SENATE SUBSTITUTE AMENDMENT 1, To 1995 SENATE BILL 610

SB610-SSA1,1,6 An Act to renumber and amend 121.91 (2m) (c) 1. and 121.91 (2m) (c) 4.; to amend 121.90 (1), 121.905 (3) (b), 121.91 (2m) (b) 1., 121.91 (2m) (b) 3., 121.91 (2m) (d) (intro.), 121.91 (2m) (d) 1. and 121.91 (2m) (d) 4.; and to create 121.91 (2m) (c) 1. b., 121.91 (2m) (c) 4. b., 121.91 (2m) (e) and 121.91 (2m) (f) of the statutes; relating to: the determination of the number of pupils for calculating the Milwaukee public school district's revenue limits.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

SB610-SSA1, s. 1 Section 1. 121.90 (1) of the statutes, as affected by 1995 Wisconsin Act 27, is amended to read:

SB610-SSA1,1,11 121.90 (1) "Number of pupils enrolled" means the number of pupils enrolled on the 3rd Friday of September, except that "number of pupils" excludes the number of pupils attending private schools under s. 119.23.

SB610-SSA1, s. 2 Section 2. 121.905 (3) (b) of the statutes, as created by 1995 Wisconsin Act 27, is amended to read:

SB610-SSA1,2,5 121.905 (3) (b) Divide the result in par. (a) by the sum of the average of the number of pupils enrolled in the 3 previous school years and the number of pupils enrolled who were school district residents and solely enrolled in a special education program provided by a county handicapped children's education board program in the previous school year.

SB610-SSA1, s. 3 Section 3. 121.91 (2m) (b) 1. of the statutes, as affected by 1995 Wisconsin Act 27, is amended to read:

SB610-SSA1,2,11 121.91 (2m) (b) 1. Divide the sum of the amount of state aid received in the previous school year and property taxes levied for the previous school year, excluding funds described under sub. (4) (c), by the average of the number of pupils enrolled in the 3 previous school years.

SB610-SSA1, s. 4 Section 4. 121.91 (2m) (b) 3. of the statutes, as affected by 1995 Wisconsin Act 27, is amended to read:

SB610-SSA1,2,15 121.91 (2m) (b) 3. Multiply the result under subd. 2. by the average of the number of pupils enrolled in the current and the 2 preceding school years.

SB610-SSA1, s. 5 Section 5. 121.91 (2m) (c) 1. of the statutes, as created by 1995 Wisconsin Act 27, is renumbered 121.91 (2m) (c) 1. a. and amended to read:

Divide Except as provided in subd. 1. b., divide the sum of the amount of state aid received in the previous school year and property taxes levied for the previous school year, excluding funds described under sub. (4) (c), by the average of the number of pupils enrolled in the 3 previous school years.

For a school district operating under ch. 119, divide the sum of the amount of state aid received in the previous school year and property taxes levied for the previous school year, excluding funds described under sub. (4) (c), by a number calculated by adding the number of pupils enrolled in the 3 previous school years, subtracting from that total the number of pupils attending private schools under s. 119.23 in the 1996-97 school year, and dividing the remainder by 3.

SB610-SSA1, s. 7 Section 7. 121.91 (2m) (c) 4. of the statutes, as created by 1995 Wisconsin Act 27, is renumbered 121.91 (2m) (c) 4. a. and amended to read:

SB610-SSA1,3,8 121.91 (2m) (c) 4. a. Multiply Except as provided in subd. 4. b., multiply the result under subd. 3. by the average of the number of pupils enrolled in the current and the 2 preceding school years.

SB610-SSA1, s. 8 Section 8. 121.91 (2m) (c) 4. b. of the statutes is created to read:

For a school district operating under ch. 119, multiply the result under subd. 3. by a number calculated by adding the number of pupils enrolled in the current and the 2 preceding school years, subtracting from that total the number of pupils attending private schools under s. 119.23 in the 1996-97 school year, and dividing the remainder by 3.

SB610-SSA1, s. 9 Section 9. 121.91 (2m) (d) (intro.) of the statutes, as created by 1995 Wisconsin Act 27, is amended to read:

SB610-SSA1,3,19 121.91 (2m) (d) (intro.) Except as provided in pars. (e) and (f) and subs. (3) and (4), no school district may increase its revenues for the 1998-99 school year or for any school year thereafter to an amount that exceeds the amount calculated as follows:

SB610-SSA1, s. 10 Section 10. 121.91 (2m) (d) 1. of the statutes, as created by 1995 Wisconsin Act 27, is amended to read:

SB610-SSA1,3,25 121.91 (2m) (d) 1. Divide the sum of the amount of state aid received in the previous school year and property taxes levied for the previous school year, excluding funds described under sub. (4) (c), by the average of the number of pupils enrolled in the 3 previous school years.

SB610-SSA1, s. 11 Section 11. 121.91 (2m) (d) 4. of the statutes, as created by 1995 Wisconsin Act 27, is amended to read:

SB610-SSA1,4,4 121.91 (2m) (d) 4. Multiply the result under subd. 3. by the average of the number of pupils enrolled in the current and the 2 preceding school years.

SB610-SSA1, s. 12 Section 12. 121.91 (2m) (e) of the statutes is created to read:

SB610-SSA1,4,8 121.91 (2m) (e) Except as provided in subs. (3) and (4), no school district operating under ch. 119 may increase its revenues for the 1998-99 school year to an amount that exceeds the amount calculated as follows:

SB610-SSA1,4,14 1. Divide the sum of the amount of state aid received in the previous school year and property taxes levied for the previous school year, excluding funds described under sub. (4) (c), by a number calculated by adding the number of pupils enrolled in the 3 previous school years, subtracting from that total the number of pupils attending private school under s. 119.23 in the 1996-97 and 1997-98 school years, and dividing the remainder by 3.

SB610-SSA1,4,15 2. Add the result under subd. 1. to the amount under par. (c) 2.

SB610-SSA1,4,19 3. Multiply the result under subd. 2. by a number calculated by adding the number of pupils enrolled in the current and the 2 preceding school years, subtracting from that total the number of pupils attending private schools under s. 119.23 in the 1996-97 and 1997-98 school years, and dividing the remainder by 3.

SB610-SSA1, s. 13 Section 13. 121.91 (2m) (f) of the statutes is created to read:

SB610-SSA1,4,24 121.91 (2m) (f) Except as provided in subs. (3) and (4), no school district operating under ch. 119 may increase its revenues for the 1999-2000 school year or for any school year thereafter to an amount that exceeds the amount calculated as follows:

SB610-SSA1,5,6 1. Divide the sum of the amount of state aid received in the previous school year and property taxes levied for the previous school year, excluding funds described under sub. (4) (c), by a number calculated by adding the number of pupils enrolled in the 3 previous school years, subtracting from that total the number of pupils attending private schools under s. 119.23 in the 3 previous school years, and dividing the remainder by 3.

SB610-SSA1,5,7 2. Add the result under subd. 1. to the amount under par. (c) 2.

SB610-SSA1,5,11 3. Multiply the result under subd. 2. by a number calculated by adding the number of pupils enrolled in the current and the 2 preceding school years, subtracting from that total the number of pupils attending private schools under s. 119.23 in the 3 previous school years, and dividing the remainder by 3.

SB610-SSA1, s. 14 Section 14. Initial applicability.

SB610-SSA1,5,14 (1) This act first applies to the calculation of a school district's revenue limit for the 1997-98 school year.
