NR 47.964(3)(3)Eligible practices.All of the followingpracticesare eligiblefor grantsunderthis subchapter. However,additionaleligiblepracticesmayaccompanyfundingfor this program otherthanthat providedthrough s. 20.370 (5) (av), Stats.:
NR 47.964(3)(a)(a) Education,informationand outreachincludingpublications,fielddays, websites, demonstrations,trainings,and planningworkshops.
NR 47.964(3)(b)(b) CoordinatingaWMG,whichincludesone-timestart-upcosts,aWMGcoordinator salaryfor up to one grantcycle, assistingaWMGin the formationof partnerships,goals,and objectivesfor themanagementof theWMA.
NR 47.964(3)(c)(c) Inventoryof invasiveplantspeciesoccurrences.
NR 47.964(3)(d)(d) Controlof invasiveplant speciesthat impactnonindustrialprivateforestland.
NR 47.965(1)(a)(a) Grantsunderthe program shallbe usedto distributeavailablestate,federalor nonprofitfunds for thepurposeof encouraginginvasiveplant managementin weedmanagementareas.
NR 47.965(1)(b)(b) Eligiblecostsare all thoseidentifiedin an applicationunder s. NR 47.966(3) and associatedwiththe preparationor implementationof oneor moreeligiblepracticesas approved bythechief stateforester.
NR 47.965(2)(2)Ineligible costs.No person
mayuse grant fundsunderthis subchapterfor anyof the following:
NR 47.965(2)(a)(a) Costsincurredbeforean applicationfor grant assistanceis approved.
NR 47.965(2)(b)(b) Theimplementationof anypracticealreadyrequiredbylaw,rule,regulationor other authority,exceptfor a practicerequiredin the managedforestlaw program under ch. 77, Stats., and exceptfor a practicerequiredunder ch. NR 40 for prohibitedand restrictedterrestrialplant species.
NR 47.965(2)(c)(c) A practicenotapprovedbythe departmentin writing,or changesto a previously approvedpractice,unlessauthorizedbythe departmentin writing.
NR 47.965(2)(d)(d) Coststo repairdamagecausedbyimplementinga practice.
NR 47.966(1)(a)(a) A matchinggrantprovidedthrough s. 20.370 (5) (av), Stats., orotherstatefundsshallbe no morethan75% of the actualeligiblecosts dependingon the availabilityof funds,exceptunder par. (c). NR 47.966(3)(a)(a) Theapplicationdeadlineis April 1 unless otherwiseprovidedon the applicationform andis contingentuponavailabilityof funds. State fundsfor this program otherthanthoseprovidedthrough s. 20.370 (5) (av), Stats.,federalfunds awardedpursuantto a federalgrantagreementand nonprofitfundsawardedpursuantto a nonprofitorganizationgrant agreementmayspecifyotherapplicationdeadlines. NR 47.967(6)(6)Start-upcostsas identifiedin s. NR 47.964(3) (b) and costsfor practicesto control prohibitedinvasiveplant speciesor other invasiveplantspeciesidentifiedbythe departmentmay be awardedaftergrantapproval.
NR 47.967(7)(7)TheWMGshallsubmitevidenceof the participationagreementfor eachperson participating,includingexpressedpermissionforWMGto enterupon land of personparticipating.

NR 47.968NR 47.968Reconsideration.AWMGthatis dissatisfiedwithanydeterminationmade underthe programmayrequestreconsiderationbythechief stateforester. All requestsfor reconsiderationshall be in writingandshallcontainfactualinformationexplainingthe basisfor requestingreconsideration. All decisionsuponreconsiderationshallbe issuedin writing.
NR 47.969(1)(1)If anyWMGor assigneeusesanyschemeor deviceto unjustlybenefitfrom this program,the cost-sharegrantsshall be withheldor a refundof all or part of anyprogram paymentsotherwisedue or paidthatpersonshall be secured. A schemeor deviceincludes,but is not limitedto, coercion,fraudor misrepresentation,falseclaims,or any businessdissolution,reorganization,revival,or other legalmechanismdesignedfor or havingthe effectof evadingthe requirementsof this subchapter.
