3program for the timely resolution of any dispute that concerns a defect in a
4manufactured home, or in the installation of a manufactured home, reported to the
5department within one year of the date on which the manufactured home was
6installed and that occurs between parties, each of which is a manufacturer of
7manufactured homes, manufactured home salesperson, manufactured home dealer,
8or installer. The rules may require the parties to submit to an alternative dispute
9resolution program before bringing an action in another forum. This section does not
10affect the rights of any consumer to commence an action or the rights of any person
11to commence an action against a consumer.

14standards. (a)
Promulgation of standards. The department shall, by rule, establish
15installation standards for the safe installation of manufactured homes in this state.
16In promulgating rules under this paragraph, the department shall consider the
17recommendations of the manufactured housing code council under s. 101.933.

(b)
Enforcement of standards. The department shall, by rule, establish a
19method for ensuring compliance with the rules promulgated under par. (a). The
20department shall require inspections of manufactured home installations by
213rd-party inspectors licensed by the department. The department shall, by rule,
22establish criteria for the licensure of 3rd-party inspectors that include a
23requirement that an individual may not serve as a 3rd-party inspector if the
24individual is, is employed by, or is an independent contractor of any of the following:

7(2) Manufactured home installers. (a)
License required; exceptions; liability. 8Except as otherwise provided in this paragraph, beginning on January 1, 2007, no
9person may act as an installer in this state unless the person is a licensed installer
10or employs one or more licensed installers to generally supervise each of the person's
11installations of manufactured homes in this state. This requirement does not apply
12to an individual who installs a manufactured home on his or her own property for his
13or her personal use or to an individual who installs a manufactured home under the
14general supervision of a licensed installer. A licensed installer is liable for all acts
15and omissions related to the installation of each individual who performs an
16installation under the licensed installer's general supervision.

(b)
License eligibility. The department may issue an installer's license only to
18an individual to whom all of the following apply:

1. The individual is at least 18 years old.

3. The individual completes, to the satisfaction of the department, an

11environmentally sound disposal practices.

(b) The department may make grants under this section to provide financial
13assistance to individuals who reside in manufactured homes that are in need of
14critical repairs. An individual is eligible for a grant under this paragraph only if the
15individual is otherwise unable to finance the critical repairs.

16(3) Administration. The department shall contract with one or more entities
17that are exempt from taxation under section
501 (a) of the Internal Revenue Code
18and that employ individuals with technical expertise concerning manufactured
19housing for the administration of the grant program under this section. The

21section. To the extent feasible, the department shall coordinate the program under
22this section with the state housing strategy plan under s. 560.9802.

Proposed rules. No later than the first day of the 12th month beginning
25after the effective date of this subsection, the department of commerce shall submit
1in proposed form the rules required under sections 101.9205 (3), 101.9208, 101.9213

3act, to the legislative council staff under section 227.15 (1) of the statutes unless the
4secretary of administration requires the department to prepare an economic impact
5report under section 227.137 of the statutes for the proposed rules.

Emergency rules. Using the procedure under section 227.24 of the statutes,
7the department of commerce may promulgate rules required under sections
8101.9205 (3), 101.9208, 101.9213 (8), 101.935 (2) (c) 2., 101.95, 101.951 (2) (bm), and
9101.952 (2) (bm) of the statutes, as affected by this act, within 30 days after the
10effective date of this subsection. Notwithstanding section 227.24 (1) (c) and (2) of the
11statutes, emergency rules promulgated under this subsection shall remain in effect
12until December 31, 2007, or the date on which permanent rules take effect,
13whichever is sooner. Notwithstanding section 227.24 (1) (a) and (3) of the statutes,
14the department is not required to provide evidence that promulgating a rule under
15this subsection as an emergency rule is necessary for the preservation of public
16peace, health, safety, or welfare and is not required to provide a finding of emergency
17for a rule promulgated under this subsection.

19the length of terms specified for the manufactured housing code council under
20section 15.157 (13) (a) of the statutes, as created by this act, the initial members
21appointed under section 15.157 (13) (a) 1. and 2. of the statutes, as created by this
22act, shall be appointed for terms that expire on July 1, 2006; the initial members
23appointed under section 15.157 (13) (a) 3. and 4. of the statutes, as created by this
24act, shall be appointed for terms that expire on July 1, 2007; and the initial members
