NOTICE IS HEREBY GIVEN that pursuant to the authority given in s. 115.28 (7) (a), Stats., the Department of Public Instruction will hold a preliminary public hearing and comment period as provided in s. 227.136 (2), Stats., to consider promulgation of permanent and emergency administrative rules, under SS 127-20, amending ch. PI 34 relating to licensing flexibilities during a pandemic declaration. Any comment received will also be considered for the development of the economic impact analysis required for rulemaking under s. 227.137 (3), Stats.
The Department will hold the public hearing at the time shown below via teleconference only. The hearing will be held as follows:

The objective of the proposed rule under this scope statement is to amend ch. PI 34 in order to create licensing flexibilities to address staffing needs in school districts, as well as provide flexibilities for educator preparation programs regarding the clinical programs they are able to offer during a pandemic, during the COVID-19 pandemic and in the event of another pandemic.
Pursuant to s. 227.135 (1), Stats., a statement of scope is prepared in advance of any rule that an agency plans to promulgate. The scope statement shall include a description of the objective the rule, a description of existing policies relevant to the rule and an analysis of policy alternatives, the statutory authority for the rule, estimates of the amount of time expected to develop the rule, a description of entities affected by the rule, and a summary of any federal regulation that is intended to address the activities to be regulated by the rule. Pursuant to s. 227.136 (7), Stats., a preliminary public hearing and comment period on a statement of scope does not relieve the agency of its obligation to hold an agency hearing on proposed rules under s. 227.16, Stats., after proposed rules are available for review.
