Detailed Description of the Objective of the Proposed Rule
2023 Wisconsin Act 165 makes changes to s. 106.275, Stats., relating to technical education equipment grants. 2017 Wisconsin Act 59 created s. 106.275, which allows the Department to award technical education equipment grants to school districts. As required by 2017 Wisconsin Act 59, the Department promulgated rules in ch. DWD 802 to implement the grant procedures and requirements. The objective of this proposed rule is to align ch. DWD 802 with 2023 Wisconsin Act 165, which allows the grants to be used to enhance or improve technical education facilities; allows a consortium of school districts to receive a grant; varies the amount of required matching funds based on whether the funds are from private or public sources; requires that not less than one-third of the grant monies awarded in a fiscal biennium are provided to school districts that are eligible for sparsity aid; and increases the maximum award amount from $50,000 to $100,000. The new policies which will be proposed in the rule are revisions to ensure that ch. DWD 802 aligns with the changes made by 2023 Wisconsin Act 165. The policy alternative is to do nothing. If the Department does not promulgate the proposed rule, ch. DWD 802 will not align with the revisions made by 2023 Wisconsin Act 165.
Detailed Explanation of Statutory Authority for the Rule (Including the Statutory Citation and Language)
Section 106.275 Technical education equipment grants. (4) Implementation of grant program.
(b) The department shall promulgate rules to implement this section. Those rules shall include all of the following:
1. Rules establishing the procedures and requirements for applying for a grant under sub. (2) (a), including the information that must be submitted with a grant application.
2. Rules establishing the procedures and criteria for awarding a grant under sub. (2) (b).
3. Rules governing the reporting requirements under sub. (3), including the information that must be provided in a report submitted under sub. (3).

The rule will impact school districts, and consortia of school districts that are interested in participating in the Technical Education Equipment Grant program.

The grant will complement existing job training opportunities under the Wisconsin Fast Forward programs, the federal Workforce Innovation and Opportunity Act of 2014, and other local, state, and federal workforce training programs.
