AB150-ASA,2447,11 14(c)Reporting requirements; evaluation; recommendations. No later than
15October 1, 1995, each specified state body shall submit to the lieutenant governor a
16report on a form prescribed by the lieutenant governor describing its functions and
17the justification, if any, for continuation of those functions. The lieutenant governor
18shall evaluate the information contained in the reports and shall consider whether
19to recommend continuation of each specified state body that is required to submit a
20report under this subsection or transfer of the functions of that body to another state
21body. The department of administration shall assist the lieutenant governor in
22performing this evaluation upon request of the lieutenant governor. The lieutenant
23governor shall, no later than January 1, 1996, submit a report to the cochairpersons
24of the joint committee on finance containing a single piece of proposed legislation
25providing for termination of all specified state bodies and their functions, effective

1on April 1, 1996, except that if a specified state body demonstrates to the satisfaction
2of the lieutenant governor that the functions of the body should be continued after
3March 31, 1996, the lieutenant governor may include in the proposed legislation
4provision for transfer of the functions of the body to another state body. In the report,
5the lieutenant governor shall also include any findings, recommendations or
6conclusions that he reaches as a result of his evaluation. If the lieutenant governor
7recommends continuation of any specified state body after March 31, 1996, the
8lieutenant governor shall also submit with the report a single piece of proposed
9legislation providing for termination or transfer of the functions of all specified state
10bodies except those bodies which the lieutenant governor recommends to be
11continued.
AB150-ASA,2447,12 12(7x)Transfer of municipal boundary review.
AB150-ASA,2447,16 13(a)Assets and liabilities. On the effective date of this paragraph, the assets
14and liabilities of the department of administration primarily related to the functions
15of municipal boundary review, as determined by the secretary of administration,
16shall become the assets and liabilities of the department of development.
AB150-ASA,2447,20 17(b)Employe transfers. All incumbent employes holding positions in the
18department of administration having duties primarily related to the functions of
19municipal boundary review, as determined by the secretary of administration, are
20transferred on the effective date of this paragraph to the department of development.
AB150-ASA,2448,2 21(c)Employe status. Employes transferred under paragraph (b) have all the
22rights and the same status under subchapter V of chapter 111 and chapter 230 of the
23statutes in the department of development that they enjoyed in the department of
24administration immediately before the transfer. Notwithstanding section 230.28 (4)

1of the statutes, no employe so transferred who has attained permanent status in
2class is required to serve a probationary period.
AB150-ASA,2448,7 3(d)Tangible personal property, records. On the effective date of this paragraph,
4all tangible personal property, including records, of the department of
5administration primarily related to the functions of municipal boundary review, as
6determined by the secretary of administration, is transferred to the department of
7development.
AB150-ASA,2448,14 8(e)Contracts. All contracts entered into by the department of administration
9primarily related to the functions of municipal boundary review, as determined by
10the secretary of administration, in effect on the effective date of this paragraph
11remain in effect and are transferred to the department of development. The
12department of development shall carry out any such contractual obligations until
13modified or rescinded by the department of development to the extent allowed under
14the contract.
AB150-ASA,2448,23 15(f)Rules and orders. All rules promulgated by the department of
16administration primarily related to the functions of municipal boundary review, as
17determined by the secretary of administration, that are in effect on the effective date
18of this paragraph remain in effect until their specified expiration date or until
19amended or repealed by the department of development. All orders issued by the
20department of administration primarily related to the functions of municipal
21boundary review, as determined by the secretary of administration, that are in effect
22on the effective date of this paragraph remain in effect until their specified expiration
23date or until modified or rescinded by the department of development.
AB150-ASA,2449,5 24(g)Pending matters. Any matter pending with the department of
25administration primarily related to the functions of municipal boundary review, as

1determined by the secretary of administration, on the effective date of this
2paragraph is transferred to the department of development and all materials
3submitted to or actions taken by the department of administration with respect to
4the pending matter are considered as having been submitted to or taken by the
5department of development.
AB150-ASA,2449,6 6(11g)Educational technology transfers; loan and grant procedures.
AB150-ASA,2449,9 7(a) No later than November 1, 1995, the department of administration and
8educational technology board, as created by this act, shall jointly report to the
9cochairpersons of the joint committee on finance concerning:
AB150-ASA,2449,14 101. A request to transfer not more than 4.0 full-time equivalent positions and
11the funding for those positions to the educational technology board from any other
12state agency, as defined in section 20.001 (1) of the statutes, including a
13recommendation concerning whether any incumbent in a position to be transferred
14should be transferred with his or her position.
AB150-ASA,2449,17 152. A plan which sets forth deadlines, procedures and criteria that the
16educational technology board will use in reviewing and approving applications for
17grants and loans under section 16.992 (3) of the statutes, as created by this act.
AB150-ASA,2450,2 18(b) The joint committee on finance may approve a request submitted under
19paragraph (a) 1. in accordance with section 13.101 (2) and (4) of the statutes and may
20authorize transfer of any incumbent in a position being transferred. If the committee
21authorizes the transfer of an incumbent, the incumbent shall have all the rights and
22the same status under subchapter V of chapter 111 and chapter 230 of the statutes
23that he or she enjoyed in the state agency by which he or she was employed
24immediately before the transfer. Notwithstanding section 230.28 (4) of the statutes,

1no such incumbent who is authorized by the committee to be transferred and who has
2permanent status in class is required to serve a probationary period.
AB150-ASA,2450,5 3(c) No portion of the plan submitted by the educational technology board under
4paragraph (a) 2. may be implemented until the plan is approved by the joint
5committee on finance.
AB150-ASA,2450,25 6(12g) Plan for enhancement of transaction information for the
7management of enforcement system.
The departments of administration and
8justice shall jointly develop a plan for the enhancement of the transaction
9information for the management of enforcement system under section 165.827 of the
10statutes, as affected by this act. The objectives of the plan shall be to convert the
11system to a client-server system and to enhance the capabilities of the system to
12interrelate with the capabilities of systems operated by the federal government and
13other jurisdictions. The departments shall submit the plan to the cochairpersons of
14the joint committee on finance no later than January 1, 1996. The plan may include
15provision for changes in authorized full-time equivalent positions and funding
16required to provide adequate maintenance, technical support and development for
17the system. If the cochairpersons of the committee do not notify the secretary of
18administration and attorney general that the committee has scheduled a meeting for
19the purpose of reviewing the plan within 14 working days after the date of submittal,
20the departments may implement any portion of the plan not requiring approval of
21the committee under section 13.101 of the statutes or the legislature. If, within 14
22working days after the date of submittal, the cochairpersons of the committee notify
23the secretary of administration and attorney general that the committee has
24scheduled a meeting for the purpose of reviewing the plan, no portion of the plan may
25be implemented without the approval of the committee.
