 (2) (we) to any
10county land conservation committee that has a land and water resource
11management plan approved by the department under s. 92.10 (4) (d), and that, by
12county board action, has resolved to provide any matching funds required under sub.
13(5g) unless the county is seeking a grant under sub. (3) (h). The county may use the
14grant for land and water resource management planning and for any of the following
15purposes, consistent with the approved land and water resource management plan:

24provides funding for salary and fringe benefits for more than one county staff person,
25a county shall provide matching funds, as determined by the department by rule,

1equal to 30 percent of the cost of salary and fringe benefits for the 2nd staff person
2and 50 percent of the cost of salary and fringe benefits for any additional staff persons
3the 3rd staff person for whom the grant provides funding.
SB70,1716 4Section 1716. 92.14 (6) (b) of the statutes is amended to read:
SB70,1023,165 92.14 (6) (b) The department and the department of natural resources shall
6prepare an annual grant allocation plan identifying the amounts to be provided to
7counties under this section and ss. 281.65 and 281.66. In the allocation plan, the
8departments shall attempt to provide funding under this section for an average of
93 staff persons per county with full funding for the first staff person, 70 percent
10funding for the 2nd staff person and 50 percent funding for any additional staff
11persons
the 3rd staff person and to provide an average of $100,000 per county for
12cost-sharing grants under sub. (3) (a) to (g). If after meeting these goals there are
13additional funds available, the departments may provide funding in the allocation
14plan to counties for a 4th or subsequent staff person with a matching requirement
15to be determined by the departments and for assistance under sub (3) (h)
. The
16department shall submit that plan to the board.
SB70,1717 17Section 1717. 93.40 (1) (g) of the statutes is amended to read:

19planning, and assistance, including grants and loans to dairy producers and grants

SB70,1718 22Section 1718. 93.425 (3) of the statutes is amended to read:
SB70,1024,323 93.425 (3) Of the moneys appropriated under s. 20.115 (3) (b), the center for
24international agribusiness marketing shall ensure that $2,500,000 is expended for
25the objective specified in sub. (2) (a), $1,250,000 is expended for the objective

1specified in sub. (2) (b), and $1,250,000 is expended for the objective specified in sub.
2(2) (c). The center may not expend more than $1,000,000 under the program in any
3fiscal year.
SB70,1719 4Section 1719 . 93.475 of the statutes is created to read:
SB70,1024,11 593.475 Water stewardship certification grant program. The department
6may award grants from the appropriation under s. 20.115 (4) (cm) to agricultural
7producers to reimburse the amounts that a producer pays to the Alliance for Water
8Stewardship to obtain a certification of water stewardship. The department shall
9award grants under this section directly to the agricultural producer. Grants under
10this section may not be used to reimburse any costs of operational changes needed
11to obtain the certification of water stewardship.
SB70,1720 12Section 1720. 93.48 (1) of the statutes is amended to read:
SB70,1024,1913 93.48 (1) The department may award grants from the appropriation under s.
1420.115 (4) (am) (f) to individuals or organizations to fund projects that are designed
15to increase the sale of agricultural products grown in this state that are purchased
16in close proximity to where they are produced. The department may not award a
17grant under this section unless the applicant contributes matching funds equal to at
18least 50 percent of the costs of the project. The department shall promulgate rules
19for the program under this section.
SB70,1721 20Section 1721. 93.485 of the statutes is created to read:
SB70,1025,3 2193.485 Tribal elder community food box program. From the
22appropriation under s. 20.115 (4) (k), the department shall provide grants to one or
23more nonprofit entities for the purpose of purchasing and distributing food to tribal
24elders and for the purpose of supporting the growth and operations of food producers
25participating in the program under this section. A nonprofit entity that receives a

1grant under this section shall give preference to purchasing food from, and
2supporting the growth and operations of, indigenous-based food producers and local
3food producers. The department may promulgate rules to administer this section.
SB70,1722 4Section 1722. 93.525 of the statutes is created to read:
SB70,1025,10 593.525 Meat processing tuition and curriculum development grants.
6(1) From the appropriation under s. 20.115 (3) (f), the department shall provide
7grants to universities, colleges, and technical colleges located in this state that have
8programs in meat processing to reimburse tuition costs of students enrolled in a meat
9processing program and for curriculum development for the meat processing
10program.
SB70,1025,13 11(2) Each tuition reimbursement made with a grant received under this section
12shall reimburse a student for not more than 80 percent of the first $9,375 of the
13tuition cost for enrolling in a meat processing program.
SB70,1723 14Section 1723. 93.53 of the statutes is created to read:
SB70,1025,21 1593.53 Food waste reduction grants. (1) The department shall provide
16grants for food waste reduction pilot projects that have an objective of preventing
17food waste, redirecting surplus food to hunger relief organizations, and composting
18food waste. In awarding grants under this section, the department shall give
19preference to proposals that serve census tracts for which the median household
20income is below the statewide median household income and in which no grocery
21store is located.

