SENATE AMENDMENT 1, TO 2005 ASSEMBLY BILL 800

AB800-SA1,1,1 At the locations indicated, amend the bill as follows:

AB800-SA1,1,5 1. Page 1, line 4: after "programs" insert ", the minimum age for hunting and possessing a firearm, age specific restrictions on hunting and on possessing a firearm while hunting, requirements for obtaining a hunting certificate of accomplishment, and establishing a hunting mentorship program".

AB800-SA1,1,6 2. Page 2, line 1: before that line insert:

AB800-SA1,1,7 " Section 1b. 29.184 (1) (b) of the statutes is amended to read:

AB800-SA1,1,9 29.184 (1) (b) "Minor" means a person who is at least 12 10 years of age but under 18 years of age.

AB800-SA1, s. 1c Section 1c. 29.184 (6) (b) 1. of the statutes is amended to read:

AB800-SA1,1,11 29.184 (6) (b) 1. The applicant is at least 12 10 years old.

AB800-SA1, s. 1d Section 1d. 29.304 (1) (a) of the statutes is amended to read:

AB800-SA1,2,2 29.304 (1) (a) Prohibition on hunting. No person under 12 10 years of age may hunt with a firearm or, a bow and arrow , or a crossbow.

AB800-SA1, s. 1e Section 1e. 29.304 (1) (ag) of the statutes is created to read:

AB800-SA1,2,10 29.304 (1) (ag) Restrictions on possession or control of a firearm by persons under the age of 10. No person under 10 years of age may have in his or her possession or control any firearm unless he or she is enrolled in the course of instruction under the hunter education program and is carrying the firearm in a case and unloaded to or from that class under the supervision of his or her parent or guardian, or a person at least 18 years of age who is designated by the parent or guardian, or is handling or operating the firearm during that class under the supervision of an instructor.

AB800-SA1, s. 1f Section 1f. 29.304 (1) (am) of the statutes is created to read:

AB800-SA1,2,14 29.304 (1) (am) Restrictions on hunting by persons 10 or 11 years of age. No person who is 10 or 11 years of age may hunt unless he or she is hunting with a mentor and meets the requirements under s. 29.592.

AB800-SA1, s. 1g Section 1g. 29.304 (1) (b) of the statutes is renumbered 29.304 (1) (b) (intro.) and amended to read:

AB800-SA1,2,19 29.304 (1) (b) Restrictions on possession or control of a firearm by persons 10 or 11 years of age. (intro.) No person under 12 who is 10 or 11 years of age may have in his or her possession or control any firearm unless he any of the following apply:

AB800-SA1,2,24 1. He or she is enrolled in the course of instruction under the hunter education program and he or she is carrying the firearm in a case and unloaded to or from that class under the supervision of a his or her parent or guardian, or by a person at least 18 years of age who is designated by the parent or guardian, or is handling or operating the firearm during that class under the supervision of an instructor.

AB800-SA1,3,2 29.304 (1) (b) 2. He or she is hunting with a mentor and meets the requirements specified under s. 29.592.

AB800-SA1, s. 1j Section 1j. 29.304 (1) (c) of the statutes is amended to read:

AB800-SA1,3,6 29.304 (1) (c) Restrictions on obtaining hunting approval. Except as provided under par. (d), no person under 12 10 years of age may obtain any approval authorizing hunting.

AB800-SA1, s. 1h Section 1h. 29.304 (1) (d) of the statutes is amended to read:

AB800-SA1,3,11 29.304 (1) (d) Restrictions on validity of certificate of accomplishment. A person under 12 10 years of age may obtain a certificate of accomplishment if he or she complies with the requirements of s. 29.591 (4) but that certificate is not valid for the hunting of small game until that person becomes 12 10 years of age.

AB800-SA1, s. 1m Section 1m. 29.304 (2) (title) of the statutes is amended to read:

AB800-SA1,3,13 29.304 (2) (title) Persons 12 to 14 and 13 years of age.

AB800-SA1, s. 1n Section 1n. 29.304 (2) (a) of the statutes is amended to read:

AB800-SA1,3,19 29.304 (2) (a) Restrictions on hunting. No person 12 years of age or older but under 14 years of age may hunt unless he or she is accompanied by a his or her parent or guardian, or by a person at least 18 years of age who is designated by the parent or guardian, or he or she is hunting with a mentor and meets the requirements specified under s. 29.592.

AB800-SA1, s. 3c Section 3c. 29.304 (5) of the statutes is amended to read:

AB800-SA1,6,2 29.304 (5) Exception. Notwithstanding subs. (1) to (3), a person 12 years of age or older may possess or control a firearm and may hunt with a firearm or, bow and arrow, or crossbow on land under the ownership of the person or the person's family if no license is required and if the firing of firearms is permitted on that land.

AB800-SA1, s. 3d Section 3d. 29.304 (5) (b) of the statutes is created to read:

AB800-SA1,6,7 29.304 (5) (b) The restrictions on the possession and control of a firearm under sub. (1) do not apply to a person using a firearm in target practice if he or she is accompanied by his or her parent or guardian or by a person at least 18 years of age who is designated by the parent or guardian.
