SENATE AMENDMENT 2, TO SENATE SUBSTITUTE AMENDMENT 1, TO 2005 SENATE BILL 42

SB42-SSA1-SA2,1,1 At the locations indicated, amend the substitute amendment as follows:

SB42-SSA1-SA2,1,3 1. Page 2, line 1: after "homes," insert "notification of regular absentee voting privileges,".

SB42-SSA1-SA2,1,4 2. Page 7, line 17: after that line insert:

SB42-SSA1-SA2,1,5 " Section 8m. 6.31 of the statutes is created to read:

SB42-SSA1-SA2,2,2 6.31 Notice of regular absentee voting privilege. (1) Whenever an elector registers in person, except under s. 6.55 (2), the municipal clerk or special registration deputy shall provide to the elector written notification, on a form prescribed by the board, informing the elector of the privilege of requesting that absentee ballots be mailed to the elector regularly under s. 6.86 (2). The clerk or special registration deputy shall accept an application under s. 6.86 (2) from any elector who registers with the clerk or deputy. Each special registration deputy shall deliver the application to the municipal clerk together with the elector's registration form.

SB42-SSA1-SA2,2,5 (2) If an elector registers by mail, the municipal clerk shall, promptly upon entering the elector's registration on the registration list, send the elector a 1st class postcard containing the notice required under sub. (1).".

SB42-SSA1-SA2,2,13 6.80 (4) Notice of regular absentee voting privilege. After each elector casts his or her ballot, an inspector shall provide to the elector written notification, on a form prescribed by the board, informing the elector of the privilege of requesting that absentee ballots be sent to the elector regularly under s. 6.86 (2). The inspector shall accept an application under s. 6.86 (2) from any elector who votes at the polling place and shall deliver the application to the municipal clerk after the close of the polls.".

SB42-SSA1-SA2,2,15 " Section 22m. 6.86 (2) (a) of the statutes is amended to read:

SB42-SSA1-SA2,3,2 6.86 (2) (a) An elector who is indefinitely confined because of age, physical illness or infirmity or is disabled for an indefinite period may by signing a statement to that effect written request to the municipal clerk of the municipality where the elector resides require that an absentee ballot be sent to the elector automatically for every election. The application form and instructions shall be prescribed by the board, and furnished upon request to any elector by each municipality. The envelope containing the absentee ballot shall be clearly marked as not forwardable. If any elector is no longer indefinitely confined wishes to have an absentee ballot sent to him or her under this subsection, the elector shall so notify the municipal clerk in writing. The clerk shall then discontinue sending absentee ballots to the elector under this subsection.".

SB42-SSA1-SA2,3,4 " Section 35m. 7.08 (1) (c) of the statutes is amended to read:

SB42-SSA1-SA2,3,9 7.08 (1) (c) Prescribe forms required by ss. 6.24 (3) and (4), 6.30 (4), 6.31, 6.33 (1), 6.40 (1) (a), 6.47 (1) (a) 2. and (3), 6.55 (2) and (3), 6.80 (4), and 6.86 (2) and (3). All such forms shall contain a statement of the penalty applicable to false or fraudulent registration or voting through use of the form. Forms are not required to be furnished by the board.".
