1999 WISCONSIN ACT 90
An Act to amend 341.08 (2) (c), 341.11 (1) and 341.335 (title); and to create 341.08 (2) (cm), 341.335 (1m) and 349.02 (2) (c) of the statutes; relating to: vehicle color and motor vehicle registration, making an appropriation and providing a penalty.
The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:
90,1 Section 1. 341.08 (2) (c) of the statutes is amended to read:
341.08 (2) (c) A description of the vehicle, including make, model, color, identification number and any other information which the department may reasonably require for proper identification of the vehicle. An application for a motorcycle or for a vehicle registered at a gross weight of more than 8,000 pounds is not required to include the vehicle color in the description of the vehicle.
90,2 Section 2. 341.08 (2) (cm) of the statutes is created to read:
341.08 (2) (cm) A place for the applicant to indicate whether the color of the vehicle being registered has changed from the color specified on the certificate of registration and, if so, the new color.
90,3 Section 3. 341.11 (1) of the statutes is amended to read:
341.11 (1) Except as provided in sub. (2) the department upon registering a vehicle shall issue and deliver to the owner a certificate of registration. The certificate shall contain the name, residence and address of the owner,; a brief description of the vehicle, including its color; the registration number assigned; and the date of expiration of registration. The certificate shall be in such form and may contain such additional information as the department deems advisable. A certificate for a motorcycle or for a vehicle registered at a gross weight of more than 8,000 pounds is not required to include the vehicle color in the description of the vehicle.
90,4 Section 4. 341.335 (title) of the statutes is amended to read:
341.335 (title) Notice of change of address or, name or vehicle color.
90,5 Section 5. 341.335 (1m) of the statutes is created to read:
341.335 (1m) No person is required to notify the department before the next renewal of registration for the vehicle that a vehicle's color has been changed from the color stated in the most recent application for registration of the vehicle.
90,6 Section 6. 349.02 (2) (c) of the statutes is created to read:
349.02 (2) (c) Notwithstanding par. (a), a law enforcement officer may not stop a vehicle solely because the vehicle's color differs from the color stated in the application for registration of that vehicle. This paragraph does not limit the authority of a law enforcement officer to issue a citation for improper registration of a vehicle whose color differs from the color stated in the application for registration of the vehicle, if the difference is observed in the course of a stop or inspection made for other purposes.
90,6g Section 6g. Nonstatutory provisions.
(1) Notwithstanding section 16.42 (1) (e) of the statutes, in submitting information under section 16.42 of the statutes for the purpose of the 2001-03 biennial budget bill, the department of transportation shall submit information concerning the appropriation under section 20.395 (5) (cq) of the statutes as though the amounts appropriated to the department under that appropriation for fiscal year 2000-01 were $37,500 less than the amounts in the schedule.
90,6m Section 6m. Appropriation changes.
(1) In the schedule under section 20.005 (3) of the statutes for the appropriation to the department of transportation under section 20.395 (5) (cq) of the statutes, as affected by the acts of 1999, the dollar amount is increased by $37,500 for fiscal year 2000-01 to reflecting vehicle color on motor vehicle registration.
90,7 Section 7.0 Initial applicability.
(1) This act first applies to applications for registration of vehicles submitted to the department of transportation on the effective date of this subsection.
90,8m Section 8m. Effective dates. This act takes effect on the first day of the 4th month beginning after publication or on July 1, 2000, whichever is later, except as follows:
(1) Section 6m of this act takes effect on the day after publication.
