TO 2011 SENATE BILL 93

SB93-SSA2-SA2,1,11 At the locations indicated, amend the substitute amendment as follows:
SB93-SSA2-SA2,1,4 21. Page 2, line 9: after "weapons;" insert "providing information to a firearms
3dealer when purchasing a handgun; authorizing the Department of Justice to
4prosecute violations of certain laws regulating firearms; receiving a stolen firearm;".
SB93-SSA2-SA2,1,5 52. Page 11, line 3: after that line insert:
SB93-SSA2-SA2,1,7 6" Section 35d. 175.35 (3) of the statutes is renumbered 175.35 (3) (a) and
7amended to read:
SB93-SSA2-SA2,1,108 175.35 (3) (a) Any person who intentionally violates sub. (2), (2e), (2f), or (2j)
9shall be fined not less than $500 nor more than $10,000 and may be imprisoned for
10not more than 9 months.
SB93-SSA2-SA2, s. 35n 11Section 35n. 175.35 (3) (b) of the statutes is created to read:

1175.35 (3) (b) 1. Except as provided in subd. 2., a person who intentionally
2violates sub. (2e) shall be fined not less than $500 nor more than $10,000 and may
3be imprisoned for not more than 9 months.
SB93-SSA2-SA2,2,84 2. A person who violates sub. (2e) by intentionally providing false information
5regarding whether he or she is purchasing a firearm with the purpose or intent of
6transferring it to another whom the person knows or reasonably should know is
7presently prohibited from possessing a firearm under state or federal law is guilty
8of a Class H felony and shall be fined not less than $500.
SB93-SSA2-SA2, s. 35s 9Section 35s. 175.35 (4) of the statutes is created to read:
SB93-SSA2-SA2,2,1410 175.35 (4) The department of justice or the district attorney may institute,
11manage, control, and direct, in the proper county, a prosecution for violation of sub.
12(2e) that is punishable under sub. (3) (b) 2. When prosecuting such violations, the
13department of justice shall have and exercise all powers conferred upon district
14attorneys.".

7of this subsection.".
