8department on a form provided by the department and shall include the renewal fee
9determined by the department under s. 440.03 (9) (a).
AB440-ASA1, s. 58 10Section 58. 448.86 (3) of the statutes is created to read:

12shall provide to the department proof of satisfactory completion of at least the
13minimum continuing professional education credits required by the registration
14commission and shall submit one of the following:

AB440-ASA1,15,1816 (b) Verification from the registration commission that the applicant has
17completed and accurately reported at least the minimum continuing professional
18education credits required by the commission.
AB440-ASA1, s. 59 19Section 59. 448.865 of the statutes is created to read:
AB440-ASA1,15,25 20448.865 Disclosure required to provide certain services. (1) An
21individual who is neither licensed under this subchapter nor exempt from licensure
22under s. 448.72 may provide general nonmedical nutrition information and other
23information or services related to nutrition to a client or group of clients for
24compensation, direct or indirect, or in the expectation of compensation, if the
25individual complies with all of the following:

1(a) The individual does not engage in the practice of dietetic nutrition care
2services.
AB440-ASA1,16,43 (b) The individual provides to the client or group of clients a written disclosure
4that contains the following information:
AB440-ASA1,16,65 1. The name, professional title, business address, and business telephone
6number of the individual.
AB440-ASA1,16,87 2. A statement that the individual is not licensed as a dietitian nutritionist in
8this state and cannot provide dietetic nutrition therapy.
AB440-ASA1,16,119 3. A statement that the individual may not provide a medical diagnosis or
10recommend that the client or group of clients discontinue medically prescribed
11treatments.
AB440-ASA1,16,1312 (c) The individual clearly posts in the individual's place of business a copy of
13the written disclosure under par. (b).
AB440-ASA1,16,1814 (d) Prior to providing services to a client or group of clients, the individual
15obtains from each client a signed and dated statement on which the client confirms
16receiving and reading the disclosure required under par. (b). The individual shall
17maintain the signed statement in the client's file for 7 years after the client has
18ceased being a client of the individual.
AB440-ASA1,16,21 19(2) An individual who provides information and services to other individuals
20under s. 448.72 (12) shall provide to the other individuals a written disclosure that
21contains the information required under sub. (1) (b) 2.

AB440-ASA1,17,223 448.87 (2) (intro.) Subject to the rules promulgated under s. 440.03 (1), the
24affiliated credentialing board may reprimand a certified licensed dietitian
25nutritionist or deny, limit, suspend, or revoke a certificate license granted under this

1subchapter if it finds that the applicant or certified licensed dietitian nutritionist has
2done any of the following:

AB440-ASA1,18,158 (a) Individuals certified by the dietitians affiliated credentialing board as a
9dietitian on the effective date of this act.
Notwithstanding section 448.78 (3) to (5) of
10the statutes, as affected by this act, no later than the first day of the 7th month
11beginning after the effective date of this paragraph, the dietetic nutrition care
12services affiliated credentialing board shall grant a license under section 448.78 of
13the statutes, as affected by this act, to an individual who, on the the effective date
14of this act, held a valid certificate as a dietitian granted by the dietitians affiliated
15credentialing board.
AB440-ASA1,18,2416 (b) Individuals registered as a registered dietitian with the American Dietetic
17Association on the effective date of this act.
Notwithstanding section 448.78 (3) to (5)
18of the statutes, as affected by this act, the dietetic nutrition care services affiliated
19credentialing board shall grant a license under section 448.78 of the statutes, as
20affected by this act, to an individual who no later than the first day of the 13th month
21beginning after the effective date of this paragraph provides sufficient evidence to
22the dietetic nutrition care services affiliated credentialing board that the individual
23was registered as a registered dietitian with the commission on dietetic registration
24of the American Dietetic Association on the effective date of this act.
