2009 WISCONSIN ACT 361
An Act to amend 20.866 (1) (u); to create 13.48 (39h), 20.866 (2) (zck) and 20.867 (3) (bi) of the statutes; and to affect 2009 Wisconsin Act 28, section 9106 (1) (qm) and (27); relating to: construction of a rural dental education outreach facility in Marshfield, granting bonding authority, and making an appropriation.
The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:
361,1 Section 1. 13.48 (39h) of the statutes is created to read:
13.48 (39h) Marshfield clinic. (a) The legislature finds and determines that expanding access to dental education, especially for the provision of dental care in rural and underserved areas of Wisconsin, greatly benefits state residents and is essential for preserving public health in Wisconsin. It is therefore in the public interest, and it is the public policy of this state, to assist the Marshfield Clinic in the construction of a rural dental education outreach facility in Marshfield.
(b) Before July 1, 2015, the building commission may authorize up to $10,000,000 in general fund supported borrowing to aid in the construction of a rural dental education outreach facility in Marshfield. The state funding commitment shall be in the form of a grant to the Marshfield Clinic. Before approving any state funding commitment under this paragraph, the building commission shall determine that the Marshfield Clinic has secured at least $10,000,000 in additional funding from nonstate sources for the project.
(c) If the building commission authorizes a grant to the Marshfield Clinic under par. (b) and if, for any reason, the facility that is constructed with funds from the grant is not used as a a rural dental education outreach facility, the state shall retain an ownership interest in the facility equal to the amount of the state's grant.
361,2 Section 2. 20.866 (1) (u) of the statutes, as affected by 2009 Wisconsin Act 28, is amended to read:
20.866 (1) (u) Principal repayment and interest. A sum sufficient from moneys appropriated under sub. (2) (zp) and ss. 20.115 (2) (d) and (7) (b), (br), (s), and (tb), 20.190 (1) (c), (d), (i), and (j), 20.225 (1) (c) and (i), 20.245 (1) (e) and (j), 20.250 (1) (c) and (e), 20.255 (1) (d), 20.285 (1) (d), (db), (im), (in), (je), (jq), (kd), (km), and (ko) and (5) (i), 20.320 (1) (c) and (t) and (2) (c), 20.370 (7) (aa), (ac), (ag), (aq), (ar), (at), (au), (bq), (br), (cb), (cc), (cd), (cg), (cq), (cr), (cs), (ct), (ea), (eq), and (er), 20.395 (6) (af), (aq), (ar), and (au), 20.410 (1) (e), (ec), and (ko) and (3) (e), 20.435 (2) (ee), 20.465 (1) (d), 20.485 (1) (f) and (go), (3) (t) and (4) (qm), 20.505 (4) (es), (et), (ha), and (hb) and (5) (c), (g), and (kc), 20.855 (8) (a), and 20.867 (1) (a) and (b) and (3) (a), (b), (bb), (bc), (bd), (be), (bf), (bg), (bh), (bi), (bm), (bn), (bp), (bq), (br), (bu), (bv), (g), (h), (i), (kd), and (q) for the payment of principal, interest, premium due, if any, and payment due, if any, under an agreement or ancillary arrangement entered into under s. 18.06 (8) (a) relating to any public debt contracted under subchs. I and IV of ch. 18.
361,3 Section 3. 20.866 (2) (zck) of the statutes is created to read:
20.866 (2) (zck) Marshfield Clinic. From the capital improvement fund, a sum sufficient for the building commission to provide a grant to Marshfield Clinic for construction of a rural dental education outreach facility in Marshfield. If the project is authorized by the building commission before July 1, 2015, the state may contract public debt in an amount not to exceed $10,000,000 for this purpose.
361,4 Section 4. 20.867 (3) (bi) of the statutes is created to read:
20.867 (3) (bi) Principal repayment, interest, and rebates; Marshfield Clinic. A sum sufficient to reimburse s. 20.866 (1) (u) for the payment of principal and interest costs incurred in financing the construction of a rural dental education outreach facility in Marshfield for the Marshfield Clinic, to make the payments determined by the building commission under s. 13.488 (1) (m) that are attributable to the proceeds of obligations incurred in financing the project, and to make payments under an agreement or ancillary arrangement entered into under s. 18.06 (8) (a).
361,5 Section 5. 2009 Wisconsin Act 28, section 9106 (1) (qm) and (27) are created to read:
(27) Marshfield rural dental education outreach facility. Notwithstanding section 18.04 (1) of the statutes, if the building commission does not authorize public debt to be contracted to finance the project specified in subsection (1) (qm) by June 30, 2015, the enumeration in subsection (1) (qm) is void and of no effect.
361,6 Section 6. Nonstatutory provisions.
(1) Marshfield Clinic. Notwithstanding section 13.48 (39h) (b) of the statutes, as created by this act, the building commission shall not make a grant to the Marshfield Clinic for construction of a rural dental education outreach facility in Marshfield, as enumerated in 2009 Wisconsin Act 28, section 9106 (1) (qm), under section 13.48 (39h) of the statutes, as created by this act, unless the department of administration has reviewed and approved plans for the project. Notwithstanding sections 16.85 (1) and 16.855 (1) of the statutes, the department of administration shall not supervise any services or work or let any contract for the project. Section 16.87 of the statutes does not apply to the project.
