8after the beginning of a license year shall pay the full annual fund assessment
9required under this section. The grain warehouse keeper shall pay, with the first
10quarterly installment that becomes due after the day on which the department
11issues the license, all of the quarterly installments that were due before that day.
SB55-SSA1-CA1,595,1512 (d) A contributing grain warehouse keeper who fails to pay the full amount of
13any quarterly installment when due shall pay, in addition to that installment, a late
14payment penalty of $50 or 10% of the overdue installment amount, whichever is
15greater.
SB55-SSA1-CA1,595,18 16(7) Notice of annual assessment and quarterly installments. When the
17department issues an annual license to a contributing grain warehouse keeper, the
18department shall notify the grain warehouse keeper of all of the following:

20this section.
SB55-SSA1-CA1,595,2221 (b) The amount of each required quarterly installment under sub. (6), and the

1126.31 Grain warehouse keepers; security. (1) Security required. A
2grain warehouse keeper shall file security with the department, and maintain that
3security until the department releases it under sub. (8), if all of the following apply
4when the department first licenses the grain warehouse keeper under s. 126.26 (1):
SB55-SSA1-CA1,596,65 (a) The grain warehouse keeper operates grain warehouses with a combined
6capacity of more than 300,000 bushels.
SB55-SSA1-CA1,596,87 (b) The grain warehouse keeper's annual financial statement under s. 126.28
8(1) (a) shows negative equity.
SB55-SSA1-CA1,596,11 9(2) Security continued. A grain warehouse keeper who filed security under
10ch. 127, 1999 stats., before September 1, 2002, shall maintain that security until the
11department releases it under sub. (8).
SB55-SSA1-CA1,596,15 12(3) Amount of security. A grain warehouse keeper who is required to file or
13maintain security under this section shall at all times maintain security equal to at
14least 20% of the current local market value of grain that the grain warehouse keeper
15holds in this state for others.
SB55-SSA1-CA1,596,18 16(4) Form of security. The department shall review, and determine whether
17to approve, security filed or maintained under this section. The department may
18approve only the following types of security:

SB55-SSA1-CA1,596,2020 (b) A commercial surety bond if all of the following apply:
SB55-SSA1-CA1,596,2221 1. The surety bond is made payable to the department for the benefit of
22depositors.
SB55-SSA1-CA1,596,2423 2. The surety bond is issued by a person authorized to operate a surety business
24in this state.
SB55-SSA1-CA1,597,3
13. The surety bond is issued as a continuous term bond that may be canceled
2only with the department's written agreement, or upon 90 days' prior written notice
3served on the department in person or by certified mail.
SB55-SSA1-CA1,597,54 4. The surety bond is issued in a form, and subject to any terms and conditions,
5that the department considers appropriate.
SB55-SSA1-CA1,597,76 (c) A certificate of deposit or money market certificate, if all of the following
7apply:
SB55-SSA1-CA1,597,98 1. The certificate is issued or endorsed to the department for the benefit of
9depositors.
SB55-SSA1-CA1,597,1110 2. The certificate may not be canceled or redeemed without the department's
11written permission.
SB55-SSA1-CA1,597,1312 3. No person may transfer or withdraw funds represented by the certificate
13without the department's written permission.
SB55-SSA1-CA1,597,1414 4. The certificate renews automatically without any action by the department.
SB55-SSA1-CA1,597,1615 5. The certificate is issued in a form, and subject to any terms and conditions,
16that the department considers appropriate.
SB55-SSA1-CA1,597,1717 (d) An irrevocable bank letter of credit if all of the following apply:
SB55-SSA1-CA1,597,1818 1. The letter of credit is payable to the department for the benefit of depositors.
SB55-SSA1-CA1,597,1919 2. The letter of credit is issued on bank letterhead.
SB55-SSA1-CA1,597,2020 3. The letter of credit is issued for an initial period of at least one year.
SB55-SSA1-CA1,597,2321 4. The letter of credit renews automatically unless at least 90 days before the
22scheduled renewal date the issuing bank gives the department written notice, in
23person or by certified mail, that the letter of credit will not be renewed.
SB55-SSA1-CA1,597,2524 5. The letter of credit is issued in a form, and subject to any terms and
25conditions, that the department considers appropriate.

1(e) Security filed under ch. 127, 1999 stats., before September 1, 2002, except
2that on January 1, 2003, the department shall withdraw its approval of any security
3that is not approvable under pars. (a) to (d).
SB55-SSA1-CA1,598,6 4(5) Department custody of security. The department shall hold, in its custody,
5all security filed and maintained under this section. The department shall hold the
6security for the benefit of depositors.
SB55-SSA1-CA1,598,9 7(6) Additional security. (a) The department may, at any time during a license
8year, demand additional security from a grain warehouse keeper if any of the
9following applies:
SB55-SSA1-CA1,598,1310 1. The grain warehouse keeper's existing security falls below the amount
11required under sub. (3) for any reason, including depreciation in the value of the
12security, increased obligations to depositors, or the cancellation of any security filed
13with the department.
SB55-SSA1-CA1,598,1514 2. The grain warehouse keeper fails to provide required information that is
15relevant to a determination of security requirements.
SB55-SSA1-CA1,598,2016 (b) The department shall issue a demand under par. (a) in writing. The
17department shall indicate why additional security is required, the amount of
18security required, and the deadline date for filing security. The department may not
19specify a deadline for filing security that is more than 30 days after the date on which
20the department issues its demand for security.
