1997 WISCONSIN ACT 4
An Act to amend 302.01; and to create 20.410 (1) (ac) of the statutes; relating to: the temporary placement of young adult offenders at a juvenile secured correctional facility.
The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:
4,1 Section 1 . 20.005 (3) (schedule) of the statutes: at the appropriate place, insert the following amounts for the purposes indicated: - See PDF for table PDF
4,2 Section 2 . 20.410 (1) (ac) of the statutes is created to read:
20.410 (1) (ac) Temporary placement of young adult offenders. The amounts in the schedule for start-up and training costs of the correctional institution authorized under 1997 Wisconsin Act .... (this act), section 4 (1) (a ).
4,3 Section 3 . 302.01 of the statutes is amended to read:
302.01 State prisons named and defined. The penitentiary at Waupun is named “Waupun Correctional Institution". The correctional treatment center at Waupun is named “Dodge Correctional Institution". The penitentiary at Green Bay is named “Green Bay Correctional Institution". The medium/maximum penitentiary at Portage is named “Columbia Correctional Institution". The medium security institution at Oshkosh is named “Oshkosh Correctional Institution". The medium security penitentiary near Fox Lake is named “Fox Lake Correctional Institution". The penitentiary at Taycheedah is named “Taycheedah Correctional Institution". The medium security penitentiary at Plymouth is named “Kettle Moraine Correctional Institution". The penitentiary at the village of Sturtevant in Racine county is named “Racine Correctional Institution". The resource facility at Oshkosh is named “Wisconsin Resource Center". The institutions named in this section, the correctional institutions authorized under s. 301.16 (1n) or (1o), correctional institution authorized under 1997 Wisconsin Act .... (this act), section 4 (1) (a ), correctional institution authorized under s. 301.046 (1), correctional institution authorized under s. 301.048 (4) (b), minimum security correctional institutions authorized under s. 301.13, and state-local shared correctional facilities when established under s. 301.14, are state prisons.
4,4 Section 4 . Nonstatutory provisions.
(1) Temporary placement of young adult offenders.
(a) Notwithstanding 1995 Wisconsin Act 27, section 9126 (23) and (26v), the department of corrections may, from July 1, 1997, until July 1, 1998, operate the juvenile secured correctional facility authorized under 1995 Wisconsin Act 27, section 9126 (26v) as a state prison named in section 302.01 of the statutes, as affected by this act, for the placement of prisoners, as defined in section 301.01 (2) of the statutes, who are young adults.
(b) For all purposes of discipline and for judicial proceedings, the correctional institution authorized under paragraph (a) and the precincts thereof shall be deemed to be in Crawford County, and the courts of that county shall have jurisdiction of all crimes committed within that county. Every activity conducted under the jurisdiction of and by the institution, wherever located, is a precinct of the institution; and each precinct is part of the institution.
