Amendment ASA1-AB40

AB40-ASA1,1348,19 (b) The Wisconsin Economic Development Corporation shall submit to the joint committee on finance a request for that committee to supplement the appropriation account under section 20.192 (1) (r) of the statutes, as affected by this act, for the purpose of an aircraft maintenance and repair company grant program to be administered by the Wisconsin Economic Development Corporation. The Wisconsin Economic Development Corporation shall use the program to provide grants to companies included in the 2007 North American Industry Classification System as aerospace product and parts manufacturing or to support activities for air transportation companies that create or retain jobs in this state. The Wisconsin Economic Development Corporation shall submit to the joint committee on finance a plan and policies for awarding grants that ensure grant recipients are retaining or creating jobs. The Wisconsin Economic Development Corporation shall include, in any grant contract, requirements that the grant recipients provide the corporation with documentation and other financial statements of grant expenditures and with quarterly reports containing information related to job creation and retention as determined by the corporation. The Wisconsin Economic Development Corporation shall include in the contract penalties for noncompliance with these requirements.

AB40-ASA1,1349,2 (c) If the joint committee on finance approves the plan and policy the Wisconsin Economic Development Corporation submits under paragraph (b), the committee, from the appropriation account under section 20.865 (4) (u) of the statutes, may supplement the appropriation account under section 20.192 (1) (r) of the statutes, as affected by this act, by an amount that is sufficient to implement the grant program under paragraph (b), but not by more than $2,000,000 in each of fiscal years 2013-14 and 2014-15.

AB40-ASA1,1349,6 (d) By January 1, 2015, the Wisconsin Economic Development Corporation shall report to the joint committee on finance the amount of grant money awarded and the number of jobs created or retained as a result of the grant program under paragraph (b).

AB40-ASA1,1349,7 (1q) Response to audit.

AB40-ASA1,1349,8 (a) Definitions. In this subsection:

AB40-ASA1,1349,13 1. "Audit report" means the legislative audit bureau's report 13-7, submitted to the joint legislative audit committee in May 2013 and setting forth the legislative audit bureau's findings, conclusions, and recommendations concerning improvement of WEDC's administration of its economic development programs, its financial and personnel management, and the governance of its operations.

AB40-ASA1,1349,15 2. "Economic development program" has the meaning given in section 238.01 (3) of the statutes.

AB40-ASA1,1349,16 3. "WEDC" means the Wisconsin Economic Development Corporation.

AB40-ASA1,1349,17 (b) Appropriations.

AB40-ASA1,1349,24 1. `Operations and economic development programs.' In fiscal year 2014-15, the joint committee on finance may supplement, from the appropriation under section 20.865 (4) (a) of the statutes, the appropriation under section 20.192 (1) (a) of the statutes for the purposes specified in section 20.192 (1) (a) of the statutes, and may supplement, from the appropriation under section 20.865 (4) (u) of the statutes, the appropriations under section 20.192 (1) (r) and (s) of the statutes for the purposes specified in section 20.192 (1) (r) and (s) of the statutes, if all of the following occur:

AB40-ASA1,1350,3 a. WEDC submits a report to the joint committee on finance that shows that WEDC is complying with the recommendations of the legislative audit bureau in the audit report.

AB40-ASA1,1350,6 b. The chief executive officer of WEDC testifies concerning WEDC's report under subdivision 1. a. at the second quarterly meeting of the joint committee on finance in fiscal year 2013-14.

AB40-ASA1,1350,9 c. The joint committee on finance determines, based on the information it receives under subdivision 1. a. and b., that WEDC is complying with the recommendations of the legislative audit bureau in the audit report.

AB40-ASA1,1350,15 2. `Marketing expenses.' In fiscal year 2013-14, the joint committee on finance may supplement, from the appropriation under section 20.865 (4) (a) of the statutes, the appropriation under section 20.192 (1) (a) of the statutes for marketing expenses of WEDC if WEDC submits a plan to the joint committee on finance specifying the extent to which WEDC's future marketing expenses may be funded from WEDC's existing funds, rather than from additional GPR funding.