193.60 Food security and Wisconsin products grant program. The
2department may award grants from the appropriation under s. 20.115 (4) (f) to
3nonprofit food banks, nonprofit food pantries, and other nonprofit organizations that
4provide food assistance for the purpose of purchasing food products that are made
5or grown in this state.
SB70,1725 6Section 1725. 93.62 of the statutes is created to read:
SB70,1026,13 793.62 Farm to fork program. (1) Definition. In this section, “farm to fork
8program” means a program to connect entities that are not school districts and that
9have cafeterias to nearby farms to provide locally produced fresh fruits and
10vegetables, dairy products, and other nutritious, locally produced foods in meals and
11snacks; to help the public develop healthy eating habits; to provide nutritional and
12agricultural education; and to improve farmers' incomes and direct access to
13markets.
SB70,1026,18 14(2) Grants. (a) The department may award grants from the appropriation
15under s. 20.115 (4) (f) to businesses, universities, hospitals, and other entities that
16are not school districts and that have cafeterias for the creation and expansion of
17farm to fork programs. The department shall give preference to proposals that are
18innovative or that provide models that other entities can adopt.
SB70,1026,2219 (b) In awarding grants under this section, the department shall promote
20agricultural development and farm profitability by supporting the development and
21adoption of practices and agribusiness opportunities that involve the production of
22value-added agricultural products, as defined under s. 93.65 (1).
SB70,1026,2423 (c) The department may award grants under this subsection for projects that
24do any of the following:

11. Create, expand, diversify, or promote production, processing, marketing, and
2distribution of food produced in this state for sale to entities in this state other than
3school districts.
SB70,1027,64 2. Create, expand, or renovate facilities, including purchases of equipment for
5the facilities, that would ensure the use of food produced in this state in locations in
6this state other than schools.
SB70,1027,87 3. Provide, expand, or promote training for food service personnel, farmers, and
8distributors.
SB70,1027,99 4. Provide, expand, or promote nutritional and agricultural education.
SB70,1027,1110 (d) The department shall consult with interested persons to establish grant
11priorities for each fiscal year.
SB70,1027,14 12(3) Reports. At least annually, the department shall report to the legislature
13under s. 13.172 (2) and to the secretary on the needs and opportunities for farm to
14fork programs.
SB70,1027,15 15(4) Rules. The department may promulgate rules to administer this section.
SB70,1726 16Section 1726. 93.65 of the statutes is created to read:
SB70,1027,19 1793.65 Value-added agricultural practices. (1) Definition. In this section,
18“value-added agricultural product” means a farm product that satisfies any of the
19following:

SB70,1027,2121 (b) The product is produced in a manner that enhances its value.
SB70,1027,2222 (c) The product is physically segregated in a manner that enhances its value.
SB70,1027,2323 (d) The product is a source of farm-based or ranch-based renewable energy.
SB70,1027,2424 (e) The product is aggregated and marketed as a locally produced farm product.

1(2) Value-added products. The department may provide education and
2technical assistance related to promoting and implementing agricultural practices
3that produce value-added agricultural products, including by doing all of the
4following:
SB70,1028,135 (a) Assistance for organic farming practices. Providing education and technical
6assistance related to organic farming practices, including business and market
7development assistance; collaborating with organic producers, industry
8participants, and local organizations that coordinate organic farming; and
9stimulating interest and investment in organic production. The department may
10award grants from the appropriation under s. 20.115 (4) (f) to organic producers,
11industry participants, and local organizations that coordinate organic farming. The
12department may award a grant to an organic producer, industry participant, or local
13organization under this paragraph for any of the following purposes:

15organic farming practices.
SB70,1028,1616 2. Helping to create organic farming plans.
SB70,1028,1717 3. Assisting farmers to transition to organic farming.
SB70,1028,2018 (b) Grazing grants. Awarding grants from the appropriation under s. 20.115
19(4) (f) to appropriate entities to provide education and training to farmers about best
20practices related to grazing.
SB70,1028,2221 (c) Promotion. Helping producers market value-added agricultural products,
22including products produced through the use of a practice described in s. 93.67.
SB70,1028,23 23(3) Rules. The department may promulgate rules to administer this section.
SB70,1727 24Section 1727. 93.66 of the statutes is created to read:

193.66 Grants for hiring farm business consultants. The department may
2award grants from the appropriation under s. 20.115 (4) (f) to county agriculture
3agents of the University of Wisconsin-Extension to help farm operators hire
4business consultants and attorneys to examine their farm business plans and create
5a farm succession plan. The department may promulgate rules to administer this
6section.

SB70,1731 20Section 1731 . 94.56 of the statutes is created to read:
SB70,1029,22 2194.56 Marijuana producers and processors. (1) Definitions. In this
22section:
SB70,1029,2523 (a) “Labor peace agreement” means an agreement between a person applying
24for a permit under this section and a labor organization, as defined in s. 5.02 (8m),
25that does all of the following:

11. Prohibits labor organizations and its members from engaging in picketing,
2work stoppages, boycotts, and any other economic interference with persons doing
3business in this state.
SB70,1030,54 2. Prohibits the applicant from disrupting the efforts of the labor organization
5to communicate with and to organize and represent the applicant's employees.
SB70,1030,96 3. Provides the labor organization access at reasonable times to areas in which
7the applicant's employees work for the purpose of meeting with employees to discuss
8their right to representation, employment rights under state law, and terms and
9conditions of employment.
SB70,1030,1010 (b) “Marijuana" has the meaning given in s. 961.70 (2).
SB70,1030,1111 (c) “Marijuana processor" has the meaning given in s. 139.97 (6).
SB70,1030,1212 (d) “Marijuana producer” has the meaning given in s. 139.97 (7).
SB70,1030,1313 (e) “Usable marijuana” has the meaning given in s. 139.97 (13).
SB70,1030,1514 (f) “Permittee” means a marijuana producer or marijuana processor who is
15issued a permit under this section.
SB70,1030,24 16(2) Permit required. (a) No person may operate in this state as a marijuana
17producer or marijuana processor without a permit from the department. A person
18who acts as a marijuana producer and a marijuana processor shall obtain a separate
19permit for each activity. A permit issued under this section is not transferable from
20one person to another or from one premises to another. A separate permit is required
21for each place in this state where the operations of a marijuana producer or
22marijuana processor occur. A person is not required to obtain a permit under this
23section if the person produces or processes only industrial hemp and holds a valid
24license under s. 94.55.
