An Act to repeal 13.101 (3m), 14.26 (4m), 20.395 (5) (qr), 20.525 (1) (k), 20.525 (1) (qr), 20.865 (4) (c), 25.40 (2) (b) 20p., 341.14 (6r) (bg) and 341.14 (6r) (f) 52.; to amend 341.14 (6r) (bm) 1., 341.14 (6r) (bm) 1., 341.14 (6r) (c), 341.14 (6r) (c), 341.14 (6r) (e), 341.14 (6r) (e), 341.16 (1) (b) and 341.16 (1) (b); and to create 13.101 (3m), 14.26 (4m), 20.395 (5) (qr), 20.525 (1) (em), 20.525 (1) (k), 20.525 (1) (qr), 20.865 (4) (c), 25.40 (2) (b) 20p., 341.14 (6r) (bg), 341.14 (6r) (f) 52. and 341.142 of the statutes; relating to: vehicle registration plates commemorating the 150th anniversary of Wisconsin statehood, veterans honorary medal decals and making appropriations.
The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:
445,1g Section 1g. 13.101 (3m) of the statutes is created to read:
13.101 (3m) Notwithstanding sub. (3), the committee shall supplement, from the appropriation under s. 20.865 (4) (c), the appropriation to the Wisconsin sesquicentennial commission under s. 20.525 (1) (k) upon receipt of documentation of the amounts of gifts and grants received by the commission under s. 20.245 (4) (h). The supplement under this subsection shall equal $1 for each dollar received by the commission as a gift or grant. This subsection does not apply to the first $250,000 received by the commission as gifts or grants.
445,1h Section 1h. 13.101 (3m) of the statutes, as created by 1995 Wisconsin Act .... (this act), is repealed.
445,1m Section 1 m. 14.26 (4m) of the statutes is created to read:
14.26 (4m) The commission shall cooperate with the department of transportation in promoting motor vehicle registration plates for the special group specified under s. 341.14 (6r) (f) 52.
445,2 Section 2 . 14.26 (4m) of the statutes, as created by 1995 Wisconsin Act .... (this act), is repealed.
445,3 Section 3 . 20.005 (3) (schedule) of the statutes: at the appropriate place, insert the following amounts for the purposes indicated: - See PDF for table PDF
445,4 Section 4 . 20.395 (5) (qr) of the statutes is created to read:
20.395 (5) (qr) Sesquicentennial commemorative registration plates. A sum sufficient to design, produce, promote and distribute special group registration plates under s. 341.14 (6r) (f) 52.
445,5 Section 5 . 20.395 (5) (qr) of the statutes, as created by 1995 Wisconsin Act .... (this act), is repealed.
445,6 Section 6 . 20.525 (1) (em) of the statutes is created to read:
20.525 (1) (em) Wisconsin sesquicentennial commission; general program operations supplement. As a continuing appropriation, the amounts in the schedule for the general program operations of the Wisconsin sesquicentennial commission under s. 14.26.
445,6m Section 6m. 20.525 (1) (k) of the statutes is created to read:
20.525 (1) (k) Wisconsin sesquicentennial commission; supplementing gifts and grants. All moneys transferred from the appropriation under s. 20.865 (4) (c) for the general program operations of the Wisconsin sesquicentennial commission under s. 14.26.
445,6n Section 6n. 20.525 (1) (k) of the statutes, as created by 1995 Wisconsin Act .... (this act), is repealed.
445,7 Section 7 . 20.525 (1) (qr) of the statutes is created to read:
20.525 (1) (qr) Wisconsin sesquicentennial commission; vehicle registration plates. From the transportation fund, all moneys credited to this appropriation account under s. 341.14 (6r) (bg) 3. b., to be used for the general program operations of the Wisconsin sesquicentennial commission under s. 14.26.
445,8 Section 8 . 20.525 (1) (qr) of the statutes, as created by 1995 Wisconsin Act .... (this act), is repealed.
445,8m Section 8m. 20.865 (4) (c) of the statutes is created to read:
20.865 (4) (c) Wisconsin sesquicentennial commission appropriation supplement. As a continuing appropriation, the amounts in the schedule for the purpose of supplementing the appropriation to the Wisconsin sesquicentennial commission under s. 20.525 (1) (k) as provided in s. 13.101 (3m).
445,8n Section 8n. 20.865 (4) (c) of the statutes, as created by 1995 Wisconsin Act .... (this act), is repealed.
445,9 Section 9 . 25.40 (2) (b) 20p. of the statutes is created to read:
25.40 (2) (b) 20p. Section 20.525 (1) (qr).
445,10 Section 10 . 25.40 (2) (b) 20p. of the statutes, as created by 1995 Wisconsin Act .... (this act), is repealed.