AB40-ASA1,1350,18 3. `Finding of emergency not required.' Notwithstanding section 13.101 (3) of the statutes, the joint committee on finance is not required to find that an emergency exists in order to supplement an appropriation under subdivision 1. or 2.

AB40-ASA1,1350,19 (c) Reports to joint legislative audit committee.

AB40-ASA1,1350,22 1. `Economic development programs.' No later than October 1, 2013, WEDC shall submit a report to the joint legislative audit committee that describes in detail WEDC's efforts do all of the following:

AB40-ASA1,1350,24 a. Create all required economic development program rules or policies and procedures.

AB40-ASA1,1351,5 b. For each economic development program grant or loan of $100,000 or more, require as a term of the grant or loan contract that the grant or loan recipient shall submit to WEDC a verified financial statement describing how the grant or loan moneys were spent, and enforce each such contract term to ensure that each such grant or loan recipient submits that verified financial statement.

AB40-ASA1,1351,7 c. Develop at least one expected result for each goal of each economic development program that WEDC administers.

AB40-ASA1,1351,9 d. Ensure that each recipient of an economic development program grant or loan submit all progress reports required in the grant or loan contract.

AB40-ASA1,1351,12 e. Verify the performance information being reported to WEDC by economic development program grant and loan recipients by annually conducting a review of a representative sample of grants and loans issued by WEDC.

AB40-ASA1,1351,15 f. Ensure that WEDC's annual report under section 238.07 (2) of the statutes presents clear, accurate, and complete information concerning each economic development program's results.

AB40-ASA1,1351,20 2. `Outstanding loans.' No later than October 1, 2013, WEDC shall submit a report to the joint legislative audit committee that covers the period from January 1, 2013, to September 30, 2013, and describes in detail the status of all outstanding economic development program loans for which WEDC was responsible during that period, including all of the following:

AB40-ASA1,1351,22 b. The total number and outstanding balance of loans WEDC forgave.

AB40-ASA1,1351,24 c. The total number and outstanding balance of loans WEDC referred to the department of justice for collection proceedings.

AB40-ASA1,1351,25 d. The total number and outstanding balance of loans WEDC wrote off.

AB40-ASA1,9151 Section 9151. Nonstatutory provisions; Workforce Development.

AB40-ASA1,1352,3 (2) Transfer of disabled veterans' outreach and local veterans' employment representative programs.

AB40-ASA1,1352,4 (a) Definitions. In this subsection:

AB40-ASA1,1352,10 1. "Approval" means approval by the secretary of the federal department of labor of a plan submitted jointly by the department of workforce development and the department of veterans affairs for transfer of the administration of the disabled veterans' outreach program and the local veterans' employment representative program from the department of workforce development to the department of veterans affairs.

AB40-ASA1,1352,12 2. "Disabled veterans' outreach program" means the disabled veterans' outreach program under 38 USC 4103a.

AB40-ASA1,1352,14 3. "Local veterans' employment representative program" means the local veterans' employment representative program under 38 USC 4104.

AB40-ASA1,1352,23 (b) Approval by secretary of federal department of labor. The department of workforce development and the department of veterans affairs, jointly, shall prepare a plan for transfer of the administration of the disabled veterans' outreach program and the local veterans' employment representative program from the department of workforce development to the department of veterans affairs and shall submit that plan to the secretary of the federal department of labor for approval. If the secretary of the federal department of labor approves the plan, administration of those programs shall be transferred from the department of workforce development to the department of veterans affairs as provided in paragraphs (c) to (i ).

AB40-ASA1,1353,3 (c) Assets and liabilities. On the effective date of approval, the assets and liabilities of the department of workforce development that are primarily related to the disabled veterans' outreach program or the local veterans' employment representative program, as determined by the secretary of administration, shall become the assets and liabilities of the department of veterans affairs.

