3payout ratio for each type of lottery game offered, and an evaluation of the effect of
4prize payout ratios of lottery games on lottery sales, lottery operating costs and on
5maximizing the revenue available for the lottery property tax credit. If, within 14
6working days after the date on which the committee receives the report, the
7cochairpersons of the committee notify the commission department that the
8committee has scheduled a meeting for the purpose of reviewing the commission's
9department's proposed prize payouts, the commission department may proceed with
10its plans for the prize payouts for the subsequent fiscal year only upon approval of
11the plans by the committee. If the cochairpersons of the committee do not notify the
12commission department within 14 working days after the date on which the
13committee receives the report that the committee has scheduled a meeting for the
14purpose of reviewing the commission's department's proposed prize payouts, the
15commission's department's plans for the prize payouts for the subsequent fiscal year
16are considered approved by the committee.

6convenient availability of lottery tickets and lottery shares to prospective buyers.

13officer, director, owner or other individual whose actions directly contributed to the
14partnership's, limited liability company's, association's or corporation's conviction or

3person operating activities on state or local government property. The commission
4department shall give preference to an individual, group of individuals or nonprofit
5organization, as specified under sub. (4) (b), in entering into contracts under this

AB150-ASA,2132,1712 565.10 (8) Contract fees. A contract entered into under this section may
13require payment of a nonrefundable initial application fee or a nonrefundable
14annual fee for continuation, or both, in an amount promulgated by the commission
15board by rule under s. 565.02 (4) (b). A separate nonrefundable fee, in an amount
16specified in rules promulgated under s. 565.02 (4) (b), may be required for each
17certificate of authority issued under sub. (11).
AB150-ASA, s. 6978t 18Section 6978t. 565.10 (8m) of the statutes is amended to read:

6certificate in a location which is accessible for public inspection.

3any, shall be indicated as a deduction from the total remitted.

15protect the public interest or the security, integrity or fiscal responsibility of the
16lottery, the administrator may, without prior notice or hearing, suspend for a
17specified period or terminate the lottery retailer contract by mailing to the retailer
18a notice of suspension or termination that includes a statement of the facts or conduct
19that warrant the suspension or termination and a notice that the retailer may, within
2030 days after the date on which the notice of suspension or termination is mailed,
21have the suspension or termination reconsidered by the administrator. If, upon
22reconsideration, the administrator affirms the determination to suspend or
23terminate the lottery retailer contract, the retailer shall be afforded an opportunity
24for a hearing before the commission board to review the determination of the
25administrator.

9shall attempt to minimize the competitive effects of its sales on sales by other
10retailers.

AB150-ASA,2136,195 565.25 (1m) Scope of authority. Subject to approval by the commission, the
6administrator may determine whether lottery functions shall be performed by
7commission employes or by one or more persons under contract with the department,
8except that no contract may provide for the entire management of the lottery or for
9the entire operation of the lottery by any private person. The department may
10contract for management consultation services to assist in the management or
11operation of the lottery. The department may not contract for financial auditing or
12security monitoring services, except that if the department delegates under s. 16.71
13(1) to the commission the authority to make a major procurement the commission
14may contract with the department for warehouse and building protection services
.
15If the department delegates under s. 16.71 (1) to the commission the authority to
16make a major procurement, the commission shall assume the powers and duties of
17the department and the administrator shall assume the powers and duties of the
18secretary of administration under this section and ss. 16.70 to 16.77, except under
19ss. 16.72 (4) (a), 16.76 (1) and 16.77 (1).
AB150-ASA, s. 6981b 20Section 6981b. 565.25 (1m) of the statutes, as affected by 1995 Wisconsin Act
21....(this act), is amended to read:
AB150-ASA,2137,1422 565.25 (1m) Scope of authority. Subject to approval by the commission board,
23the administrator may determine whether lottery functions shall be performed by
24commission department of revenue employes or by one or more persons under
25contract with the department of administration, except that no contract may provide

1for the entire management of the lottery or for the entire operation of the lottery by
2any private person. The department of administration may contract for

AB150-ASA, s. 6981c 15Section 6981c. 565.25 (2) (a) 4. (intro.) of the statutes is amended to read:
AB150-ASA,2137,2516 565.25 (2) (a) 4. (intro.) The administrator shall develop specifications for
17major procurements. If security is a factor in the materials, supplies, equipment,
18property or services to be purchased in any major procurement, then invitations for
19bids or competitive sealed proposals shall include specifications related to security.
20The administrator shall submit specifications for major procurement to the
21commission secretary of revenue for review and approval before the department of
22administration
releases the specifications in invitations for bids or competitive
23sealed proposals. The department of administration shall require separate bids or
24separate competitive sealed proposals for each of the following supplies and services
25if the supplies or services are provided under contract as provided in sub. (1m):

AB150-ASA,2139,513 565.25 (4) Background investigations. The commission, with the assistance
14of the
department of justice, shall conduct a background investigation of any person
15proposing to contract or contracting for a major procurement and of all partners,
16members, officers, directors, owners and beneficial owners identified under sub. (3)
17(b). The commission department of justice may require the person and partners,
18members, officers, directors and shareholders identified under sub. (3) (b) to be
19photographed and fingerprinted on 2 fingerprint cards each bearing a complete set
20of the person's fingerprints. The department of justice may submit the fingerprint
21cards to the federal bureau of investigation for the purposes of verifying the identity
22of the persons fingerprinted and obtaining records of their criminal arrests and
23convictions. If the results of the background investigation disclose information
24specified in sub. (3) (a) with respect to the person, partner, member, officer, director,
25owner or beneficial owner, a contract with the vendor, if entered into prior to the

