17affected by this act, to the legislative council staff under section 227.15 (1) of the
18statutes no later than the first day of the 3rd month beginning after the effective date
19of this paragraph.

20(b) Using the procedure under section 227.24 of the statutes, the department
21of commerce shall promulgate the rules required under section 101.143 (2) (h), (i) and
22(j) and (2e) (a) of the statutes, as created by this act, and shall promulgate rules to
23implement section 101.143 (4) (cm) 1. of the statutes, as affected by this act, for the
24period before the effective date of the rules submitted under paragraph (a), but not
1to exceed the period authorized under section 227.24 (1) (c) and (2) of the statutes.
2Notwithstanding section 227.24 (1) (a), (2) (b) and (3) of the statutes, the department
3is not required to provide evidence that promulgating rules under this paragraph is
4necessary for the preservation of the public peace, health, safety or welfare and is not
5required to provide a finding of emergency for rules promulgated under this
6paragraph. The department shall promulgate rules under this paragraph no later
7than the 30th day after the effective date of this paragraph.

8(c) The department of natural resources shall submit in proposed form any
9changes in its rules necessary to implement this act to the legislative council staff
10under section 227.15 (1) of the statues no later than the first day of the 6th month

(7v) Grants to CAP Services, Inc. From the appropriation under section
1620.143 (1) (fg) of the statutes, as affected by this act, the department of commerce
17shall make a grant of $12,500 in each of fiscal years 1999-2000 and 2000-01 to CAP
18Services, Inc., for providing technical assistance and management services to small
19businesses. The grants under this subsection shall be in addition to any grants
20awarded to CAP Services, Inc., under section 560.13 of the statutes, as affected by
21this act. Within 6 months after spending the full amount of each grant under this
22subsection, CAP Services, Inc., shall submit a report to the department of commerce
23detailing how the grant proceeds were used.".

(7h) Grant for Swiss cultural center.

2(a) Subject to paragraph (b), from the appropriation under section 20.143 (1)
3(km) of the statutes, as created by this act, the department of commerce shall make
4a grant in fiscal biennium 1999-2001 to an organization known as the Swiss Cultural
5Center for construction of a Swiss cultural center in the village of New Glarus.

6(b) The amount of the grant under paragraph (a) may not exceed $1,000,000.
7For every dollar received from the state for the project under paragraph (a), the
8organization shall provide $2 in matching funds for the project from a source other

21the department shall make a grant of $100,000 to a person for the cleanup of a
22brownfields site in the city of Kenosha and for development of the cleaned-up site
23as a park if all of the following apply:

11. The person submits a plan to the department detailing the proposed use of
2the grant and the secretary approves the plan.

32. The person enters into a written agreement with the department that

(8e) Community development block grant for domestic violence shelter.
15The department of commerce shall make a grant of $250,000 in fiscal year
161999-2000, from the appropriation under section 20.143 (1) (n) of the statutes, to a
17county in which a domestic violence shelter is being constructed by the Young
18Women's Christian Association in a city that is located in the county and that has a
19population greater than 52,000 but less than 60,000. The county must use the grant
20proceeds to provide financial assistance to the Young Women's Christian Association
21for the construction of the domestic violence shelter. Within 6 months after spending
22the full amount of the grant, the county shall submit to the department of commerce
23a report detailing how the grant proceeds were spent.".

(6q) Transferring prisoners to county facilities from out-of-state jails
2and prisons.

3(a) Solicitation and acceptance of proposals. Before October 31, 2000, the
4department of corrections shall solicit proposals from counties for contracts, to
5commence during the first quarter of calendar year 2001, under which prisoners who
6are confined in other states under section 301.21 of the statutes may be returned to
7Wisconsin and confined in a county jail or house of correction. If one or more counties
8propose to enter into a contract with the department that meets the requirements
9of this subsection, and the number of prisoners who could be transferred under the
10proposed contracts is 1,000 or more, the department shall reduce by 1,000 the
11number of Wisconsin prisoners confined in other states under section 301.21 of the
12statutes by entering into one or more such contracts, consistent with the competitive
13process it has established under paragraph (d). If the proposed contracts meet the
14requirements of this subsection, but the number of prisoners who could be
15transferred under the proposed contracts is less than 1,000, the department shall
16enter into all such proposed contracts and shall reduce the number of prisoners
17confined in their states under section 301.21 of the statutes by the number of
18prisoners who are to be transferred under the contracts.

19(b) Contract requirements. Each contract entered into by the department under
20this subsection shall include a termination date, shall identify the regulations and
21rules of the department and of the county jail or house of correction to which the
22prisoners will be subject and shall contain provisions regarding all of the following:

24of prisoner earnings and the crediting of proceeds from or disposal of any products
25resulting from prisoner employment.

23. Regular reporting by the county concerning the prisoners confined under the

6(c) Standard of care. Prisoners confined by a county under this subsection shall
7be subject to the same standards of reasonable and humane care as the prisoners
8would receive in an appropriate state correctional institution.

9(d) Procedures. 1. The department shall establish a competitive process,
10subject to approval by the secretary of administration, to govern the solicitation of
11proposals and the awarding of contracts under this subsection. Notwithstanding
12section 227.10 (1) of the statutes, the procedures governing the solicitation of
13proposals and the awarding of contracts need not be promulgated as rules under
14chapter 227 of the statutes.

152. Sections 16.75 and 301.08 (2) of the statutes do not apply to contracts entered

17(e) Limit on payments under contracts. The department may not enter into a

19more than $57 per prisoner per day, excluding the cost of transporting prisoners, the

23subsection are severable. If any provision of such a contract is invalid, or if the
24application of a provision of the contract to any person or circumstance is invalid, the
