(7) (h) Annually, by August 1, the state superintendent shall, with the
8assistance of the department of justice, do all of the following:

1. Conduct a criminal history records search on each teacher and administrator
10employed by and owner of a participating private school.

2. Determine whether any teacher and administrator employed by or owner of
12a participating private school is required to register as a sex offender under s. 301.45.

(7) (i) 1. a. Notwithstanding subch. II of ch. 111, except as provided in
2subd. 1. b., a private school participating in the program under this section may not
3employ a person convicted of any Class A, B, C, D, E, F, G, or H felony under ch. 940
4or 948, except ss. 940.08 and 940.205, for 6 years following the date of conviction, and
5may employ such a person after 6 years only if the person establishes by clear and
6convincing evidence that he or she is entitled to be employed.

b. A private school participating in the program under this section may employ
8a person convicted of a crime enumerated in subd. 1. a. prior to the expiration of the
96-year period following the conviction, if the private school receives from the court
10in which the conviction occurred a certificate stating that the conviction has been
11reversed, set aside, or vacated.

2. A private school participating in the program under this section may not
13employ a person required to register as a sex offender under s. 301.45.".