1disclosure, is void and the vendor shall forfeit any amount filed, deposited or
2established under sub. (5) (b). The commission department of revenue shall
3reimburse the department of justice for the department of justice's services under
4this subsection and shall obtain payment from the person proposing to contract or
5the vendor in the amount of the reimbursement.
AB150-ASA, s. 6981fm 6Section 6981fm. 565.25 (6) of the statutes is created to read:
AB150-ASA,2139,127 565.25 (6) Advertising contracts. Contracts for the advertising of the state
8lottery or any multistate lottery in which the state participates, other than contracts
9for promotional advertising under s. 565.32 (2), that involve any marketing,
10production or talent services may only be entered into with businesses that have
11their principal place of business in this state. Such contracts shall require that all
12marketing, production and talent services be provided by residents of this state.
AB150-ASA, s. 6981g 13Section 6981g. 565.27 (1) (intro.) of the statutes is amended to read:
AB150-ASA,2139,2014 565.27 (1)Game features and procedures. (intro.) Subject to this section, the
15rules promulgated under s. 565.02 (3) (d) and (4) (a) and commission board approval,
16the administrator shall determine the particular features of and procedures for each
17lottery game offered. The administrator shall recommend to the commission board
18for promulgation by rule under s. 565.02 (3) (d) the types of state or multistate lottery
19games to be offered. The features and procedures shall be in writing, shall be
20accessible to the public and shall include all of the following:

AB150-ASA,2140,115 565.30 (1) Payment of prizes. The administrator shall direct the payment of
6a prize to the holder of the winning lottery ticket or lottery share or to a person
7designated under sub. (2), except that a prize may be paid to another person under
8a court order or to the estate of a deceased prize winner. The commission board,

, administrator, state and any contractor for materials, equipment or
10services of the game in which the prize is won are discharged of all liability upon
11payment of the prize to the holder of a winning lottery ticket or lottery share.
AB150-ASA, s. 6981k 12Section 6981k. 565.30 (4m) of the statutes is amended to read:
AB150-ASA,2140,1513 565.30 (4m) Carry over of prize money. The commission department may
14carry over unexpended lottery prize money that is not unclaimed lottery prize money
15from one drawing of a game to another drawing of the same game.
AB150-ASA, s. 6981km 16Section 6981km. 565.30 (5) of the statutes is amended to read:
AB150-ASA,2141,1517 565.30 (5) Withholding of delinquent state taxes, child support or debts
18owed the state.
The administrator shall report the name, address and social security
19number of each winner of a lottery prize equal to or greater than $1,000 to the
20department secretary of revenue to determine whether the payee of the prize is
21delinquent in the payment of state taxes under ch. 71, 72, 76, 77, 78 or 139 or in
22court-ordered payment of child support or has a debt owing to the state. Upon
23receipt of a report under this subsection, the department secretary of revenue shall
24first ascertain based on certifications by the department of health and social services
25industry, labor and human relations under s. 46.255 49.855 (2) whether any person

1named in the report is currently delinquent in court-ordered payment of child
2support and shall next certify to the administrator whether any person named in the
3report is delinquent in court-ordered payment of child support or payment of state
4taxes under ch. 71, 72, 76, 77, 78 or 139. Upon this certification by the department
5secretary of revenue or upon court order the administrator shall withhold the
6certified amount and send it to the department of revenue for remittance to the
7appropriate agency or person. At the time of remittance, the department of revenue
8shall charge its administrative expenses to the state agency that has received the
9remittance. The administrative expenses received by the department of revenue
10shall be credited to the appropriation under s. 20.566 (1) (h). In instances in which
11the payee of the prize is delinquent both in payments for state taxes and in
12court-ordered payments of child support, or is delinquent in one or both of these
13payments and has a debt owing to the state, the amount remitted to the appropriate
14agency or person shall be in proportion to the prize amount as is the delinquency or
15debt owed by the payee.
AB150-ASA, s. 6981kp 16Section 6981kp. 565.30 (5m) of the statutes is amended to read:
AB150-ASA,2142,417 565.30 (5m) Withholding of child support, spousal support, maintenance or
18family support.
The administrator shall report to the department of health and
19social services
industry, labor and human relations the name, address and social
20security number of each winner of a lottery prize that is payable in instalments.
21Upon receipt of the report, the department of health and social services industry,
22labor and human relations
shall certify to the administrator whether any payee
23named in the report is obligated to provide child support, spousal support,
24maintenance or family support under s. 767.02 (1) (f) or (g), 767.10, 767.23, 767.25,
25767.26, 767.261, 767.465 (2m), 767.51 (3), 767.65 (24) [ch. 769] or 948.22 (7) and the

1amount required to be withheld from the lottery prize under s. 767.265. The
2administrator shall withhold the certified amount from each payment made to the
3winner and remit the certified amount to the department of health and social
4services
industry, labor and human relations.
