Applicability and designation of affected facility. NR 440.42(1)(a)(a) The provisions of this section are applicable to any of the following affected facilities in coal preparation plants which process more than 181 Mg (200 tons) per day: thermal dryers, pneumatic coal-cleaning equipment (air tables), coal processing and conveying equipment (including breakers and crushers), coal storage systems and coal transfer and loading systems.

(b) Any facility under
par. (a) that commences construction or modification after October 24, 1974, is subject to the requirements of this section.
NR 440.42(2)
(2) Definitions. As used in this section, terms not defined in this subsection have the meanings given in
s. NR 440.02.
NR 440.42(2)(a)
(a) “Bituminous coal" means solid fossil fuel classified as bituminous coal by ASTM D388-99 (reapproved 2004), incorporated by reference in
s. NR 440.17 (2) (a) 12.
NR 440.42(2)(b)
(b) “Coal" means all solid fossil fuels classified as anthracite, bituminous, subbituminous or lignite by ASTM D388-99 (reapproved 2004), incorporated by reference in
s. NR 440.17 (2) (a) 12.
NR 440.42(2)(c)
(c) “Coal preparation plant" means any facility, excluding underground mining operations, which prepares coal by one or more of the following processes: breaking, crushing, screening, wet or dry cleaning and thermal drying.
NR 440.42(2)(d)
(d) “Coal processing and conveying equipment" means any machinery used to reduce the size of coal or to separate coal from refuse, and the equipment used to convey coal to or remove coal and refuse from the machinery. This includes, but is not limited to, breakers, crushers, screens and conveyor belts.
NR 440.42(2)(e)
(e) “Coal storage system" means any facility used to store coal except for open storage piles.
NR 440.42(2)(f)
(f) “Cyclonic flow" means a spiraling movement of exhaust gases within a duct or stack.
NR 440.42(2)(g)
(g) “Pneumatic coal-cleaning equipment" means any facility which classifies bituminous coal by size or separates bituminous coal from refuse by application of one or more air streams.
NR 440.42(2)(h)
(h) “Thermal dryer" means any facility in which the moisture content of bituminous coal is reduced by contact with a heated gas stream which is exhausted to the atmosphere.
NR 440.42(2)(i)
(i) “Transfer and loading system" means any facility used to transfer and load coal for shipment.
NR 440.42(3)(a)(a) On and after the date on which the performance test required to be conducted by
s. NR 440.08 is completed, an owner or operator subject to the provisions of this section may not cause to be discharged into the atmosphere from any thermal dryer gases which:
NR 440.42(3)(a)1.
1. Contain particulate matter in excess of 0.070 g/dscm (0.031 gr/dscf).
NR 440.42(3)(b)
(b) On and after the date on which the performance test required to be conducted by
s. NR 440.08 is completed, an owner or operator subject to the provisions of this section may not cause to be discharged into the atmosphere from any pneumatic coal cleaning equipment gases which:
NR 440.42(3)(b)1.
1. Contain particulate matter in excess of 0.040 g/dscm (0.017 gr/dscf).
NR 440.42(3)(c)
(c) On and after the date on which the performance test required to be conducted by
s. NR 440.08 is completed, an owner or operator subject to the provisions of this section may not cause to be discharged into the atmosphere from any coal processing and conveying equipment, coal storage system, or coal transfer and loading system processing coal gases which exhibit 20% opacity or greater.
NR 440.42(4)(a)(a) The owner or operator of any thermal dryer shall install, calibrate, maintain and continuously operate monitoring devices as follows:

1. A monitoring device for the measurement of the temperature of the gas stream at the exit of the thermal dryer on a continuous basis. The monitoring device shall be certified by the manufacturer to be accurate within

