SENATE AMENDMENT 1, To SENATE SUBSTITUTE AMENDMENT 1, To 1995 SENATE BILL 437

SB437-SSA1-SA1,1,1 At the locations indicated, amend the substitute amendment as follows:

SB437-SSA1-SA1,1,2 1. Page 1, line 3: before "criminal" insert "paramilitary training,".

SB437-SSA1-SA1,1,3 2. Page 1, line 7: delete that line and substitute:

SB437-SSA1-SA1,1,4 " Section 1g. 21.10 of the statutes is created to read:

SB437-SSA1-SA1,1,5 21.10 Paramilitary training prohibited. (1) In this section:

SB437-SSA1-SA1,1,6 (a) "Military weapon" includes all of the following:

SB437-SSA1-SA1,1,7 1. A firearm.

SB437-SSA1-SA1,1,9 2. A device capable of discharging a projectile by means of a gas generated from an explosive compound.

SB437-SSA1-SA1,1,10 3. An explosive or incendiary bomb, grenade, rocket, missile or similar device.

SB437-SSA1-SA1,1,12 4. A device for launching an explosive or incendiary bomb, grenade, rocket, missile or similar device.

SB437-SSA1-SA1,2,2 (b) "Paramilitary organization" means an organization of 2 or more persons who engage or conspire to engage in military instruction or training in warfare or sabotage for the purpose of unlawfully causing bodily harm to any person or unlawfully damaging the property of any person.

SB437-SSA1-SA1,2,6 (2) No person may, with knowledge of the purpose of the paramilitary organization, assemble or conspire to assemble with other persons as a paramilitary organization and practice with a military weapon in order to further the purpose of the paramilitary organization.

SB437-SSA1-SA1,2,8 (3) A person who violates sub. (2) may be fined not more than $10,000 or imprisoned for not more than 2 years or both.
