ASSEMBLY AMENDMENT 5, To 1995 ASSEMBLY BILL 557

AB557-AA5,1,1 At the locations indicated, amend the bill as follows:

AB557-AA5,1,3 1. Page 4, line 4: after the semicolon insert: "political contributions by certain highway contractors and bidders;".

AB557-AA5,1,4 2. Page 12, line 1: before that line insert:

AB557-AA5,1,5 " Section 1d. 11.39 of the statutes is created to read:

AB557-AA5,1,10 11.39 Contributions by highway contractors and bidders. (1) In this section: (a) "Highway contract" means any contract for the construction, reconditioning, reconstruction or resurfacing of a highway, as defined in s. 340.01 (22), entered into or proposed to be entered into by the state or a local governmental unit in this state.

AB557-AA5,1,11 (b) "Immediate family" has the meaning given in s. 19.42 (7).

AB557-AA5,1,12 (c) "Local governmental unit" has the meaning given in s. 16.97 (7).

AB557-AA5,2,2 (2) No person who enters into a highway contract with the state or any local governmental unit, while work is being performed by that person under the contract and for one year following completion of any work by that person under the contract, may make any contribution to a candidate for state office, personal campaign committee of such a candidate, legislative campaign committee or political party committee.

AB557-AA5,2,8 (3) No person who performs work as a subcontractor under any highway contract specified in sub. (2), while work is being performed by that person under the contract and for one year following completion of any work by that person under the contract, may make any contribution to a candidate for state office, personal campaign committee of such a candidate, legislative campaign committee or political party committee.

AB557-AA5,2,15 (4) No person who submits a bid to the state or to any local governmental unit in this state to enter into a highway contract, for one year following the due date for submittal of bids for the contract, or if the contract is awarded to the person, for one year after completion of any work by that person under the contract, whichever is later, may make any contribution to a candidate for state office, personal campaign committee of such a candidate, legislative campaign committee or political party committee.

AB557-AA5,2,22 (5) For purposes of subs. (2) to (4), "person" includes an officer or partner of a person to whom sub. (2), (3) or (4) applies, a person who has a 10% or greater interest in an entity to whom sub. (2), (3) or (4) applies, a member of the immediate family of a person to whom sub. (2), (3) or (4) applies, or any person or member of the immediate family of any person to whom sub. (2), (3) or (4) applies who, in combination with the members of his or her immediate family, has a 10% or greater interest in an entity to whom sub. (2), (3) or (4) applies.

AB557-AA5, s. 1g Section 1g. 11.61 (1) (b) of the statutes is amended to read:

AB557-AA5,3,3 11.61 (1) (b) Whoever intentionally violates s. 11.25, 11.26, 11.27 (1), 11.30 (1) or, 11.38 or 11.39 where the intentional violation does not involve a specific figure, or where the intentional violation concerns a figure which exceeds $100 in amount or value may be fined not more than $10,000 or imprisoned not more than 3 years or both.".