2. For affected facilities that use venturi scrubber emission control equipment:
NR 440.42(4)(a)2.a.
a. A monitoring device for the continuous measurement of the pressure loss through the venturi constriction of the control equipment. The monitoring device shall be certified by the manufacturer to be accurate within plus or minus one inch water gauge.
NR 440.42(4)(a)2.b.
b. A monitoring device for the continuous measurement of the water supply pressure to the control equipment. The monitoring device shall be certified by the manufacturer to be accurate within
" 5% of design water supply pressure. The pressure sensor or tap shall be located close to the water discharge point. The department may approve alternative locations.
NR 440.42(5)(a)(a) In conducting the performance tests required in
s. NR 440.08, the owner or operator shall use as reference methods and procedures the test methods in Appendix A of
40 CFR part 60, incorporated by reference in
s. NR 440.17, or other methods and procedures as specified in this subsection, except as provided in
s. NR 440.08 (2).
NR 440.42(5)(b)
(b) The owner or operator shall determine compliance with the particulate matter standards in
sub. (3) as follows:

1. Method 5 shall be used to determine the particulate matter concentration. The sampling time and sample volume for each run shall be at least 60 minutes and 0.85 dscm (30 dscf). Sampling shall begin no less than 30 minutes after startup and shall terminate before shutdown procedures begin.

NR 440.43 Ferroalloy production facilities. NR 440.43(1)(1)
Applicability and designation of affected facility. NR 440.43(1)(a)(a) The provisions of this section are applicable to the following affected facilities: electric submerged arc furnaces which produce silicon metal, ferrosilicon, calcium silicon, silicomanganese zirconium, ferrochrome silicon, silvery iron, high-carbon ferrochrome, charge chrome, standard ferromanganese, silicomanganese, ferromanganese silicon or calcium carbide; and dust-handling equipment.

NR 440.43(2)
(2) Definitions. As used in this section, terms not defined in this subsection have the meanings given in

NR 440.43(2)(a)
(a) “Blowing tap" means any tap in which an evolution of gas forces or projects jets of flame or metal sparks beyond the ladle, runner or collection hood.
NR 440.43(2)(b)
(b) “Calcium carbide" means material containing 70 to 85% calcium carbide by weight.
NR 440.43(2)(d)
(d) “Capture system" means the equipment (including hoods, ducts, fans, dampers, etc.) used to capture or transport particulate matter generated by an affected electric submerged arc furnace to the control device.
NR 440.43(2)(e)
(e) “Charge chrome" means that alloy containing 52 to 70% by weight chromium, 5 to 8% by weight carbon, and 3 to 6% by weight silicon.
NR 440.43(2)(f)
(f) “Control device" means the air pollution control equipment used to remove particulate matter generated by an electric submerged arc furnace from an effluent gas stream.
NR 440.43(2)(g)
(g) “Dust-handling equipment" means any equipment used to handle particulate matter collected by the air pollution control device (and located at or near such device) serving any electric submerged arc furnace subject to this section.
NR 440.43(2)(h)
(h) “Electric submerged arc furnace" means any furnace wherein electrical energy is converted to heat energy by transmission of current between electrodes partially submerged in the furnace charge.
NR 440.43(2)(j)
(j) “Ferromanganese silicon" means that alloy containing 63 to 66% by weight manganese, 28 to 32% by weight silicon, and a maximum of 0.08% by weight carbon.
NR 440.43(2)(k)
(k) “Ferrosilicon" means that alloy as defined by ASTM A100-93, incorporated by reference in
s. NR 440.17 (2) (a) 2., grades A, B, C, D and E which contains 50 or more percent by weight silicon.
NR 440.43(2)(L)
(L) “Furnace charge" means any material introduced into the electric submerged arc furnace, and may consist of, but is not limited to, ores, slag, carbonaceous material and limestone.
NR 440.43(2)(m)
(m) “Furnace cycle" means the time period from completion of a furnace product tap to the completion of the next consecutive product tap.
NR 440.43(2)(n)
(n) “Furnace power input" means the resistive electrical power consumption of an electric submerged arc furnace as measured in kilowatts.
NR 440.43(2)(o)
(o) “High-carbon ferrochrome" means that alloy as defined by ASTM A101-93, incorporated by reference in
s. NR 440.17 (2) (a) 3., grades HC1 through HC6.
NR 440.43(2)(p)
(p) “Product change" means any change in the composition of the furnace charge that would cause the electric submerged arc furnace to become subject to a different mass standard applicable under this section.
NR 440.43(2)(r)
(r) “Silicomanganese zirconium" means that alloy containing 60 to 65% by weight silicon, 1.5 to 2.5% by weight calcium, 5 to 7% by weight zirconium, 0.75 to 1.25% by weight aluminum, 5 to 7% by weight manganese, and 2 to 3% by weight barium.