AB40-ASA1,1353,9 (d) Positions and employees. On the effective date of approval, all positions and all incumbent employees holding those positions in the department of workforce development performing duties that are primarily related to the disabled veterans' outreach program or the local veterans' employment representative program, as determined by the secretary of administration, are transferred to the department of veterans affairs.

AB40-ASA1,1353,15 (e) Employee status. Employees transferred under paragraph (d ) have all the rights and the same status under subchapter V of chapter 111 and chapter 230 of the statutes in the department of veterans affairs that they enjoyed in the department of workforce development immediately before the transfer. Notwithstanding section 230.28 (4) of the statutes, no employee so transferred who has attained permanent status in class is required to serve a probationary period.

AB40-ASA1,1353,20 (f) Tangible personal property. On the effective date of approval, all tangible personal property, including records, of the department of workforce development that is primarily related to the disabled veterans' outreach program or the local veterans' employment representative program, as determined by the secretary of administration, is transferred to the department of veterans affairs.

AB40-ASA1,1354,3 (g) Pending matters. Any matter pending with the department of workforce development on the effective date of approval that is primarily related to the disabled veterans' outreach program or the local veterans' employment representative program, as determined by the secretary of administration, is transferred to the department of veterans affairs. All materials submitted to or actions taken by the department of workforce development with respect to the pending matter are considered as having been submitted to or taken by the department of veterans affairs.

AB40-ASA1,1354,11 (h) Contracts. All contracts entered into by the department of workforce development in effect on the effective date of approval that are primarily related to the disabled veterans' outreach program or the local veterans' employment representative program, as determined by the secretary of administration, remain in effect and are transferred to the department of veterans affairs. The department of veterans affairs shall carry out any obligations under those contracts unless modified or rescinded by the department of veterans affairs to the extent allowed under the contract.

AB40-ASA1,1354,21 (i) Rules and orders. All rules promulgated by the department of workforce development in effect on the effective date of approval that are primarily related to the disabled veterans' outreach program or the local veterans' employment representative program remain in effect until their specified expiration dates or until amended or repealed by the department of veterans affairs. All orders issued by the department of workforce development in effect on the effective date of approval that are primarily related to the disabled veterans' outreach program or the local veterans' employment representative program remain in effect until their specified expiration dates or until modified or rescinded by the department of veterans affairs.

AB40-ASA1,1355,6 (b) The unencumbered balance in the appropriation account under section 20.505 (6) (km), 2011 stats., is transferred to the appropriation account under section 20.455 (2) (k) of the statutes.

AB40-ASA1,1355,10 (c) The unencumbered balance in the appropriation account under section 20.505 (6) (m), 2011 stats., is transferred to the appropriation accounts under section 20.455 (2) (m) and (5) (ma) of the statutes, as determined by the department of administration.

AB40-ASA1,1355,14 (d) The unencumbered balance in the appropriation account under section 20.505 (6) (p), 2011 stats., is transferred to the appropriation accounts under section 20.455 (2) (n) and (5) (mh) of the statutes, as determined by the department of administration.

There is transferred from the appropriation account under section 20.505 (1) (is) of the statutes, as affected by this act, to the appropriation account under section 20.155 (3) (g) of the statutes, as created by this act, $4,300,000 in the 2013-14 fiscal year.

AB40-ASA1,1357,5 (1) Supplementation of appropriations. Before July 1, 2019, the secretary of employee trust funds may request the governor to supplement any sum certain appropriation from the public employee trust fund for the purpose of modernizing business processes or integrating information technology systems of the department of employee trust funds. Upon receiving such a request, the governor may approve or modify the request. If the governor proposes to approve or modify the request, the governor shall notify the joint committee on finance in writing of his or her proposed action. If, within 14 working days after the date of the governor's notification, the cochairpersons of the committee do not notify the governor that the committee has scheduled a meeting for the purpose of reviewing the proposed action, the supplements proposed by the governor are approved. If the cochairpersons notify the governor that the committee has scheduled a meeting for the purpose of reviewing the proposed action, the supplements may be made only upon approval of the committee.