445,11 Section 11 . 341.14 (6r) (bg) of the statutes is created to read:
341.14 (6r) (bg) 1. Upon application to register an automobile, station wagon or motor home, or a motor truck, dual purpose motor home or dual purpose farm truck which has a gross weight of not more than 8,000 pounds, or a farm truck which has a gross weight of not more than 12,000 pounds, by any person who is a resident of this state and a member of the authorized special group under par. (f) 52., the department shall issue to the person special plates whose colors and design shall indicate that the vehicle is owned by a person who is a member of that special group.
2. An additional fee of $15 shall be charged for the initial issuance of a plate for the special group specified under par. (f) 52. To the extent permitted under ch. 71, the fee under this subdivision is deductible as a charitable contribution for purposes of the taxes under ch. 71.
3. Not later than 45 days after the last day of the first fiscal quarter beginning after the effective date of this paragraph .... [revisor inserts date], and not later than 45 days after the last day of each fiscal quarter thereafter, ending with the 2nd fiscal quarter of the 1998-99 fiscal year, the department shall do all of the following:
a. Compute the total cost to the department of designing, producing, promoting and distributing special group plates under par. (f) 52. during the preceding fiscal quarter.
b. Credit to the appropriation account under s. 20.525 (1) (qr) the amount, if any, by which fees received under subd. 2. during the preceding fiscal quarter exceeded the total cost computed under subd. 3. a.
445,12 Section 12 . 341.14 (6r) (bg) of the statutes, as created by 1995 Wisconsin Act .... (this act), is repealed.
445,13 Section 13 . 341.14 (6r) (bm) 1. of the statutes is amended to read:
341.14 (6r) (bm) 1. Upon application to register a vehicle specified in par. (b) or (bg) by a resident of this state who is the owner of the vehicle, upon payment of the additional fees under par. (b) or (bg) and submission of a statement by the applicant certifying to the department that the vehicle is leased to a person who qualifies for special plates under par. (b) or (bg) together with information required of an applicant under par. (b) or (bg), the department shall issue to the owner special plates of the appropriate colors and design under par. (d) or (e) in lieu of the plates which ordinarily would be issued for the vehicle. The department may not accept an application for a special group plate under par. (f) 50. before January 1, 1995.
445,14 Section 14 . 341.14 (6r) (bm) 1. of the statutes, as affected by 1995 Wisconsin Act .... (this act), is amended to read:
341.14 (6r) (bm) 1. Upon application to register a vehicle specified in par. (b) or (bg) by a resident of this state who is the owner of the vehicle, upon payment of the additional fees under par. (b) or (bg) and submission of a statement by the applicant certifying to the department that the vehicle is leased to a person who qualifies for special plates under par. (b) or (bg) together with information required of an applicant under par. (b) or (bg), the department shall issue to the owner special plates of the appropriate colors and design under par. (d) or (e) in lieu of the plates which ordinarily would be issued for the vehicle.
445,15 Section 15 . 341.14 (6r) (c) of the statutes, as affected by 1993 Wisconsin Act 415, is amended to read:
341.14 (6r) (c) Special group plates shall display the word “Wisconsin", the name of the applicable authorized special group, a symbol representing the special group, not exceeding one position, and identifying letters or numbers or both, not exceeding 6 positions and not less than one position. The department shall specify the design for special group plates, but the department shall consult the president of the university of Wisconsin system before specifying the design for the special group plates under par. (f) 35. to 47., the Wisconsin sesquicentennial commission before specifying the design for the special group plate under par. (f) 52. and the secretary of natural resources before specifying the design for the special group plate under par. (f) 50. Special group plates under par. (f) 50. shall be as similar as possible to regular registration plates in color and design.
445,16 Section 16 . 341.14 (6r) (c) of the statutes, as affected by 1995 Wisconsin Act .... (this act), is amended to read:
341.14 (6r) (c) Special group plates shall display the word “Wisconsin", the name of the applicable authorized special group, a symbol representing the special group, not exceeding one position, and identifying letters or numbers or both, not exceeding 6 positions and not less than one position. The department shall specify the design for special group plates, but the department shall consult the president of the university of Wisconsin system before specifying the design for the special group plates under par. (f) 52. and the secretary of natural resources before specifying the design for the special group plate under par. (f) 50. Special group plates under par. 445,17 Section 17 . 341.14 (6r) (e) of the statutes is amended to read:
341.14 (6r) (e) The department shall specify one combination of colors for special group plates for groups or organizations which are not military in nature and not special group plates under par. (f) 35. to 47. and , 50. and 52. The department, after consulting the president of the university of Wisconsin system, shall specify one combination of colors for special group plates under par. (f) 35. to 47. The department shall specify the word or words comprising the special group name and the symbol to be displayed upon special group plates for a group or organization which is not military in nature after consultation with the chief executive officer in this state of the group or organization, except that the department may not specify the word or words or the symbol for special group plates under par. (f) 35. to 47. unless the word or words or symbol is approved in writing by the president of the university of Wisconsin system or, with respect to endangered resources, specify the word or words or the symbol for special group plates under par. (f) 50. unless the word or words or symbol is approved in writing by the secretary of natural resources or, with respect to commemorating the 150th anniversary of Wisconsin statehood, specify the word or words or the symbol for special group plate under par. (f) 52. unless the word or words or symbol is approved in writing by the Wisconsin sesquicentennial commission. The president may not approve the word or words or symbol for a university specified under par. (f) 35. to 47. unless the chancellor of the university approves in writing the word or words or symbol. The department shall require that the word or words and symbol for a university specified under par. (f) 35. to 47. be a registration decal or tag and affixed to the special group plate and be of the colors for a university specified under par. (f) 35. to 47. that the president of the university of Wisconsin system specifies.
445,18 Section 18 . 341.14 (6r) (e) of the statutes, as affected by 1995 Wisconsin Act .... (this act), is amended to read:
341.14 (6r) (e) The department shall specify one combination of colors for special group plates for groups or organizations which are not military in nature and not special group plates under par. (f) 35. to 47. and , 50. and 52. The department, after consulting the president of the university of Wisconsin system, shall specify one combination of colors for special group plates under par. (f) 35. to 47. 445,19 Section 19 . 341.14 (6r) (f) 52. of the statutes is created to read:
341.14 (6r) (f) 52. Persons interested in obtaining a plate commemorating the 150th anniversary of Wisconsin statehood. This subdivision does not apply after December 31, 1998.
445,20 Section 20 . 341.14 (6r) (f) 52. of the statutes, as created by 1995 Wisconsin Act .... (this act), is repealed.
445,20m Section 20m. 341.142 of the statutes is created to read:
341.142 Veterans honorary medal decals. If any person who is registering or has registered a vehicle specified in s. 341.14 (6r) (b) 1. submits a statement from the U.S. department of veterans affairs certifying to the department that the person has been awarded a medal authorized under an act of congress relating to that person's service in the U.S. armed forces, as defined in s. 40.02 (57m), the department shall, free of charge, procure, issue and deliver to that veteran one decal, similar in appearance to the medal awarded to that veteran, for each motor vehicle registered in the name of that veteran. Notwithstanding s. 341.61 (3), a decal issued under this section shall be displayed in the manner directed by the department on the rear registration plate of the vehicle registered in the name of the veteran to whom the decal was issued. The department shall specify one combination of colors and design for each medal authorized under an act of congress for which a statement has been received by the department under this section, except that the department may not specify the colors or design unless the colors and design are approved in writing by the state department of veterans affairs. Not more than one decal may be issued under this section for each motor vehicle registered in the name of a veteran.
445,21 Section 21 . 341.16 (1) (b) of the statutes is amended to read:
341.16 (1) (b) Upon satisfactory proof of the loss or destruction of a special plate issued under s. 341.14 (6m) (a) or (6r) (b) or (bg) or a special personalized plate issued under s. 341.145 (1) (b) or (c) and upon payment of a fee of $5 for each plate or, if the plate is for a special group specified under s. 341.14 (6r) (f) 35. to 47. or 52., $6 for each plate, the department shall issue a replacement.
445,22 Section 22 . 341.16 (1) (b) of the statutes, as affected by 1995 Wisconsin Act .... (this act), is amended to read:
341.16 (1) (b) Upon satisfactory proof of the loss or destruction of a special plate issued under s. 341.14 (6m) (a) or (6r) (b) or (bg) or a special personalized plate issued under s. 341.145 (1) (b) or (c) and upon payment of a fee of $5 for each plate or, if the plate is for a special group specified under s. 341.14 (6r) (f) 35. to 47. or 52., $6 for each plate, the department shall issue a replacement.
445,23 Section 23 . Effective dates. This act takes effect on the day after publication, except as follows:
(1) The repeal of sections 14.26 (4m) and 20.395 (5) (qr) of the statutes and the amendment of sections 341.14 (6r) (bm) 1. (by Section 14 ), (c) (by Section 16 ) and (e) (by Section 18) and 341.16 (1) (b) (by Section 22) of the statutes take effect on January 1, 1999.
(2) The repeal of sections 13.101 (3m), 20.525 (1) (k) and (qr), 20.865 (4) (c), 25.40 (2) (b) 20p. and 341.14 (6r) (bg) and (f) 52. of the statutes takes effect on July 1, 1999.
