ASSEMBLY AMENDMENT 3, TO ASSEMBLY BILL 142

AB142-AA3,1,1 At the locations indicated, amend the bill as follows:

AB142-AA3,1,2 1. Page 1, line 4: before that line insert:

AB142-AA3,1,3 " Section 1b. 66.0409 (title) of the statutes is amended to read:

AB142-AA3,1,4 66.0409 (title) Local regulation of firearms weapons .

AB142-AA3,1c Section 1c. 66.0409 (2) of the statutes is amended to read:

AB142-AA3,1,11 66.0409 (2) Except as provided in subs. (3) and (4), no political subdivision may enact an ordinance or adopt a resolution that regulates the sale, purchase, purchase delay, transfer, ownership, use, keeping, possession, bearing, transportation, licensing, permitting, registration or taxation of any knife or any firearm or part of a firearm, including ammunition and reloader components, unless the ordinance or resolution is the same as or similar to, and no more stringent than, a state statute.

AB142-AA3,1d Section 1d. 66.0409 (6) of the statutes is amended to read:

AB142-AA3,2,7 66.0409 (6) Unless other facts and circumstances that indicate a criminal or malicious intent on the part of the person apply, no person may be in violation of, or be charged with a violation of, an ordinance of a political subdivision relating to disorderly conduct or other inappropriate behavior for loading, a firearm, or for carrying, or going armed with a firearm or a knife, without regard to whether the firearm is loaded or the firearm or the knife is concealed or openly carried. Any ordinance in violation of this subsection does not apply and may not be enforced.".

AB142-AA3,2,10 2. Page 2, line 7: delete the material beginning with "or by gravity" and ending with "movement is" on line 8 and substitute " or by gravity or by a thrust or movement is".

AB142-AA3,2,12 3. Page 2, line 22: delete the material beginning with that line and ending with page 3, line 3, and substitute:

AB142-AA3,2,13 "2. A person engaged in the business of manufacturing or selling switchblades.

AB142-AA3,2,14 3. A licensee or an out-of-state licensee.".

AB142-AA3,2,15 4. Page 3, line 4: delete "(c)" and substitute "(b)".

AB142-AA3,2,16 5. Page 3, line 5: after that line insert:

AB142-AA3,2,17 " Section 6m. 947.01 (2) of the statutes is amended to read:

AB142-AA3,2,22 947.01 (2) Unless other facts and circumstances that indicate a criminal or malicious intent on the part of the person apply, a person is not in violation of, and may not be charged with a violation of, this section for loading , a firearm, or for carrying, or going armed with a firearm or a knife, without regard to whether the firearm is loaded or the firearm or the knife is concealed or openly carried.".
