2005 WISCONSIN ACT 211
An Act relating to: decreasing Medical Assistance reimbursement, transferring moneys from the general fund to the Medical Assistance trust fund, increasing the Medical Assistance reimbursement rate for nursing homes, supplementing the Medical Assistance reimbursement for nursing homes, and making appropriations.
The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

Section
1.
Appropriation changes.
(1) Medical Assistance reimbursement decrease. In the schedule under section 20.005 (3) of the statutes for the appropriation to the department of health and family services under section 20.435 (4) (b) of the statutes, as affected by the acts of 2005, the dollar amount is decreased by $63,516,600 for fiscal year 2005-06 and the dollar amount is decreased by $103,900 for fiscal year 2006-07 to decrease funding for the purposes for which the appropriation is made
(2) Transfer from general fund to Medical Assistance trust fund. There is transferred from the general fund to the Medical Assistance trust fund $51,364,200 in fiscal year 2005-06 and $25,383,900 in fiscal year 2006-07.
(3) Exemption from certain legislative rules of proceedings. Section 20.003 (4) of the statutes does not apply to the actions of the legislature in enacting this act.
(4c) Nursing home reimbursement rate increase. In the schedule under section 20.005 (3) of the statutes for the appropriation to the department of health and family services under section 20.435 (4) (b) of the statutes, as affected by the acts of 2005, the dollar amount is increased by $10,118,000 for fiscal year 2006-07 to increase funding for reimbursement for care provided by facilities, as defined in section 49.45 (6m) (a) 3. of the statutes, for recipients of Medical Assistance.
(4d) Nursing home reimbursement supplement. In the schedule under section 20.005 (3) of the statutes for the appropriation to the department of health and family services under section 20.435 (4) (b) of the statutes, as affected by the acts of 2005, the dollar amount is increased by $1,285,400 for fiscal year 2005-06 to provide a one-time supplement to reimbursement under Medical Assistance for care provided by facilities, as defined in section 49.45 (6m) (a) 3. of the statutes, based on each facility's proportionate share of numbers of Medical Assistance recipient patient days in fiscal year 2004-05.
(4e) Exemption from certain legislative rules of proceedings. Section 20.003 (4) of the statutes does not apply to the actions of the legislature in enacting this act.