(s) “Silicon metal" means any silicon alloy containing more than 96% silicon by weight.
NR 440.43(2)(t)
(t) “Silvery iron" means any ferrosilicon, as defined by ASTM A100-93 incorporated by reference in
s. NR 440.17 (2) (a) 2., which contains less than 30% silicon.
NR 440.43(2)(u)
(u) “Slag" means the more or less completely fused and vitrified matter separated during the reduction of a metal from its ore.
NR 440.43(2)(v)
(v) “Standard ferromanganese" means that alloy as defined by ASTM A99-82 (reapproved 1987), incorporated by reference in
s. NR 440.17 (2) (a) 1.
NR 440.43(2)(w)
(w) “Tapping" means the removal of slag or product from the electric submerged arc furnace under normal operating conditions such as removal of metal under normal pressure and movement by gravity down the spout into the ladle.
NR 440.43(2)(x)
(x) “Tapping period" means the time duration from initiation of the process of opening the tap hole until plugging of the tap hole is complete.
NR 440.43(2)(y)
(y) “Tapping station" means that general area where molten product or slag is removed from the electric submerged arc furnace.
NR 440.43(3)(a)(a) On and after the date on which the performance test required to be conducted by
s. NR 440.08 is completed, no owner or operator subject to the provisions of this section may cause to be discharged into the atmosphere from any electric submerged arc furnace any gases which:
NR 440.43(3)(a)1.
1. Exit from a control device and contain particulate matter in excess of 0.45 kg/MW-hr (0.99 lb/MW-hr) while silicon metal, ferrosilicon, calcium silicon or silicomanganese zirconium is being produced.
NR 440.43(3)(a)2.
2. Exit from a control device and contain particulate matter in excess of 0.23 kg/MW-hr (0.51 lb/MW-hr) while high-carbon ferrochrome, charge chrome, standard ferromanganese, silicomanganese, calcium carbide, ferrochrome silicon, ferromanganese silicon or silvery iron is being produced.
NR 440.43(3)(a)4.
4. Exit from an electric submerged arc furnace and escape the capture system and are visible without the aid of instruments. The requirements of this subdivision apply only during periods when flow rates are being established under
sub. (6) (d).
NR 440.43(3)(a)5.
5. Escape the capture system at the tapping station and are visible without the aid of instruments for more than 40% of each tapping period. There are no limitations on visible emissions under this subdivision when a blowing tap occurs. The requirements of this subdivision apply only during periods when flow rates are being established under
sub. (6) (d).
NR 440.43(3)(b)
(b) On and after the date on which the performance test required to be conducted by
s. NR 440.08 is completed, no owner or operator subject to the provisions of this section may cause to be discharged into the atmosphere from any dust-handling equipment any gases which exhibit 10% opacity or greater.
NR 440.43(4)(a)(a) On and after the date on which the performance test required to be conducted by
s. NR 440.08 is completed, no owner or operator subject to the provisions of this section may cause to be discharged into the atmosphere from any electric submerged arc furnace any gases which contain, on a dry basis, 20 or greater volume % of carbon monoxide. Combustion of such gases under conditions acceptable to the department constitutes compliance with this subsection. Acceptable conditions include, but are not limited to, flaring of gases or use of gases as fuel for other processes.
NR 440.43(5)(a)(a) The owner or operator subject to the provisions of this section shall install, calibrate, maintain and operate a continuous monitoring system for measurement of the opacity of emissions discharged into the atmosphere from control devices.
NR 440.43(5)(b)
(b) For the purpose of reports required under
s. NR 440.07 (3), the owner or operator shall report as excess emissions all 6-minute periods in which the average opacity is 15% or greater.
NR 440.43(5)(c)
(c) The owner or operator subject to the provisions of this section shall submit a written report of any product change to the department. Reports of product changes shall be postmarked not later than 30 days after implementation of the product change.
NR 440.43(6)(a)(a) The owner or operator of any electric submerged arc furnace subject to the provisions of this section shall maintain daily records of the following information:
