1An Act to create 302.073 of the statutes;
relating to: inmate access to the

This bill requires the Department of Corrections and county sheriffs to provide
every inmate being held in a state correctional institution or county house of
correction with three hours per week of outdoor time, unless the inmate is being held
in the Milwaukee secure detention facility, in which case the three-hour per week
requirement does not apply until the inmate's 91st day of holding at that institution.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

1. 302.073 of the statutes is created to read:

4302.073 Outdoor access by inmates of state correctional institutions or
5county houses of correction. (1) (a) Except as provided in par. (b), the warden
6or superintendent of a state correctional institution shall ensure that each inmate
1is permitted to access the outdoors for 3 hours per week unless the inmate is subject
2to a prison lockdown or is being held in solitary confinement.

(b) The requirement under par. (a) does not apply to inmates being held in the
4state correctional institution under s. 302.01 (1) (i) until their 91st day of holding in
5that state correctional institution.

6(2) The county sheriff shall ensure that each inmate in a county house of
7correction is permitted to access the outdoors for 3 hours per week unless the inmate
8is subject to a jail lockdown or is being held in solitary confinement.
