AB450-ASA1,1,3 1An Act to create 66.0308 of the statutes; relating to: requiring local units of
2government to cooperate with the U.S. Immigration and Customs Enforcement
3agency.

This substitute amendment requires cities, villages, towns, and counties to
cooperate with the federal Immigration and Customs Enforcement agency, to the
greatest extent possible, to facilitate the removal from this country of individuals
who pose a security threat as defined in the bill. The threats, which are currently
defined by ICE, include aliens who are engaged in or are suspected of terrorism or
espionage, pose a danger to national security, or have been convicted of certain
crimes.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB450-ASA1,1 4Section 1. 66.0308 of the statutes is created to read:
AB450-ASA1,1,6 566.0308 Policies for the apprehension, detention, and removal of
6undocumented immigrants.
(1) Definitions. In this section:
AB450-ASA1,2,2
1(a) "ICE" means U.S. immigration and customs enforcement, under the federal
2department of homeland security.
AB450-ASA1,2,33 (b) "Political subdivision" means a city, village, town, or county.
AB450-ASA1,2,54 (c) "Security threat" means a threat to national security, border security, and
5public safety, including an alien who is:
AB450-ASA1,2,76 1. Engaged in or suspected of terrorism or espionage, or who otherwise poses
7a danger to national security.
AB450-ASA1,2,118 2. Convicted of an offense for which an element was active participation in a
9criminal street gang, as defined in 18 USC 521 (a), or an alien not younger than 16
10years of age who intentionally participated in an organized criminal gang to further
11the illegal activity of the gang.
AB450-ASA1,2,1412 3. Convicted of an offense classified as a felony in the convicting jurisdiction,
13other than a state or local offense for which an essential element was the alien's
14immigration status.
AB450-ASA1,2,17 15(2) Required cooperation with ICE. To the greatest extent possible, every
16political subdivision shall cooperate with ICE to facilitate the removal from this
17country of an individual who is a security threat.
