SENATE SUBSTITUTE AMENDMENT 2,
TO 1997 SENATE BILL 373

SB373-SSA2,1,1 1An Act relating to: a study for a bluff protection program.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB373-SSA2, s. 1 2Section 1. Nonstatutory provisions.
SB373-SSA2,1,63 (1) The department of natural resources shall conduct a study on the damage,
4destruction and protection of bluffs and on the feasibility of establishing a program
5for bluff protection. In conducting the study, the department shall do all of the
6following:
SB373-SSA2,1,97 (a) Study natural forces that cause erosion, recession or destruction of bluffs
8and identify bluffs where those natural forces threaten public or private property or
9limit the potential for development of public or private property.
SB373-SSA2,1,1210 (b) Study the attributes of bluffs, including biological diversity, recreational
11potential and aesthetic values, that warrant special protection and identify bluffs
12that exhibit those attributes.

1(c) Study the factors that lead to the loss of aesthetic values of bluffs and
2identify bluffs where those factors threaten the loss of aesthetic values.
SB373-SSA2,2,73 (2) No later than December 31, 1999, the department of natural resources shall
4submit a report to the legislature for distribution to the appropriate standing
5committees in the manner provided under section 13.172 (3) of the statutes that
6summarizes the findings and conclusions of the study and that makes
7recommendations for legislation. The report shall include all of the following:

9destruction threaten public or private property or limit the potential for development
10of public or private property, where the attributes warranting special protection are
11exhibited or where development or other factors threaten the loss of the aesthetic
12values.
SB373-SSA2,2,1713 (b) Recommendations for directing development away from bluffs where
14erosion, recession or destruction threaten public or private property or limit the
15potential for development of public or private property, where the attributes
16warranting special protection are exhibited or where development or other factors
17threaten the loss of aesthetic values.
SB373-SSA2,2,1918 (c) A recommendation for a definition of "bluff" for purposes of any program
19that may be established to protect bluffs.
