(6) (e) 2. Subject to subd. 3., beginning in the 2013-14 fiscal biennium,
8and at the beginning of each fiscal biennium thereafter, the department shall adjust
9the maximum payment rates under pars. (a) to (d) by a percentage that is equal to
10the percentage change in the U.S. consumer price index for all urban consumers, U.S.
11city average, for the 24 months ending on December 31 of the previous year, as
12determined by the federal department of labor, except that the department may
13make the adjustment only if the percentage is a positive number.
