1An Act to renumber and amend 301.21 (1);
to amend 301.21 (title), 301.21 (2),
2301.21 (4), 301.21 (5) and 302.02 (3t); and
to create 301.21 (1g) of the statutes;
3relating to: contracts providing for the confinement of prisoners of this state
4in certain other states.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

2. 301.21 (1) of the statutes is renumbered 301.21 (1r), and 301.21 (1r)
8(intro.), (e), (g) and (j), as renumbered, are amended to read:

(1r) (intro.) The department may enter into one or more contracts with
10the state of Minnesota one or more of the states specified in sub. (1g) for the transfer
11and confinement in
Minnesota the state with which the department is contracting 12of prisoners who have been committed to the custody of the department. Any such
13contract shall provide for all of the following:

1(e) Waiver of extradition by
Minnesota and Wisconsin
and the state with which
2the department is contracting.

(g) Regular reporting procedures
concerning Wisconsin prisoners by
4Minnesota officials
on Wisconsin prisoners of the state with which the department
5is contracting.

(j) Any other matters as are necessary and appropriate to fix the obligations,
7responsibilities and rights of
Minnesota and Wisconsin
and the state with which the
8department is contracting.

(1g) The department may enter into a contract under sub. (1r) with any
11of the following states:

(a) Illinois.

(2) Inmates from Wisconsin state prisons while in
Minnesota
18institutions an institution in another state under a contract entered into under sub.
19(1r) are subject to all provisions of law and regulation concerning the confinement
20of persons committed for violations of the laws of
Minnesota that state, except as
21otherwise provided for by any contract entered into under sub.
(1) (1r).

(4) Sections 16.75 and 301.08 (2) do not apply to contracts entered into
24under sub.
(1) (1r).

(5) The provisions of this section are severable, as provided in s. 990.001
2(11). The provisions of any contract entered into under sub.
(1) (1r) are severable.
3If any provision of such a contract is invalid, or if the application of a provision of the
4contract to any person or circumstance is invalid, the invalidity does not affect other
5provisions or applications which can be given effect without the invalid provision or
6application.

Minnesota Other states' institutions. For all purposes of
9discipline and for judicial proceedings, each
Minnesota institution
of another state 10authorized for use under s. 301.21 and the precincts thereof shall be deemed to be
11in a county in which the institution is physically located, and the courts of that county
12shall have jurisdiction of any activity, wherever located, conducted by
such
13Minnesota the institution.
