NOTICE IS GIVEN that pursuant to Wis. Stat. § 227.16 (5), the Public Service Commission of Wisconsin will hold a hearing on proposed rules to Wis. Admin. Code ch. 113, Service Rules for Electrical Utilities, as listed above. A copy of the draft proposed rules is available on the Commission’s ERF system at PSC REF#: 533022. The Commission will conduct the proceedings of this docket as an uncontested case.
The existing rule, last revised in 2002, requires that each dwelling in a non-transient multi-dwelling unit residential building and mobile home park, constructed or renovated after March 1, 1980, must have its electric service individually metered. The existing rule authorizes the Commission to grant waivers of the requirement in specified circumstances, such as cases where tenants have minimal usage under their control or when electric equipment under tenant control is substantially more efficient than applicable codes.
The proposed rule would update the existing provisions of Wis. Admin. Code ch. PSC 113 (PSC 113) regarding individual electric metering requirements for non-transient multi dwelling unit residential buildings, mobile home parks, and commercial establishments. The individual metering requirements are generally intended to promote energy conservation, ensure that each customer is billed for his or her own consumption only, and ensure that the utility is able to disconnect the electric service to an individual unit without affecting the service of other units at a property. The proposed rule would modify the situations in which the rule would apply in order to better reflect current and emerging technologies and would update and clarify the standards that the Commission must apply when considering grounds for a waiver of this rule under Wis. Admin. Code § PSC 113.0803(5). PUBLIC RECORDS. Any material submitted to the Commission is a public record and may appear on the Commission web site. INITIAL REGULATORY FLEXIBILITY ANALSIS. This rulemaking will not affect small businesses. The Wis. Stat. § 227.114 (12) definition of “small business” states that to be considered a small business, the business must not be dominant in its field. Changes to this rule are anticipated to result in minimal financial impacts to the State's economy as a whole. Increased rule clarity and modified provisions may help reduce construction and energy-related costs for building owners and tenants associated with the increased deployment of renewable energy and energy-efficient technologies. Businesses more likely to have impacts are electric utilities which are monopolies in their service territories and larger multifamily building developers. Both of these are dominant in their field and are not small businesses. WISCONSIN ENVIRONMENTAL POLICY ACT. This is a Type III action under Wis. Admin. Code § PSC 4.10(3). The Commission has reviewed the potential environmental effects of the project. The proposed revisions will not result in possible significant adverse environmental or social impacts. The preparation of an environmental impact statement under Wis. Stat. §1.11 or an environmental assessment is not necessary. AMERICANS WITH DISABILITIES ACT.
