AB449-AA1,1,1 At the locations indicated, amend the bill as follows:

AB449-AA1,1,2 1. Page 5, line 1: before that line insert:

AB449-AA1,1,4 " Section 2m. 20.370 (3) (bL) of the statutes, as created by 2005 Wisconsin Act 25, is amended to read:

AB449-AA1,1,8 20.370 (3) (bL) Operator certification — fees. From the general fund, from the moneys received under ss. 281.17 (3) and 281.48 (4s) (a) and (b) (c), the amounts in the schedule for administrative activities related to the certification of operators of water systems, wastewater treatment plants, and septage servicing vehicles.".

AB449-AA1,1,9 2. Page 5, line 1: delete lines 1 to 5 and substitute:

AB449-AA1,1,11 " Section 3b. 20.370 (4) (bL) of the statutes, as affected by 2005 Wisconsin Act 25, is amended to read:

AB449-AA1,2,3 20.370 (4) (bL) Wastewater management — fees. From the general fund, from the moneys received under. ss. 281.17 (3) and s. 281.48 (4s) (a) and (b) (c), all moneys not appropriated under sub. (3) (bL), for the certification of operators of water systems, wastewater treatment plants and septage servicing vehicles and for wastewater management activities.".

AB449-AA1,2,9 "(d) The department may make grants under the local assistance program to provide funds to nonprofit, nongovernmental organizations for the development of software to support the inventory and record-keeping activities of governmental units for the maintenance program under sub. (5). The department may not make a grant under this paragraph unless the department determines all of the following:

AB449-AA1,2,11 1. That the organization requests a grant and has adequate plans to develop the software.

AB449-AA1,2,13 2. That the organization has adequate controls in place to manage the grant funds.

AB449-AA1,2,15 3. That sufficient governmental units are likely to use the software to justify the development costs.

AB449-AA1,2,18 4. That the availability of the software will contribute to coordinated and compatible maintenance programs in governmental units on a regional or statewide basis.".

AB449-AA1,2,19 4. Page 13, line 1: before that line insert:

AB449-AA1,2,20 " Section 14m. 145.245 (6) (a) of the statutes is amended to read:

AB449-AA1,3,2 145.245 (6) (a) Except for grants under par. (b) and sub. (11) (f), funds available under a grant under this section shall be applied to the rehabilitation or replacement of the private sewage system. An existing private sewage system may be replaced by an alternative private sewage system or by a system serving more than one principal residence.".

AB449-AA1,3,5 5. Page 23, line 12: after "paragraph" insert "if the department determines that the fees are no more than is necessary to fund the county program under this paragraph".

AB449-AA1,3,6 6. Page 23, line 18: after "prohibit" insert "or regulate".

AB449-AA1,3,8 7. Page 27, line 9: delete "The interest" and substitute "Notwithstanding subd. 1., the interest".

AB449-AA1,3,9 8. Page 28, line 10: delete "not".

AB449-AA1,3,11 9. Page 28, line 11: delete lines 11 to 15 and substitute "sludge to land if the regulation is identical to regulations of the department under sub. (1).".
